  1. Thanks for all your replies. I will sit tight for the time being and see what happens:)
  2. Thanks for your reply reallymadwoman. I might try and see if they will take a reduced amount and do it 0%, if they have not got the cca then this would put me in a stronger position. Does anybody know if there is a thread for settling for a reduced amount, there are so many threads and replies sometimes it is like looking for a needle in a haystack?
  3. Good morning, hope someone can help. I am in the process of trying to get a cca from mbna (August 2009) and to date have not received anything. They have rang me this week saying that if I don't pay they will sell the debt to someone else. My questions are:- 1. If they sell the debt, does this company still have to get the cca. 2. I am thinking of talking to mbna and get the debt reduced and pay them something on a monthly basis, has anyone else done this. 3.It seems that even if they don't have the correct terms in the cca, they can still win, is this so. 4.My credit card has been with mbna for 10 years, what is the likely hood they have it and if they don't does this make a differance when going to court, compared to them going to court with a signed one but the terms are wrong.
  4. Captain 2 Thanks for your reply. Is there a template letter that I send out to my credit card companies and if so where are they, also what are the timescales that I give to these companies? Hope to hear from you soon
  5. Hi All I am thinking about starting the process of asking LloydsTSB for my credit card agreement but do not know what to do. I have heard that there are letters and time scales to follow, can anyone point me in the direction of these letters and advise on the timescales. If these timescales are not adhered to is it best that I continue to pay until the timescales have ran out (this is because if I lose then at least I do not have to find a large sum of money to pay after missing a number of payments), does it help their case if I continue to pay or it does not make a difference? How difficult is it to prove that my card may be unenforceable? Finally has anyone had any success? Your help will be very helpful

  7. Thanks maroondevo52 for your quick response, but where have you moved the thread to?
  8. Hello to all. I am new to this forum and I am looking for some advice. I have started to use a company that claims to wipe your debt with MBNA if your credit card agreement is not enforceable in a court of law. I started to use them before I found this forum and once I started to read that it could be done for free. The company have called me saying that MBNA have not replied in the initial timescales laid down, I am in the process in deciding whether or not to use them. Can anybody tell me has anybody else used any of these companies and have you had any success? Does anybody know the tricks that if I do decide to take the matter further what are the consequences for myself. How difficult is it to do yourself, once the company sends you an alledged agreement. Hope to hear from you soon Kind regards.
  9. Thanks for the quick response. The reason why I am asking the questions is because I have stumbled across this forum and read that you could do it yourself and for nothing after I started to use this company. I have read a number of the responses and it seems a little confusing whether or not or could be done and once you got the reply what to do with it. Although I initially used a company I stared to wonder if I was smart enough to do it myself, if not I will continue to use them Which thread do I look at, as I thought this was the thread I should be looking at.
  10. Hi to all. I am just starting off the process to see if my credit card is unenforceable or not. I have two credit cards taken out before 2007, MBNA and CapitalOne, has anybody had any success against these companies and are there any under handed tricks that they employ. I have started to use a company that claim they can get the debts wiped clean, they have contacted myself saying that MBNA have not replied with a CCA, (I am only doing one at a time) I have not committed myself to take it to the next stage. I am just wondering how successful the people on this forum have been and has anybody used any such companies. Regards.
