  1. thanks for that. in this case she had lost the original case and there were no costs awards. she then proceeded to apeal and they awarded costs for her review case not her original case. so there must of been a strong case of her acting unreasonable and maybe the judge warned her of that. Also you can only appeal if there has been a error in the law not on your personal opinion. Thats what I've been led to believe.
  2. Thanks SweetLorraine yeah I think is one or the other from what I gather from beckys posts.
  3. this is all good to know. I was watching that case with interest and o thought costs may have been awarded if I'm honest
  4. Excellent Thank you. So I just wait for the hearing. Did the judge take into account your ability to pay or did he just throw the costs out?
  5. Thanks so the cases you dropped in on were the costs awarded? Thanks
  6. Wow thanks, did you get a detailed costs? Only becky has said not to bother ( just trying to look at all avenues and find out what is best to do before I jump in ). I dont think this is a in house solicitors but external as far as I can imagine. Is Good to have your side as well as sweet Lorraine. Can I ask where do you think Your friend went wrong or was it just a injustice? Thanks
  7. thanks so much for this, its nice to hear your situation is very similar to mine. There isn't nothing I haven't mentioned and everything from the postponement to the withdrawal can be proven. My claim was for a dispute over holiday payment for a casual worker that was for £180 and it was more of a principle that I knew they were not paying all casual workers or explaining there process on leave basically. So there was nothing Un toward about my claim. I just hope I can prove that to the judge. Did you go to the costs hearing Un represented? Thanks
  8. in reply to your last post also can I ask should the solicitor send me a detailed costs?
  9. Yes your facts are correct. I would rather have all the facts than to go into it blaze thinking nothing would happen. Do appreciate all comments though..
  10. Thanks so could I challenge this? Also sweet lorraine did the costs get accepted by the judge? Thanks again
  11. Thanks so do you think this figure is inflated? It was a straight forward unlawful deduction of wages. Thanks
  12. no just the amounts ive quoted no breakdown. Thanks
  13. Thanks for that, other people on hear have said it may make matters worse, also I don't think they will go for £200. So do you think they are panicking if they have offered a settlement? Thanks
  14. Thanks for that, So are only costs above £20,000 are the ones that go to CC or can the ET trans any costs order? Also as well as the £3000 plus vat they are saying they will try for further costs of £1500 plus vat if I didn't accept there settlement and it goes to a hearing. So £3000 for not going to a hearing £1500 for going to a hearing that could only last 15 minutes is like sweetlorraine said very inflated but also there figures don't seem correct. Thanks for that article It has put my mind to rest. Taking into account that article what are the chances of the other side realising that and defending the claim? Or are they likely to pull out? Just thinking of all avenues. Thanks
  15. Thanks very much for that, its nice to hear from someone who has been through it. im sussex based not london ( so going to do a little research. so did they apply for costs against you? Thanks and thanks Becci im not going to.
  16. Sweetlorraine, I haven't been given a date for the hearing but I know its been accepted as I have spoken with them. thanks
  17. Thank you, I am going to do that. can I ask what your experience was? Thanks
  18. Thanks, yeah your right its just a awful time to have this hanging over me with my dads illness but will take your advice and go to the hearin and will make sure I make a good statment.
  19. I don't that's the thing, just want it sorted. The dead lines tomorrow you see.
  20. I was thinking of offering £300 and paying it monthly as the deadline is tomorrow just to draw a line under it do you think they will accept? Also do you think they are likely to proceed? Should I tell them and be honest about my financial situation? Thanks everyone
