  1. I just recieved an exact same letter today from DM ltd. From reading this post it looks like this company does the walk as well as the talk. Im going to send a CCA which i have already done once. Sent recorded delivery - and they state they have not received it. Anyway - so i will try again. But i can see a solicitors letter on the way from them again just like "Staichey". Bit of a concern. I was wondering - whats the latest on this so far Staichey - did u succeed in holding them off ? i was also wondering if - offering them a £1 a month would keep them off my back. I owe £6202 to Cahoot. I have offered them £1 a month - never accept it. this is the 3rd debt collection company to try it, but they seem much more eager .

  4. hello again here is the info as jpg's regarding the Barclay card agreement. as you will see - there is only an historic agreement copied and also - i think this is a cause for issue - there is no Max Credit limit set.   5. Hi guys - all lots said whilst i been away from here few days. PGH7447 - thank you for your honesty - means alot - but also bolsters your your rep. Very similar circumstances to me. If i may - i would like to go off subject of HSBC and refer to my Credit Cards for the moment then. i say this because i think my HSBC Loan is pretty concrete. although i did there is no ppl on this one. i do have ppl on a HSBC loan just prior to that i think - that may be worth returning to subject on later. anyways - my cards 1. Monument ( Barclay card owned i believe ) - £3400 approx - no one contacted me in approx 2 years - so dont bother with this at moment. 2. RBS Card - £2400 - currently agreed to accept £1 a month for the moment. No CCA request sent yet. 3. Barclay card ( originaly Morgan Stanley - then Gold Fish - now Barclay Card ) - offering £1 a month and sending cheque each month whether they like it or not. - Sent CCA request as per section 78 - 1974 credit act . - Returned me a copy of historic agreement - no signature of mine or theirs. and also no credit limit stated. So i think i may have a case for this Barclay card one - but not as per section 78 - i think i have seen something someone has mentioned about 77 and 79 is it ? trouble is - i dont really understand the lawyer written mumbo jumbo. PGH7447 - what would you advise that i send back to counter attack the historic agreement and the fact - no credit limit shown. i have to be honest i strongly suspect that they will not have an original or even a photo copy of my signed agreement. i have seen a guy in here win with the halifax card - but - i think i need to have some pretty clever letter writing which makes me look like i know what im talking about even though i may not to get to that point ? lol ! So what do you think PGH7447 - does it look promising ? kind regards CF
  6. Thanks PGH7447 - thats super advice and friendly understanding too. I think ultimately i have to go bankrupt at some point. i could possibly fight the credit cards and get a few wiped judging by what i have read in here over last few months and info i have gained. However this would still leave me with £19000, which i still cant manage. i think the hsbc one is pretty well sewn up too with regards to the credit agreement paperwork. not as hap hazard as the credit card companies. when u say bad state - was the debt as much as mine - or more - without being specific. have u managed to clear a lot by paying lumps or - got some wiped ? what would i be able to do with the big one ? kind regards CF
  7. thanks for the help Tawnyowl i think i know i got go bankrupt, i just cant afford to pay out to do it myself. we were trying to get savings aside with my wifes wages for christmas, but we just used that to fix the BMW and now the tumble drier - and incedentally the abs fault light came on - the bmw - so thats gonna cost some more !! im at end of my tether. give it few more months then i may do it. what a great holiday im having this week with the kids - NOT ! - terrible weather, and no money ! my parents lent me their camper van to try and give kids some sort of hol locally. - first time try to use it - no cooking gas !! i give up ! well thanks for the advice tawny - it confirms my thoughts . kind regards crazy fella
  8. hi PGH7447 i have gotten close to filling in the forms 3 times over last 2 yrs i think. I worry about them taking the kids stuff. Games consoles, tellys, etc. i think i know its the right and only option left but it does not make the unknown any easier. The bmw is in my name because cheaper to insure for wife to drive so she can go to work rather than insure in her name which is more expensive. i then own a van in my name too which i use to go to work. our working hours differ so we cannot share same car. ok - so - if i stop payment to all - they will go to court. bailiffs will then be sent - they could take - anything ? - settee ? ornament cabinets ? then they will file for my bank ruptcy ? or before ? im dreading this - christmas is on its way - and boys birthday in september. never seems tobe a right time.
  9. Hi PGH7447 it may seem that my posts are a bit abrupt and rude - its not meant that way - i do appologise - im getting edgy by the minute i think. I was thinking of that. but will they go straight to court or will they issue letters for bailiffs then send bailiffs first ? also - does a 1998 bmw 523i with 230,000 miles class as valuable ? tellys ? games consoles of kids ? printer ? stereo ? i could empty the house of such valuables and if they have to take it - take the damn bmw. i cant see another way.
