  1. Today I have received a Claim form from Northampton Court. .. Lowell are applying for a CCJ against me now. So ignoring them has resulted in me getting this! The amount they are saying I owe is more . . I owe £1120 they say I owe £1592.55. What do I do now??
  2. So the emails I get from them saying how this debt is damaging my credit file and it wont go away ao contact them now is just a load of rubbish really? My credit wont be any worse or better if I did pay it?
  3. I have just read other peoples threads regarding lowell and its got me thinking now should I offer to pay?? I am totally fed up off the pestering and threats of door step collection etc. That I do think god ill have to pay. But obviously this is just wat they want then isnt it?
  4. Hi. I am trying to get my credit file back on track and have managed to pay off some debts but I have 3 defaulted accounts still on there all was from Littlewoods catalogue that Lowell has now took over. The accounts are 3 years old and altogether total £1120. I am going to offer a full and final settlement amount just to get rid of this debt and with the hope that removing something negative off my credit file will be better for me in the long run (is that how it works though?) Plus im sick of the letters, phonecalls and texts. I know it is my own fault so im trying to sort it. Could somebody please advise me on what I should offer? Im hoping they might accept a reduced amount. Thanks for your help.

We wanted to do a celebration cheer when he told us the outcome,but knew we couldnt in the court. so we had a little smile to each other. when we left the room,the police were nowhere to be seen. They had vanished...very quickly. During the time we was waiting in the court,before the case began. Dave,my husband,walked past the PC to go to the toilet. The PC said 'taking a long time waiting here isnt it' Dave said yes it is. The PC said 'go and put £60 under the door(of the room where the case was being dealt at) and we can then all go home!' Cheek! Anyway,we are very proud of ourselves. Thanks for updating my title.
  6. Hi everyone, Well we went to the magistrate court today and....... We won. We went along today feeling quite confident but a little apprehensive as my husband was representing himself. Both the PC and PCSO had turned up. We was waiting for 3 hours before we actually went into the court room,,,,sat in a waiting room with the coppers! The judge allowed me to sit with my husband to assist him when he has to put questions to the PC and PCSO. They had a solicitor. First up was the PCSO who said she was practically 3 lengths of the room we was in,to witness my husband on the phone. When she was acting as a spotter. The judge said..so about 100feet away..in amazement and she said yes! Now that is far!!!! Then she said how she was stood on the left side of the van mh was in. And seen him clearly on the phone. My husband said yes he was on the phone. He was talking via the Bluetooth system in the car. One hand on the steering wheel and one arm resting on the window with his hand at the side of his face as he was driving at such a slow pace. The phone was in a cradle. So onto the PC. He was quite flustered on the off. He just didn't seem prepared for the questions his own solicitor was going to ask him. There was a few discrepancies the judge picked up on too. When my husband was told to pull over last aug he tried to demonstrate how the Bluetooth system worked. Soon as the engine is on,the phone straight away pairs up to the in car system. The PC wasn't interested and demanded for him to pay the fine and take the points. He wasn't ready to listen to my husband. He hadn't seen my husband with the device in his hand at all but did lie and say the phone was on his lap. At this point the Judge cut in and said how the phone could be anywhere in a car..on a lap,on the floor,on a seat,in a cradle...anywhere BUT in a hand whilst driving. So for the PC to say it was in his lap didn't make any difference to the judge. There's was other things the PC failed to answer to too. At this point he was sweating. When it was our turn to ask questions my husband asked 'did you see me driving with the phone in my hand' 'did you let me demonstrate how the Bluetooth system worked?' Then 'what did you say to me about paying the fine' he said he didnt remember word for word so my husband said 'I remember we'll word for word what you said that day as I wrote it down straight away,you said You might a swell pay the fine and take the points,as I get paid no matter what for attending court and you probably wont and will lose a days wage so save yourself all the earache and pay it' At this point the PC looked incredibly embarrassed. I'm so glad he said this as it was in my eyes...a bullying tactic. Now it was my husbands turn. He just told the