  1. Thanks Ell-enn. I Sunday i fired off some e-mails to the Government .I have had a reply (Preventing Repossessions Strategy Team - did not there was one !) which contained some usefull information. I am particularly looking into the process of applying to the "Local Authority (ENGLAND) Repossession Emergency Small Interest Free Loans Fund " When i have more information i will post it up . It is a relief ...i am not out of woods yet but will battle on..... Finally the lenders had the last laugh ... when i got home a letter from them stating my mortgages payments havve gone up by £ 23
  2. Hello Everyone - What a day yesterday was !! Before going to file my NT244 i tried again to have a reasonable conversation with lender -all to no avail they said would oppose and oppose !! So went to court and filed and paid (£35 ) -Thinking i would get listed today - Wrong ! At the last hearing (to suspend) in January the order stated "no further applications to suspend without leave of appeal from a circuit judge" - Enforcement section came back out tosee me and siad you have to pay another £40 here is the form and then we can get you before a circuit judge .Bear in mind eviction is Tuesda

  5. Hello Again - The mortgage comapny have the first charge -I have a second charge on as well -Should they be notified of any eviction as a matter of protocol ? Just thinking in technicality terms after all they would lose there charge as there would not be any £ left after sale . Any response (fast)appreciated. Kindest Regards MarkOne2
  6. Hello Everyone - Its tough out there isnt it.As you know i have had for many years battled to hang on to the home where we have lived for 25 years ! Despite paying a lot my situation has dipped again recently and they have got an eviction date for next Tuesday - I am going to try and get it suspended but it may be difficult.At the last hearing it was put in order "no more applications unless approval of circuit judge" - can i still apply in the normal way -NT244 ?   7. Hi - Only one judge took note of the "charges" factor the others did not want to know........... Generally i have had to get some funds / evidence (earnings/case law /mortgage letters/offers etc)together to get a stay of eviction.Also very much depends on what judge you get . Always seem to have been in debt !! Biggest success if you can call it that was many years ago battling with cedar holdings !!!! and managed to get that one suspended six times with arrears of £30k !!! Hello - The process as you may know is when we cannot pay our mortgage the lender applies for a repossesion hearing (think that is your Dec 15th date ) and at that hearing the court can grant possesion back to the lender .You still can live in the property under the order made by the court - Normally maintain normal monthly payments and some towards arrears every month.If this is your hearing try and get the best order you can ! If we fall behind with this order the lender then applies for an eviction order and a date is set - You can then apply again to suspend the eviction - but you need

Sorry - Also forgot to say had a letter from my original (before they packaged it off) mortgage lender (G..C) saying they have been working with the FSA to review charges and said i am entitled to £90 which are d/d charges.Not a lot but that is the full amount from them i had no other charges ! My new lender however has charged me over £4k in charges ( admin fee,solicitors etc) Current arrears of £12k means real figure is £8k !! Hello Everyone - Have not posted for a while .I have been battling the usual eviction warrants .My lender races back into court to get a new eviction date even if i am one day late with payment !! Anyway managed to suspend eviction for the 8th time this week - What stress and what a battle BUT keep fighting on everyone. Whilst in court took the time to check with enforcement office for this years dates and they are 16/12/09 - 04/01/10 - Short relief i know but hopefully usefull information. Hello - i have been through the process a few times and although it can be mentally draining - Take heart. - Prepare thouroughly (some smashing people on here ) with all the correct statements /forms. - Have as much "proof" with you as possible e.g Income/benefit letters etc. - Know the value of your house - what is it ? is it still more than you owe - in which case there asset is still safe.Is there one on internet that sold recently (as proof) - Is there a goodtermleft on the mortgage ? Hello Everyone - Just got back and very pleased to say the that tomorrows eviction order is suspended(MP + £300).It was not an easy ride but Judge P was very fair and supportive - one of the best i have to say.He was not aggressive or dismissive and made me feel at ease ( although i was still nervous) .He said he was aware of C&G Vs Norgan and also allowed me to make the point of charges on the arrears figure. The opposition naturally turned up and were trying to "pump me" for information before we went in (eg Payment date,Term of Mortgage et, why havent you ? Value of house etc.) but e