  10. Makes no odds to me whether its £1 or £5 - it keeps them off my back. i know how to keep them away. Im just wondering whether its such a good idea - and whether i should go bankrupt. Only that means i have to fork out another £500 to sort the forms and the process. The CCA will just stall them for a while - they have come up with a historic copy for barclaycard, - but that seems like another can of worms - check ouy my other thread. Crazy fella v Barclay card. It does not seem to be a solution, just slows them down for a bit. I dont have the money to go to court. but points to the direction that threatening court may well - scare them into giving it up as a bad job. dunno. i got no money - so i dont see what they can do really. point is - i dont want to be still in this situation - in 10 years when my kids will be in early 20's and i still got debt problems. I am at that point where i think i have had enough - and would rather then make me bankrupt, but - i dont want to stop payments as - then i think they will send bailiffs after numerous letters telling me this. so then i will have my wife arguing with bailiffs on the door. If i go bankrupt - i could have all this off my back in 6 yrs, and only be paying contributions for next 12 months if im really lucky. So - can someone advise me - whats the worst case scenario with me doing either of these two things : 1. file for bankruptcy myself 2. stop payment to all creditors and debt collectors i look forward to your response. kind regards crazy mad worried stressed fella right now.
  11. Hi PGH7447 Im paying Rockwell. No PPL HSBC took all the interest off - and gave to ROckwell to claw back the £19000, originally it was £25000 or there abouts. the other debts are £6000 - Cahoot Flexi Loan £6200 - Barclays Card £2200 - RBS Card

Hi Tawnyowl. im a mechanic, i earn about £26000 a year, about £1619 a mth after tax and pension paid - i should be well off on that but it dont seem to happening. my rent is £650 a month, electric £60, heating oil, £100 a month because we rent a farm house which runs an oil fired rayburn. they will not fit a boiler - i tried that one. Fuel costs for my car about £20 a month, mobile is £20 a month, car ins £15 mth, hobby - £30, Child support - £230 mth, building contents insurance £7 mth. dentist fee plan £15 mth, Council tax £104 mth, car tax £400 a year for one car, land line £30 mth, internet £16.99 mth. sky tv £18.50. Birthdays, school trips, vet bills, car repairs, appliance repairs, tools for work,christmas all take there toll. i am managing to earn a little extra answering repair questions only which varies from £50 to £150 a mth which i see as paying for the phone, internet & sky. Dont get much work repairing cars privately regular enough. Last month the BMW swallowed £400 for MOT and parts ! i fitted myself obviously. now the tumble drier has just packed in - £30 for parts that i hope will fix it. BMW now wants 2 more tyres. Its done 230,000 miles so its a bit battered and worn out - in case any of you think im running a 2 yr old flashy beemer ! I just seem to be getting costs coming from everywhere, and i cant take my kids no where this summer hols as a result - its bad times. so thats a taster of the problems that are not helping me right now - hence a closer look at my situation. kind regards CF
  13. Hi ICE BLUE not sent CCA to RBS, - for the mo they have accepted the £1 a month. I want to try this out with Barclay Card first - as they are digging there heels in so badly. i feel torn between my morals and just trying to get on in life, as i know i run up the debt, but - i need to look after my family, and my mentality too ! Looks like i will have to argue again for the original agreement . do i still offer a payment ? looks better if it goes to court does nt it ?
  14. Hi to all ! Well - this is one of my debt problems among many. Ok suffering debt problems i have been using my credit card to bail me out as i go along. My income should cover my expenditure. however as i am only human - in some instances debt i my own fault, other instances - the car breaks down, the tumble drier, the fridge, a wedding to go to, birthdays, christmas, vet bills - they all do there bit to push tip me the balance over each month and soon mount up over the year. ok here we go - i owe HSBC £19000 for a loan i just cant afford pay full stop. i have for the last 2 to 3 yrs held them off through Rockwell by paying £1 a month - although i have increased to £5 now just to get them off myback ringing all the time. i have other cards which top the whole debt to just over the £35000 mark. I tried IVA originally - and because HSBC owned the greater debt percentage they controlled final decision and said NO ! So hence i pay the £5 a month. I can carry on like this forever, but is there another way out other than bankruptcy ? i have a copy of the CCA in my filing cabinet - the second copy that you get to keep when u fill in all the forms in the beginning. it states interest rate, and amount borrowed and amount payable back. So that looks ok - although i have not checked to see if they can supply me with their own copy. I have been given the impression by people around me - that suggest - if i carry on with my £5 a month that HSBC will eventually give up after 6 yrs. I have strong doubts on this. I think that only applies when u fail to pay for 6 yrs and they cannot locate you to get a response or send bailiffs out. Please could you clarify this for me. I have also been advise on one hand to go banktrupt because i dont have any assets, no savings. i rent my house privately, my car is worth about £1000 - Bmw 523i 1998, with 230,000 miles on it - which the wife drives, and i have a Corsa Combo van worth £300 i reckon. At the same time - i have been advised not to go bankrupt because they will still send in bailiffs to get the tellys, the kids ,play consoles, stereos, the bmw - anything. this advice from an account who has been present on the day of such an ordeal. Can anyone think of a direction i should go ? i dont really want this round my neck in another 10yrs time if possible. kind regards CF

