  1. I too have suffered at the hands of SPML/Capstone/Ascenden and am currently in a suspended possession order. What I did which has been of huge help to me is got the judge to change the date of my payment. This has meant that when Mr gets paid in middle of the month, I call and pay by debit card and now they cant charge me for late payments which means my arrears (which now are all charges!!!!) are actually coming down. This may be something you want to consider asking for yourself as this is one way they ensure you are forever in arrears!!!!! Don't worry too much there is plenty of time to

I have been in that position a few times now and have never really had to say a lot, just answered the questions, at my last and fingers crossed final hearing the judge was lovely but did tell me rather sternly that I must stick to this and 7 months down the road it all seems to be going well again.   9. I won't lie to you its not a nice place to be, but when you go into see the judge its almost like a meeting sat around a table with mr/mrs judge at the head of it. Go smartly dressed, this will show the judge you are serious in getting this matter resolved and address as sir/madam. When you arrive you will see someone to say that you are there and more than likely there solicitor will pay you a visit. Stay firm in your decisions and dont let them bully you into anything.   11. Hi, just thought I would add to this post. In relation to the court papers, you will need to enter a defence, put everything you have in copies of all emails, contracts etc, I dont exactly know what to put in a defence but that is definatley something you should do before they get a CCJ against you.

  13. For some time now I have been paying back a loan with FLM Quick. This is not a problem and getting paid. My issue is that I have a guarantor on the account and she is getting constantly hassled by them to update her details. She doesnt want to as she knows it is being cleared but getting sick to death of the hassle. Any ideas what to do? Can I complain to OFT? All advice would be appreciated, she is a good friend and doesnt need the hassle. Thanks

  15. Do you have any other accounts you could use. Just because WDA are such devious swines that I dont want to see them clearing your account again. If you had another account at least you will be safe in the knowledge that they have no access to your money

  18. How long ago did they cash your cheque, not an expert but I do believe they have 40 days to comply with the request. If they dont comply I would imagine you could go to the Financial Ombudsman Service. Do you have any proof other than the date they cashed the cheque? Legally they are bound to send you this information.

  20. I think you need to do exactly what ell tells you and you will be fine, the woman is a saint! The really important thing to remember is that the minute you breach a court order they will jump at the opportunity to take back control and if at all possible your home! Send the letter, await their response, make that payment on the 28th and if necessary apply for another N244. If they refuse to change the date and a court can see you regularly pay on that date I believe you will be fine. xx
  21. If you can show you can and do keep up your monthly payments your chances are good. Remember judges dont want to see you out of your home and it is the last resort. If you dont mind me asking how much are your arrears and how many times have you had to endure this horrible stress? I had 5 eviction notices and appeared in court 3 times and fingers crossed it was 3rd time lucky xx
  22. My experience with Capstone sounds very similar, the reason they got me to eviction stage was mainly charges due to late fees which mounted and mounted!!!! Until the 3rd time I found myself infront of a judge I had fought with them about changing the date and they always said no and like you everytime I was late with the payment another eviction notice came my way!!!!! Thankfully the judge I had understood the reasons why payments were delayed (my husband gets paid on 15th of the month) and ordered that my payment date was changed according to my needs. This was 6 months ago and so far

I am currently furious with them (more so than the norm), I successfully won a suspension of eviction in June and had my payment date changed to suit me by the judge. I have religiously kept up with my order the only thing about it I dont like is that I have to pay by debit card so it means once a month speaking to the cretins. Sorry cant stand them) Looking back, in June my arrears were £3719 including charges which are not with FOS, they have so far offered me £500 to drop the case, I dont think so! My arrears now including charges are £2800 all but £100 are charges! We are working very hard to keep the arrangement and always round our payment up to the nearest pound not muc
