  1. The debt went to a ccj I believe and amount requested per month was too high. Not really had any idea how to deal with it and have no rec'd a letter saying a charging order will be heard at Court on 22 Feb. Letter contained background bits from land registry etc.
  2. Joint owner of mortgage. Other half has a credit card debt that has a hearing next month that is going to get a charging order put on for £3000.
  3. Sorry for being stupid but what does that mean ? If property is sold after the mortgage is paid off then the full debt on charging order would still be settled ?
  4. But what if the property isn't sold and the mortgage paid off eventually ?
  5. Does anyone know ? Is it added to your mortgage or if the mortgage is paid off does it become a sole debt ?
  6. On a property ? What happens if you don't sell the house and eventually pay off the mortgage ?? Thanks in advance
  7. The letter says "Our clients application is due to be heard before the district judge in chambers at 10.00 onn 22 Feb. There is an official copy of register of title enclosed. If it is heard on 22 Feb can I state why it shouldn't be charged to our property ? Thanks a lot
  8. Its SCM Sols. A provisional date for a hearing has been set for 22 Feb. It does look as though they are willing to go thru with it. So if I were to offer a full and final settlement of 15-20 % it may be accepted ? Thanks for your reply.
  9. Cheers, It is a credit card. The letter says: Further to our letter of equal date, enclosinga copy of the original interim charging order, entirely on a "without prejudice" basis our client is willing to accept a partial payment. The letters include land registry details etc. Thanks
  10. In short, my other half has rec'd a letter from one of LTSB's collection companies who have set a date to get a charging order on our property. Just a couple of questions, as its her debt are they allowed to get an order on a joint property ? Secondly, they are prepared to take a partial settlement. What sort of partial settlement could we offer on a debt of around £3000. There have been no payments made for 18 months after job losses. Thanks for any advice.

This includes in particular, but is not limited to, the following:- 1. The original signed, executed credit agreement and any terms and conditions that applied to the account at the time of default and at the time the account was opened. 2. Transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your company, or by any previous creditor 3. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account formerly held with ORIGINAL CREDITOR. 4. True copies of any notice of assignment and/or default notice or enforcement notice that you or the original creditor sent me, with a copy of any proof of postage that you hold. 5. Documents relating to any insurance added to the account, including the insurance contract and terms and conditions, date it was added and deleted (if applicable). 6. Details of any collection charges added to the account; specifically, the date it was levied, the amount of the charge, a detailed financial breakdown of how the charge was calculated, and what the charge covers. 7. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied. 8. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998 9. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed. 10. Copies of statements for the entire duration of the credit agreement. I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Yours faithfully, And await the reply - I have also read about a £1 postal order and 14 days or 12+2 days - what is that ?
  13. I am 30, have a mortgage and a 14 month old baby. As you can guess, I'm worried to say the least. I have around £20k of debt that I have been unable to pay. How low an amount can I offer to pay back per month ? What letter do I send for CCA ? I honestly have no idea what a CCA is, what happens if they don't have the original agreements etc ??????
