  1. This is the reply I received from DVLA. They haven't mentioned the POFA ' Information about registered keepers of vehicles can be released by the DVLA under the provisions of the Road Vehicles (Registration and Licensing) Regulations 2002. This legislation allows vehicle keeper details to be disclosed to third parties who can demonstrate that they have a reasonable cause to receive it. Reasonable cause is not defined in legislation but the Government’s policy is that it should relate to the vehicle or its use, following incidents where there may be liability on the part of the driver. Guidance on what constitutes reasonable cause is published online at www.gov.uk/request-information-from-dvla Drivers choosing to park a vehicle on private land do so subject to the terms and conditions set out on Signage in the car park. The need to contact individuals who may not have complied with these conditions is, in most circumstances, considered to be a reasonable cause. Data is provided by the DVLA to enable landowners or their agents to pursue their legal rights and to address disputes. I trust you will appreciate that if this were not the case, motorists would be able to park with disregard for the conditions applying with little prospect of being held accountable. The DVLA cannot regulate directly the manner in which a parking management company is operated. Therefore, it has no influence over the scale of charges, the length of time motorists are allowed to park or the hours the company operates parking conditions for. These are matters between the landowner and the company employed to manage the car park. While seeking to ensure that vehicle keeper data is released only in appropriate circumstances, it is not a matter for the Agency to decide on the merits of individual cases or to arbitrate in any civil disputes between motorists and private car park enforcement companies. The DVLA cannot regulate any aspect of a company’s business. Any representations should be made to the landowner or his agent. DVLA releases information on the basis that reasonable cause is demonstrated. The law allows DVLA to disclose keeper details, from the vehicle database, to law enforcement authorities or private litigants as a first point of contact to establish where liability for an incident or event may lie. Only the registered keeper can then decide whether he/she is able or willing to assist. Disclosure in these circumstances does not breach the Data Protection Act (DPA) and the Information Commissioner’s Office is fully aware that the data held on the DVLA vehicle database is released in this way.@

  3. I joined Xercise4less Falkirk in June 2014 rarely used it due to a knee injury that took ages to recover from. When I did use the gym I found it oversubscribed and young lads continually leaving weights lying around. I complained to staff but I don't think they bothered much. In June this year I finally decided to leave after I tripped over a barbell that was left lying around the floor which caused me injury and embarrassment. I emailed the Xercise4less manager informing him I was leaving. I received an out of office reply which stated he would deal with it on his return and I heard nothing more. I kept both emails and I've attached them to this post. I cancelled my direct debit a month afterwards and I thought that was the end of the matter. However I received a threatening letter today from Harlands demanding money from me because I had cancelled my direct debit. As I understand it as I was with Xercise4less for 2 years so I had already served my contract period. As I also understand I had cancelled my membership officially and I am not due Harlands any money. Clearly Harlands are making out I haven't cancelled my membership. Can anyone offer me advice how to handle this. Please see the threatening letter from Harlands and my cancellation email and their reply.

  5. That's exactly what they have done. I received a letter from them this morning. Presumably they got my details from the DVLA so from what I gather they have illegally sought my information from the DVLA. Can someone direct me in how I should word my complaint to the DVLA?
  6. Why do you want it in PDF? So I just ignore then? I thought as much but wondered why they suddenly wrote a letter after so many ignored phone calls over the last couple of years. If they do decide to take action through the Scottish sheriff court will I be informed beforehand?
  7. Maybe they read this thread as I received a letter from them today. This is only the second letter I've ever received from them. I notice they state may instead of will so I suspect it's just another threat o gram. Should I continue to ignore?

  9. I live in Scotland. Yesterday I was in my van with my father who has a blue badge. We parked in a disabled bay in a private retail park and I put his disabled badge in the window of my car. I took him to the shops but when we returned I found a PCN stuck to the driver side window. I was angry as clearly they had ignored the blue badge. They are asking for £90 which is reduced to £45 if I pay within 14 days. As this happened in Scotland is the best course of action still to ignore it as there is no legal requirement to identify the driver? I fear that by appealing it would only make matters worse as I have contacted them. Horizon parking PCN edited.pdf

  11. I told the LLA I wouldn't deal with Rossendales only them but clearly they have ignored this. Every six weeks or so Rossendales bombard me with phone calls which are automatically rejected and go straight to voice mail. They stop after a few days or so only to start again six weeks later. What surprises me is they have never sent a letter to me since the first one a couple of years back. Their only point of contact is through my mobile which is ignored. Anyone with a bit of sense would realise I'm not going to answer my mobile so would send a letter. I'm not complaining but I just think it's strange.

  13. Well I received the inevitable letter from Zenith a few days ago. They have offered me a discounted settlement of almost half of what they claim is owed. Presumably I should continue to ignore them?

    Thanks, that's an interesting read. I've always repaid any loans in full and never defaulted. Maybe that's the problem.

    Nothing on Clearscore although Rossendales did do a soft search in March last year. I score 5/5 on Noddle although I've just found out I am still financially connected to my ex partner whom I split with in 2006. I'll ask experian to remove the connection once I receive my report. I wouldn't think this would affect me though as since we split I've had a couple of loans and change my mortgage a couple of times. If she is now in financial dire straights would this affect me?

    I applied for a loan a few weeks back but was offered the loan at more than double the advertised rate which I rejected. I applied for another one last night which I was instantly rejected. I am confused at this as I have a good credit rating, in full time employment and a homeowner. I've had loans in the past no problem. I've applied for my experian credit report but it hasn't came through yet. However I was wondering if the fact Rossendales Collect (acting as DC) are chasing me for legal aid fees would have something to do with it? I've also received threatograms from DR+ for a parking fine which I refuse to pay (I'm in Scotland) Would Rossendales have entered something on to my credit report?
  18. In their letter there was a photo of me entering and leaving the car park however the time stamp on the exit was at least an hour out.

  20. I live in Scotland Last autumn I parked in a retailers car park and done some shopping at that particular retailers. I was gone for just under an hour and then drove home. A few weeks later I received a parking charge notice stating I had overstayed my 2 hour limit which was untrue. I wanted to contact them but I was advised not to contact them what so ever. I've ignored a few of their letters but have just received a threatening letter from a DRA called Debt Recovery Plus. What's the best course of action?
  21. I contacted the LLA in 2014 as I was confused about two separate debts. One was being dealt with Rossendales and the other from the LLA. I've never had any dealings with the courts before so I was confused but it transpired the LLA debt was a mistake and was meant for someone else!!!! How incompetent can they be? I asked the LLA to retrieve the file back from Rossendales as I wouldn't deal with them and haven't heard back from the LLA only Rossendales whom I'm ignoring. Maybe one day the LLA will retrieve the file back from Rossendales but I certainly won't contact them again.
  22. Coincidentally they called me this morning. I have their number on my reject list but they left a message asking to call Rossendales Collect. Clearly this won't be happening. Now that I've had time to get my thoughts together it's clear what you say must be the case. If they had any power what so ever they'd be hauling me to court. I've offered to pay the LLA direct which they say I cannot do as I'd have to speak to Rossendales which I won't do. So I'll ignore them. Am I correct in saying after 5 years in Scotland the debt is time barred? How do I create paragraphs? Once I send a post the paragraphs disappear.
  23. Maybe I'm reading this wrong but you're coming across as quite smarmy and I'm just asking a simple question. You may know the answer but I only asked for clarification on this. You said 'bogus debt' but offer no explanation as to why it's a 'bogus debt'.
  24. Nope can't see any answer. What I asked is if the LAA won't talk to me and I won't talk to Rossendales what's the likely outcome? I can't see an answer in the thread.
