  3. Can someone help me on how I can go about complaining about the sale of my mortgage to SPML/C®apstone. We were sold this mortgage 2 years ago when my husband was the onlywage earner brining home around £1100 after tax etc. Naively and desperately we took the brokers word for it that we could afford this mortgage. Almost immediately we fell into arrears due to the payments being £750 per month!!!! I have a complaint lodges with FOS due to the charges being imposed on us for being in arrears but how can I go about processing a claim for a mortgage which in all honesty should nev
  4. if you have received from your local court a Notice of Eviction with that date, that is the day they want to repossess your property. if you have been to court before and were awarded a suspended order of possession then they dont need to see you in court again they can activate the warrant immediately (from my limited knowledge). But dont worry have all info like your total arrears with and without charges ready and you will have a case to apply for a application to suspend the warrant

  6. Not a great expert in terms of repossession that is definately Ell-en as have been going through a simalar thing, and she has been absolutely superb!!!! On terms of PPP I am quite clued up as I work for a company that get people their mis sold PPP back. It is definately possible for you to do this yourself for free and not difficult. PPP is optional and not compulsory! What I would suggest is to have as much info ready for when Ell-en comes on and dont think the worst as there is usually always a way. Hope that helps a bit

Just a thought have you tried to contact Shelter on 0300 3300 515 (sorry if I shouldn't put phone numbers on ) They are open 8-8 every day and I found them very helpful and not at all condecending which can be a problem and very upsetting when you are in this situation. They were able to give me local places to contact if I needed it. Thank fully it appears we no longer do. Sorry I know its not much help
  8. Rather interesting phone call from Capstone today. Before they called me they have apparantly cancelled the eviction and are happy for my proposals to go ahead as of 1st Feb!!!!! I will be attending court tomorrow though as I want to make sure this is the case, kind of feeling victorious but at the same time very sceptical. We shall see

  10. I have just been on the phone to the lovely Capstone. This was to see if they would accept my proposals for the repayments of my arrears for when we meet in court Thursday. She told me there was an arrangement in place providing they find the missing payment which I posted them proof of last week. Conveniently this letter has not been received. They said they would keep looking, but I told them that I did not trust the company in any way and honestly doubt that even if they receive the proof it would be actioned I also mentioned the fact I had logged a complaint to

  12. Ell will be the best person to answer that question, the help and advice she has given me so far has been second to none. Have you ever actually been taken to court by them? I think most judges are sympathetic if you can show that you can meet the contractual repayments plus some of the arrears, that is what I am holding on to anyway.
  13. I would agree with chillinlong, thats what I thought happened. But this is Capstone and they don't seem to like the rules very much. From my experience with them (in court on Thursday to stop repo!) they will have added a whole heap of charges, see if you can get a copy of your arrears statement. The lovely (NOT) lady I spoke to for one told me that would cost £35 to which she got the answer "I don't think so, if I can get a Subject Access Request for £10!", hence a statement was sent to me straight away, then circle the charges and you can see how much your true arrears are.   14. I have also submitted my N244 for my case against Capstone today, in court Thursday ! I am in a position to offer to clear my arrears in a little over 3 months (not the charges they have added mind, they are just ridiculous!!!) The woman in court was really nice and told me you must attend or they will go to have the eviction take place. I hope to let the judge take control, if they accept your offer and anything goes wrong you will be in the same situation straight away, without any warning, thats what happened to me!!!

  16. The true arrears less their charges on the statement are £1109.51 then there is the payment they say I haven't made for which I attached the copy of my bank statment showing which brings the arrears down to £809.51
  17. No apologies necessary How did you go about getting them to agree on the charges? I was tempted to call them just to say that I would be in court to fight this on Thursday and that I had made a complaint to FOS but couldn't be bothered with dealing with their ignorant staff. I did speak to a guy from Shelter today, after my N244 went in and as I have offered to pay £250 off my arrears, he advised me to lower the offer due to the fluctuating LIBOR rate, but still pay what I had offered and if LIBOR goes up then I wont be stuck with an unaffordable amount.   19. Hi Sawyer. Thanks for that, it was very very helpful! I was actually a bit dim and missed a page of charges which totalled £2500 and a bit more!!! Have today lodged my complaint with FOS and also got hearing date for Thursday.

  21. I have entered my N244 and have a hearing date of Thursday at 10am. Is there anything extra I need to take in with me or say when I am there. I did receive a letter from Capstone telling me that even at this late date I can contact them to see if we can arrange a suitable repayment plan. Havent done so, hoping things go my way on Thursday I have another update, just lodged complaint with the FOS regarding the charges, will inform the judge of that too!!! I am in a fighting mood over this now

Thank Ell that looks brilliant, I have just gone over all the charges that have been added again and I missed a page This means that the total amount of charges added to my account are £2564.38!!!!!! With the payment they haven't included my true arrears only actually total £809.51, its mad that companies get away with taking peoples homes because of their charges:eek:
  23. I have to say as soon as I mentioned statute of limitations, the woman said that this case would be closed!!!! They can keep selling it on, I will continue to state the same thing LOL
