Hi all, The situation: I took out a bank loan after 2007 April, the odd thing is Barclays closed the account without informing me, and reopened the loan account under a difference account number. I have only found this out by SARing them recently. Is this of any signifcances? Would the loan be invalid as Barclays closed the account without my acknowledgement. There is no new agreement under the new account. Please note that the account was closed when it was not in default, so it is not becasue they sold the account to a debt agency, as the loan was being repaid via direct d

Hi Pinky, Thanks, thats what I thought as well, I had already read what you posted on the second post, but wanted to see if others thought the same I remember reading somewhere on the forum that Egg messed up their agreement forms, hence making a lot of their agreements unenforceable. But I don't remember the exact details. The egg agreement they sent us is on 2 pages, the prescribed terms of an agreement i.e. credit limit, interest rate and repayment schedule are on page 1. The signiture is on page 2. But theres no mention of page 2 on page 1. I am not sure if that means

  6. Many thanks fox, we do want to know what will happen so we can decide what to do. We'll most likely dispute the account as they haven't provided for us what we asked for under CCA after the 12+2 days have passed, then send off the SAR.   7. Have you been defaulted? No, i.e. we are not behind on payments. Has the account been terminated? No. So basically Barclays will be able to chase up the payments again once they've found the original agreement (if they have it)?. I was thinking that it was a good sign that they haven't provided us with the orginals with the CCA request. We were going to stop the payments as we basically won't be able to keep up with the payments anymore due to the current economic conditions. But were told by some CAG people that it might be best to do CCA requests first to see where

I was under the impression that they have to send you a copy of the original if you request it under the CCA. @Alloyz1, we were hoping to not have to drag this out with the SAR i.e wait another 40 days. My orginal thinking was: 1. Send off the CCAs 2. If they don't provide a valid agreement. 3. Under Section 78, we must supply you with a copy of your executed agreement and a statement of account which is practicable to refer.   11. Uploaded, we did request a couple of CCAs from Barclays, all of the replies were the same. Some didnt have a copy of the agreement attached. Etheral
  12. Hi all, A couple of you might have seen my thread a few weeks back, we've sent off for the CCAs, and have gotten letters back from Barclays. However the agreements they sent back were "Barclaycard Agreement, A copy for you records" stating the terms and conditions. There's no sign of the signitures, dates, etc. So am I correct in assuming that this isn't what they were suppose to provide us with, as it is not a true copy, as requested using the CCA template provided by this website.   13. AOL said that they will refund the difference, but it will take 30 days, which is ridiculous. They can take money quickly but cant give it back quickly. We've simply cancelled it, and moved to another provider. The cancellation guy on the phone was rude, as expected from AOL. Etheral
  14. Hi BankFodder, About the 6years thing, I meant the agreement was taken out more than 6 years ago, and I believe my parent have been paying them off via minimum payments. I am assuming that means that they acknowledge the agreement? So that they are not statute barred? I believe my parents have no run into late payments yet, although I'll keep what you've wrote in mind. I think I'll have a talk with them, to see what action they want to take, now you've clarified some of questions that I had. Many thanks, Etheral