So down to nitty gritty. I have a barclay card debt of just over £6200. The card was originally Morgan Stanley, then Gold Fish, and now Barclay card. I have over the last 3 or 4 months held them off - offering a £1 a month. they continue to do the usual decline and wack the interest on etc. they cash the cheque as is the normal. I know that i can continue to hold them off as long as i offer a payment as such. I cannot afford to pay any more than the £1 - i should but - its just amazing what expenses pop up day to day ! Now - as i state - i could carry on like this - hoping one day they will give up on me. - However - i fear that they will still be after me in 10 years, 20 years or 30 years. So i have been reading threads in here. I see that some have found a loop hole regarding the CCA. I have requested a CCA as per S78 regarding Credit act 1974. They have provided me with a historic copy with no signature. This according to info i have read in here is acceptable. So it appears i am on stop again for the mo other than carry on with my offer of £1 a month. I dont want to push to court to get the actual agreement in case they call my bluff - as i dont have the money to take them to court or to defend myself against them. A little more info may help your advice too - i owe £19000 to HSBC via Rockwell, £6200 to Barclay card as above, £6000 to Cahoot Flexi loan, £3450 to Monument ( barclay card owned - but they have not asked me for this and i am not making any payment on this either ), £2200 to RBS Card. Have to kids i pay CSA for and a step son, so i have dependents which i am worried could be persued for my debt if or when i die with debts outsanding. i dont have any assets, my car is only worth a £1000, i rent my house private. What is my best route ? Continue to take on all my credit cards first ? Carry on paying £1 a month or go for bankrupt ? Bank rupt i have been advise that even tho the law should be on my side - it means nothing on the day when bailiffs come in take what they want and the police man tells you not to interfere with the law as they remove all your kids ps2, telly, your car etc etc. Any advice will be gratefully recieved thanks. kind regards CF

Hi KATE DOG, Thank you for your reply - i am very grateful - but - Your post does not really add anything to my query. i have already submitted a CCA request and got copy of terms and conditions - but no signed agreement. now if you go back to the beginning of this specific original thread - it says that by law the CCA request means nothing - so they can carry on sending me unsigned agreements. only way according to this thread is - take them on in the court. this is what i want to clarify. if i need to go to court - then i have lost full stop - as i cant afford such expenses - thats why im in debt lol ! The law is on their side with regards to the CCA request - they dont have to supply you with the original signed copy or even a copy of that original for that matter. So what the hell do i do ? bit of a sticky one it seems. Kind regards CF
  18. hello - there im a newly registered user, however i have been reading these forums for advice for many months now. Im hoping you can offer me further advice. I owe numerous debts to credit card companies. £19,000 loan to HSBC - i have sorted a £5 a mth agreement with collection agency Rockwell. £5000 flexi-loan to Cahoot, - on going payment gesture of £1.61 a mth, RBS Card - just accepted £1 a month direct, Barclays - offering £1 a mth. So i am managing to hold them off. I have done so for the last 3 yrs. However - my query is - Barlcay card threw Mercers Debt collection agency at me - so i threw a letter back to Mercers - asking for proof of entitlement to collect the debt & a copy of the credit agreement as per credit act 1974 etc. Suddenly they cease to bother me as i now know they are part of Barclays. But strangely a i recieved a letter from barclays - saying " they are dealing with my complaint " . Later i recieved a further letter containing brief documents of their terms and conditions, and a copy of a black application form. So - after reading this thread i understand why i have no copy of a signed agreement from them. Now - this card was originally a Morgan Stanley Card which went to Goldfish, which then was took over by Barclay Card. i am thinking that it may be difficult for them to actually obtain the original documentation of the original signed agreement. Do u think i have a lucky chance or am i clutching at straws ? I understand i may have a fighting chance of clearing this debt if they cannot find the original signed agreement, but after reading this thread - it appears i may need to go to college/ university to get a Law Degree. i am a full time Motor Mechanic - reasonably educated - Master Technician on Jaguar & Land Rovers. But im not sure if i would just get tripped up by their jargon if i tried to take them on myself. i dont know whether i should persue all my credit card companies for original agreements in a bid to try and catch them out and wipe my debts or just leave my present course which is pay what i can which is - £1 a month in general to each one, until hopefully they will give up after 6 yrs of persuing the debt. im 3 yrs in with HSBC but only 6 mths in with the rest.