truth. Yes he was on the phone,via the Bluetooth. He did everything the PC said except pay the fine etc. Their solicitor asked 2questions and tried her best to get him to panic or fluster but he had no reason too as he did nothing against the law. She said the PCSO DID see you on the phone didnt she??? My husband said Yes she did see me talking whilst on the phone...via the Bluetooth. There wasnt anything more for her to say. At this point the Judge came to the end and stated.. '''how my husband had never denied he was on the phone. But he was doing it via his Bluetooth. He was resting his arm to his face as he was driving at crawling pace due to the very slow traffic. He said how the PCSO might have in her own defence,truly thought she'd seen his phone at his ear but from such a distance and as the van had no window at the back it was very unlikely. He said how the PC stated the phone was on his lap..but that makes no difference, it wasn't in his hand. He said how my husband could've paid the fine and took the points but he didn't and attended court today,represented himself to prove he wasn't guilty of this offence. Therefore he acquitted the case in my husbands favour! So so glad we stuck to our guns and carried on. We had had so many letters offering us 'one last chance' to pay the fine and take the points. And at times..usually after I'd sent them the no reply...I would panic. Waiting in court today on our own whilst the police had their own solicitor with them frightened me a little. And I would have little doubts that were going to lose. But thankfully we did well and the judge listened to our side. Sorry if I bored you with every little detail but just wanted to share with you how the day went. Never be bullied into paying a fine and taking points if you know fair well you have done absolutely nothing wrong. Thanks
  7. Update...We have now been given a date for the court hearing. So I shall update this thread when we know the outcome.
  8. Hi thanks for that. Things did certainly get sidetracked on here. My husbands mobile was in the device holder on the dashboard and he never touched it. On the officers statement he's put it was on my husbands lap! Which was false! We have sent the form back now to say he is not guilty and going to see what happens. We did have a big think about it and thought should we just give in and plea guilty...pay the fine now...just give up after both the PC and PCSO statements have false accusations,but then we thought about it ..it's wrong. Not being bullied into paying this. He was doing nothing wrong. The PC did not put on his statement regarding "you might answer pay it now as I get a day off work blah"

  13. He was talking via the stereo and the speakers. He didn't have a ear device thingy. I'm worried that they'll now say how he should've had both hands on steering wheel then or just something else to get him done for. Like all different things that I never knew you could get in trouble for.
  14. Thanks for reading and replying..I know it's abit long winded. Yes we will say the PC must've been mistaken... He's come across in his statement as tho dave was cocky..if you was to read that,that is how you think dave was. He wasn't, he was totally frustrated that he was saying he didn't have the phone in his hand and the PC said that he was! He kept saying.. Listen you just might as well pay the fine! Are they targeting to get so many fines or something?
  15. Last August my husband was stopped by police for what he thought was a routine check. He was in his work van and pulled over to the police. He came over and said...do you know what you have been pulled over for today? My husband said..routine check? No he said..for using your mobile whilst driving!! Now my husband had the phone in a holder stuck on to the dash board with the phone in it and was talking to someone via his Bluetooth device on his stereo. The other person was still on the phone and the officer could hear him thru the stereo. Yet he still wanted to fine my husband.. the officer said .."you might as well pay the fine now". He said that he didn't have the phone in his hand once etc and refused to pay the fine. He was driving with his elbow resting on the window n his hand to his head/ear whilst driving with his left hand. This must of looked like he had the phone to his head but he didn't and when he got to the officer he had put his hand back on the steering wheel and the phone was clear to see on the dashboard in front. In dec we got a letter from the ticketing office offering our "final offer" to pay the fine before it goes to court. Once again we refused. So yesterday the Summons arrived, with 2 witness statements and we are fuming. One was from the PCSO who was acting as a spotter, who "seen" Dave driving with a mobile phone in his right hand. She then contacted