  1. Hi, I'm not too sure about subsidies from the govt or council etc... but I think you must start up with a Limited (Ltd) company to do a business. Although A Private partnership is good for flexibility - Its best to forget flexibility and go for limited liability - in case things go wrong. So Sorry to put a negative spin at the word Go! but... I know that in every businesses things are always really bad between partners when: 1 . There is a lot of money coming in 2. There is no money coming in I've seen the best of friends start fighting... Its also best to be upfront & transparent in business (nothing to hide) as this policy gives the strongest roots which reaps the best rewards in the long run. All Agreements, Shares, Liabilities, Loans (private or from a bank), Work Duties & Responsibilites are best fulfilled when this is laid out at the beginning. This then gives each partner thier Motivation & Satisfaction to work at thier absolute Best! With Limited Liability = The Fear Factor is taken out!!! Which helps a great deal (if & when things go wrong) & so my advice is GO LTD Register with Companies House & then move forward from there. All the Best!!! ASM
  2. Hi jdes26, I've left all the paperwork at my mums place... but will check it tommorrow, although I dont think there was any PPI - I've never had that insurance. What do you mean you were shoked when you received yours? is this hidden in amongst other stuff that i should look out for? please let me know thanks asm

  4. Hi Cerberusalert, Thanks for your reply to my post. I'm sorry I don't understand when you ask have they defaulted me on this a/c what you mean. No they have not sent me a default notice - actually I have been paying for the minimum on this regularly & have not missed a single payment - although going thru hard times. Regards asm

This is what I have replied to MBNA and intend to post tommorow (31/10/09) about what may pssibly be a cut & paste application turned into agreement? 31st October 2009 SENT VIA HM POSTAL SERVICE - RECORDED DELIVERY BR xxxx xxxx xGB Dear Sirs, Re: Credit Card Agreement No: xxxx xxxx xxxx xxxx Thank you for your reply dated 13/10/2009 to my request dated 29/09/2009 under section 77-79 of the Consumer Credit Act 1974. I note that you have replied to the above by sending an illegible copy of the application form. I must inform you that this is not sufficient to comply with the request and that your company is still in default under the Act. A copy of the Credit Agreement (my signed copy) is illegible To clarify, The Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983 SI No. 1557 states: Legibility of notices and copy documents and wording of prescribed Forms 2.-(1) The lettering in every notice in a Form prescribed by these Regulations and in every copy of an executed agreement, security instrument or other document referred to in the Act and delivered or sent to a debtor, hirer or surety under any provision of the Act shall, apart from any signature, be easily legible and of a colour which is readily distinguishable from the colour of the paper. I hope this explains why your reply was unacceptable. I await a True copy of my agreement and would remind you again that whilst the request has not been complied with the default continues. This is what I have replied to Capital One today: 30th October 2009 SENT VIA HM POSTAL SERVICE - RECORDED DELIVERY xx xxxx xxxx xxGB Dear Sirs, Re: Credit Card Agreement No: xxxx xxxx xxxx xxxx Dear Sirs, Thank you for your letter dated 05/10/2009 in which you say that you will not comply with my request dated 28/09/2009 under s.78(1) and s.78 of the `Consumer Credit Act 1974 unless I provide you with a signature. There is no requirement under the Act that require a s.78(1) and s.78 request to be accompanied by a signature, and I am unable to accede to your request. Further, I note that you have sent statements and correspondence containing sensitive private information to me at same address as that detailed in my s.78(1) request. If you are concerned that you are corresponding with the correct person I wonder why you have not verified the information before. As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998. The time to confirm my identity was before you sent your first threat letter. My request for a true copy of my credit agreement under section 78(1) was made on 28/09/2009 and the 12 working days for your compliance expired on 10/10/2009. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity. Please now comply with your legal obligation without further delay. Thanks a lot old_andrew, that i'm sure will help, I was just thinking i wish i could post during the day, but am working (maybe i'll try from work now & again), i end up posting late nights since after work, dinner, cleaning up, putting the kids to bed - then switch on the computer & see if i have the energy! it does seem that one's posted at night seem to get a lot less attention than maybe during the day as i've noticed in many others posts. could be there's something i'm doing wrong as well! anyway, it does help to know how to get the post up top again thanks again ASM

I'm following this with a knot in my stomach - trying to do some cases of my own & family, i am very new to this and having looked around i really feel there really have great help in this forum. I know this doesn't help your case any but dont feel low! Think Positive, and keep at it, you're almost there & looks like a celebration is on its way soon! God Bless ASM
