Thanks for all your replies. Nice! My feeling is that they are trying it on. I am almost certain that they can't seize my car as it is not owned by me due to being part of the motability scheme. In respect of my other goods, I still don't think they can seize anything as they do not have a court warrant. Anyway, i've written to them making these points and explaining that I will continue to make the payments under the agreed installment plan. We'll see what they say.

I failed to make a payment to Reading Borough Council regarding the PCN and so it got transferred to Collect Services. Hi Guys I have a quick query regarding capital one and would appreciate your help. Basically I owe Capital One about £1,600.00. Most of this is made up of late payment charges and I must have made numerous late payment charges already. Anyway, fredrickson eventually got involved and now Bryan Carter have jumped in. I have sent the CCA letter to them and they have said that they will request this from capital one. I have heard nothing since. Now I understand that if they can't provide this then the debt is unenforceable but in the meantime can I recover the late payment charges