the Pc who was further up the road waiting to stop dave. The pcs statement says that once he stopped dave, that dave picked up the mobile from his lap and said 'ill ring you back' . Dave did say that but thru the Bluetooth device...he didn't have the phone on his lap.. The pc lied on his statement!!! He also said that he asked dave to demonstrate how the hands free device works and apparently twice it didn't work. .after the third time it worked and the pc suggested it was faulty and that's why he had the phone to his ear.... All this was utter rubbish. The pc hadn't put in his statement how dave " might as well just pay the fine!!!""" It ends by saying that the pc reminded dave that he was under caution and asked if he would like to reply... And dave said 'SEE YOU IN COURT". This is all so different to what actually happened. I'm just frightened to carrying on fighting this as its like 2 police people saying one thing and Dave telling the actual truth...who are the courts going to listen to more. Pure bullies! Has anyone been through something similar or what do you think? Thanks
  16. Hi all, Ive had an awful weekend. On Friday my husband went to our local pub and someone he classed as a friend decided to rummage through his jacket pockets, pinched his car keys and take the car. He didnt drive too far without ploughing into 2 parked cars in someones drive-he absolutely wrecked our car and also one of the other cars. Police were at the scene quite quickly and caught him. Hes not got a driving licence, no insurance, was over the limit and also will be done for Taking Without Owners Consent. Our car is a write off now and we spoke to our insurance company and just gave them the details but they are waiting on the CRN. So now we no longer have a car, but i am really panicking --what exactly happens with the car finance. We took out a loan for £6033. What wil the Insurance pay- and if there is a difference who has to pay that because I am so angry theres no way we should have to. That idiot should!! I need a car and we cant even have a courtesy one because if it was getting repaired we could, but because its a write off we cant. Oh really hope someone can give me some advice please Thanks
  17. Ive had IBS for 11 years and its affected every job Ive had,I had to give up my last job as the effects of IBS gave me bad anxiety attacks 2. I hope u win ur appeal and get help. People do not realise how disabilitating it is! When u had ur medical u mite of been having a good day but when the bad days come,god I know what thats like! The medical test is pointless for IBS sufferers!!! Good luck on ur appeal, and keep us informed on the progress!

  19. Thankyou so much for all your replies. To be honest,with Xmas coming up I just chose to ignore this debt and forget about it for abit..Now Im back!!! And got to get it sorted!!! I got another little snidey letter saying how someone will be coming to vist me within the next week! It is a bill from Eon originally,for electric used at a previous address..Sept 2008- feb 2009. They say I owe over £500 and i definately dont! And I moved out of that address Jan 6th! So basically my word against theirs!! What letter shall i send to the leeds ****???? Thankyou all once again!
  20. Sorry I cant give you any advice,I am just totally gobsmacked at how low these awful DCA can go...14 years ago..14!!!!!! Theyll try anything wont they! ..totally hate these DCA ****!!! Dont back down..they surely dont have a leg to stand on!
  21. Hi Huff&Puff.. I did have a thread re the certain company who i keep getting nasty letters from. It was Advantis,but now its LCS based in Leeds. This was the last post I put up on my Advantis thread........... New Update...And more help needed Please! xxxx Hiya Everyone ...Well I sent letter 18..the prove it one,then the next letter because they hadnt confirmed my details within that time limit! Then I received a letter from Advantis saying..FINAL RESPONSE. stating that THEY ARE NO LONGER DEALING WITH MY ACCOUNT,that E-ON HAD NOTIFIED THEM TO CEASE COLLECTION. that THE ACCOUNT HAS BEEN CLOSED AND NO FURTHER ACTION WILL BE TAKEN BY THEMSELVES!!! But they also let me know that Utility companies are not covered by the Consumer Credit Act 1974? Is it not?? Wat rights do i have then? Anyway today I receive a Demand letter from a New DCA, LCS regarding this same account,telling me to pay up etc.. Where do I go from here... ......... Ive now had another letter(because I ignored that 1st one) saying thyll send a rep round or theyll advise a solicitor to take me to court. What rights do they and I have? I really need all this before Xmas..wat complete S***heads!!!!!!!!! Thanks

  23. Are Utilities companies not covered by the Consumer Credit Act 1974? Im having problems with Eon..as in my other post..Advantis..advice needed!
