  1. as the above says. I'm posting this on behalf of my neighbour who has just got back from tameside magistrates regarding her housing benefit, in 2014 I helped her fill out the form HBCT1 and that was sent off, nothing was heard for several months, then after those months passed, still nothing, so I contacted them on her behalf, needless to say she had to fill out another HBCT1 form and was awarded housing benefit. New Charter had said that she owes them a total of £3000 she was taken to court today and ordered to pay £70 every monday, Bearing in mind that she gets £62 carers allowance and her income support. so out of her benefits she has to pay £270 every month. Because she had already applied but there was no acknowledgement from the revenues sector, is there any way to claim a backdate for that period that they say she owes them... Any help and advice would sincerely be appreciated.

  3. Thats just disgusting with regards to falsifying an allegation ( should get done for wasting police time ). and there I was thinking it was just louts who tried to resort to bully boy tactics. Companies trying to basically MUG people for their money.. PSShhhhhhhh! I'm glad for their sake I cancelled my account. I'm just curious, I have to ask one question, if the police were there to ensure that no breach of the peace was ensued, why did the police observe him entering the premises which clearly was not his to enter. I know the police have already claimed blame, and dealt with accordingly. Another note. I booked an appointment with BAYV monday and their agent came today and went through the traits of form filling, I was after a tumble dryer because our one broke down and I have a child with another one on the way. but After reading this. I immediately contacted them and cancelled my order. I'm glad that no one is above the law especially these agents who think they can do what they want.

I've been with Brighthouse since last year april 4th, and started off with a laptop and was told about OSC which I was advised to get, so I did just that. purchased the OSC ontop of the laptop and DLC. My Qualms are as follows. I contacted Brighthouse several months after Renting to own the laptop, I told them that some reason my laptop was taking 5 minutes to boot I told them that it was essential that I had a laptop as I was due to DJ that night, to be told that they would not be able to issue me a loaner. Recently my laptop battery was only holding a charge on low power setting for an hour, So I contacted brighthouse and requested a replacement laptop battery to be told that it would be a couple of weeks. well thats been a month ago now. I got my fiance a desktop pc brand new desktop pc. which works perfect and no flaws, so I'm kinda swaying to the desktop pc area which is more high performance and the ability to upgrade the pc when needed. I was told that if I wanted to remove the OSC I had to start a new agreement with them without the OSC. is there any way I can recover the OSC I've paid for already.

  7. I'm sorry but this is just sickening. Who ever these people are I hope they feel better for what they have put your gf through. From experience myself and the great help I got on here I am sure that something good will come of this. Though you stated that your gf is not working so I am assuming that she is on state benefits. and if she is, she should be able to claim both housing and council tax benefit which can be backdated though I can not remember just how long it can be backdated to, though I know for a fact that if there were special circumstances that the backdated benefits can go further. This just goes to show though that bailiffs do not take anything into consideration ESPECIALLY at the sight of a frightened woman, These bullyboy tactics have got to stop, especially as she is classed as a vulnerable person as she is on benefits, is a single parent. Trust me though with Hallowitch here your seriously in good hands. The one thing I would suggest you do is just be there for her, as those sobs can be seriously intimidating.
  8. From my experience with these guys, they dont care about personal circumstances, though there maybe the few exceptions. But either way you look at it, These enforcers try to do what they can when they can with hardly any thoughts to consequence.

I voted no on this matter because if it costs more for a person to use a bus for a week to get to work normally 5 days a week, it costs less to fill a car with petrol and the bus costs these days where I am for 5 stops its £2.80 and a day saver costs £3.80 so if you work it out. thats £19 where a tenner in petrol would efficiently cost less, Yes you may say but tax, insurance, but in the long run, taking away someones transportation when there is a recession going on will only deprive them which in turn means that anyone whos car has been taken by a bailiff means that in effect the car owner could lose out in the long run, ok so you have gotten your money back, but what if that person has a family, or that person relies on that mode of transport. I'm sorry but if someone owed me money, I would speak to them one way or another and get them to sign an agreement which would state that if a payment has been missed then it would go further. so No is my answer.

I also would like to thank the Enforcement Officer for trying to make me pay in full because as a result I only have to pay the fine of £125 instead of the £350 she was trying to collect from me, because if she had accepted the payment plan I had proposed to her from the start of this fiasco, she would have been in pocket.
  11. you guys may have been reading on my previous thread regarding the position that I was in regarding the tv license fine. After a serious amount of time in being persistant on the telephone with the Finance department at the local court and thankfully enough I was going through all my paperwork earlier and came across a photocopy of the statement of means that I had sent them back in April 2009 I was speaking with a guy at the court who was fantastic, I quoted every single bit of advice that I was given on here, and that I had contacted my MP plus gotten legal advice on this matter, his response was that he was sorry that this had happened to myself and my partner as I had sent off the original means statement and they had no hard copy infront of them which is why they put a warrant out for the fine, and that what he was going to do was put the warrant on hold and email Marston Group that it was on hold for fourteen days pending further investigation, I told him the problems that I had with Marston and contacting their head office and stated that every single time I had called them they asked for payment and when I started to explain the situation they said "are you going to make a payment, because if not then you will need to take it up with the enforcement officer involved" he was not pleased with that, so I am to take both the letter and the photocopy to the court which will then be placed infront of a magistrate to recall the warrant. I asked him what shall I do with the bailiffs if they turn up with a locksmith while I am out and my partner is indoors, he said if I am there, to inform them that the warrant is on hold, IF not, and your partner is unwell which she seems to be judging from what you have told me, then inform her that she is to call the police as it would be considered breaking and entering. I would like to thank Wonkeydonkey for his fantastic letter that I quoted, Hallowitch for her great advice. I would like to confirm several things which are not intended to scare anyone, but several little tips that have been confirmed by several of my solicitor friends who I befriended on yahoo. Any criminal offence A HCEO is able to break into your house while you are not there, lol if anything get a really big dog that would make them think twice or even hook your computer upto the speaker system with a sound recording of a dog barking and growling. lmfao that would make them think twice. just make sure its not too loud. I did this yesterday when there was a knock at the door and I pushed at the door with the sound clip of the dog.. I am not sure who it was, but I think they got the message lmfao. also it gave myself and my partner a giggle. Secondly always make sure that you keep copies of all documents regarding the matter in which the courts are involved and ALWAYS make sure that you send everything recorded delivery. ( I seriously learnt the delivery part the hard way. ) but Make sure that when you photocopy, make sure that its time and date stamped. . I have also informed my mp of the situation as it stands now and I would like to thank him for trying to help out in this current situation, as it stands, the advice given from here has been taken to heart and been a great help. So once again Wonkey and Hallo. Thanks ps I dont think the Enforcement Officer is very happy at losing the commision.
