  1. Ok apologies I haven't been on here, they wanted an extra 2 weeks which I gave them as long as they repaired damage caused to my wheels by towing. They agreed. They have now inspected it and have filed their defence claiming . . yet again . . that there was no oil in the car. Just waiting for my court date now, hope i'm prepared enough

  3. Sorry to double post/change the thread. What also happens if I have ticked the box to say I would like to resolve it without going to court and the defendant has chosen no?

  5. I am going through the small claims and have received my allocation questionnaire which I have filled out and posted back to the court. The defendants solicitor has sent me a copy of their allocation questionnaire and has asked that I send a copy of mine to them, stupidly I did not take a copy before I posted it off. Is it a requirement that I send a copy to them or can I just ignore them? Or shall I email/write to them and let them know I do not have a copy? Thanks
  6. I saw that site before, it just says its up to the judge?? Is it likely . . .i'm now really worried i'll end uplosing then losing even more money I also cant really afford a technician, really think i'm in over my head here. I will let you all know how much extension they would like on the case
  7. OK now they say cos the engineer can't come til a certain date they need longer for their defence, can I say no? This has gone on long enough but will saying no go against me?

Its regarding my other thread: http://www.consumeractiongroup.co.uk/forum/garage-services/213669-2006-vauxhall-astra-issue.html I am taking Vauxhall to small claims, they have arranged for an engineer to come and inspect my car, hopefully this will stop it going all the way to court! As I don't want this really, all I want is what I am entitled to If I do lose, which I doubt I will, will I have to pay for their solicitor?
  9. If I lose a small claims do I have to pay any costs? I've googled this and can't find it anywhere. Also how do i progress if the defendant claims they do not owe the money?

  13. The signal test shows them both at about 80% I do like to try and fix stuf like this myself but think it is beyond my capabilities. Do you think Sky will repair it FOC?
  14. I would expect a severe bollocking, the emails are likely to be stored on a server not your pc so I don't know why they took your pc. I wouldn't worry too much, moral of the story being never write anything down you wouldn't want someone to read. Let us know how you get on
  15. Ok I get a few of those letters through my door offering extended warranties on my sky box. Recently my sky has started playing up, not recording stuttering etc. I have been a Sky member since day dot so even though my box is more than a year old has anyone had Sky repair there box for free? Maybe by stating sale of goods act and stating that you expect a sky box to last longer than a year? Success stories would be great to hear
  16. I moved into my house last year and have my gas and electricity with EON. I have paid £90 a month since I moved in, I do not know how many units I use or whether this is a good price. A few months back EON sent me a letter to let me know I don't use that many units and that my payment can now go down to £80, result. Last month while my wife was in the last month of her maternity leave (timing!) EON sent a letter to let me know that the monthly payment would be £180! I assumed that I had been paying too little, but the debt amassed was apx £700. I asked why my bill had escalated so greatly when they had only just put it down, several phone calls and a couple of visits later it turned out it was a faulty meter and they swiftly replaced it, however they would not decrease the dd and I did not have the money! So my questions are: Can I claim my bank charges back? After all the bounced direct debit resulted from their faulty hardware. Are they allowed to change my direct debit without my permission? I spoke with them several times and let them know I could not afford it, I offered for them to spread the payment but unfortunately "It was already on the system" What can I do about the "debt" on my account, after all they have been using a faulty meter to gauge my usage, how can I prove how much gas and electricity I am using and how much it should cost me? Thanks
  17. Hope I've posted this in the right area? As per my other post I am having major trouble with my car, after reading around the internet I was wondering. Am I covered under section 75 if I have a personal loan? I can't seem to find a definite answer anywhere. Surely I can prove that I got a loan for a set amount and that the same amount was spent in a garage? Input would be appreciated
  18. It's the same engine as the vxr. Kwikfit used fully synth oil, think the grade was 5-40 which is acceptable according to the service manual
  19. Cheers scaniaman, i've filed my small claims this morning, £100! For a new engine that won't be bad though I doubt they'll even want to go to court though?

  21. Yes I took it to Vauxhall as my oil pressure light started to illuminate sporadically during journeys. Even when if I checked the oil the level was fine. I took it to my local dealer who investigated yet simply the jobsheet states: Investigate oil warning light coming on intermitantly - customer has checked oil level and it is ok. Reprogrammed ECU to remove WAR To elaborate I originally took it in as there was an issue with the car holding back when cold. The original issue simply states - unable to faulter WAR
