  2. Thanks for that, you are completely correct, she had put my application forward incorrectly. They are now processing this again for me. I will have a bank account as soon as they get my proof of ID.
  3. When I applied the woman on the phone said that there was a credit check and that my score was not good so she had to refer it to the underwriters.

  5. As far as I am aware the only thing they need to verify is your identity. I had a problem because I was homeless having had my house repossessed, but then I found somewhere to live I had to take proof to the bank to get them to accept my identity. I am expecting to get a basic Nationwide Cashcard account, which is not good enough for my needs but will get me something. I am thinking to set up a limited company and get a bank account that way.
  6. HSBC credit score their accounts, so I told them not to bother. Apparently Sainsbury's bank have a savings account that has online banking, you can send and receive money online, and you get a cash card with it. This may be ok for me, so I am looking into that as well.
  7. Thanks for the advice. I am waiting to hear back from Co-op N&P will call me back tomorrow CardOneBanking say yes, but not DD facility and it is expensive, £30 to open the account and £12.50 per month. But no credit checks at all. I will keep searching
  8. Since A&L closed my bank account a few months ago I have not had an account at all. However, I now need a bank account that will allow me online banking. Unfortunately my credit rating is very bad and the first one I tried closed the account right after they opened it. I am stuck, does anyone know which bank I should try? I can't use Lloyds or NatWest or Abbey or Alliance and Leicester or RBS as they all want my blood at the moment. Does that leave anyone else? Any ideas are most welcome.
  9. Often the no win no fee means that you still have to pay the costs of the winning side if you loose. It all depends on the insurance that your solicitors take out. They will insure their costs, i.e. no fee from them if you loose, but usually the cost of insuring both their fees and the other sides is not something they want to cover. It is only in cases where the likely costs could be high and the opposing side demand to see evidence that you can cover the costs if you loose. In these situation the solicitor will insure both sides to allow the case to proceed.

  11. It is highly likely that FC will go for a charging order on their house and then seek a forced sale. Really they must get proper legal advice. You should post this thread again in the legal advice section I think there may be more help there. Sorry I can't be of more help but I have not come across this situation before whereby you have a Bill of Sale when you thought you had a loan. It sounds like a nice loophole for the lender. Please pass on any information you get from anywhere else. Also if you don't find the answers here, check out the CCCS (Consumer Credit Counselling Service) cccs.co.uk and look at the monaysavingexpert.co.uk site, maybe there are some resources there.
  12. Anyone know whether there is a route for this complaint to be taken further? IMHO banks only ever change if customers or the authorities force them to. If they can simpy continue ot write apology letter and leave it at that they will.
  13. You are so right about the priorities of our life. It is so easy to let money cloud our vision of what is really important. I know that my kids are more important to me than the problems debt creates. In the times when I felt so depressed that I felt I could not go on, I simply put a picture in my head of the affect loosing me would have on them and I knew I could never do that to them. Now I have passed the worst and though I am homeless and my kids now live with my ex-wife, I am making progress in the right direction.

I ran my own business for 21 years, but for the last 5 years it was struggling and I ended up unable to take a salary and borrowed money to fund both my life and the business to try and turn it around. It just about turned around and went cash flow positive February 2008 and we celebrated because that meant within 2 months I could start taking a salary and the business would be able to start repaying the loans I had made to it. Unfortunately the credit crunch happened, the bank cancelled our factoring and our customers (in the building trade) delayed a load of projects we were working on, all in March 08. The result was that the business went under in July 08. This left me with over £524,000 of debts and loan guarantees to cover. I had no way of sorting this out and no income. I could not pay anything and did not find this site until a month ago. My house was repossessed, my kids and dog had to go and live with my ex-wife, my girlfriend's mother got sick so she returned to Turkey to look after her and couldn't then get a visa to return to England and I am now homeless moving around from place to place staying with friends, sleeping in people's spare rooms and on sofa's and so on. I now know that if I had found this site and the information I have learned from hear and other resources on the internet I would not only have been able to keep my home but also would have been able to clear most of my unsecured debts and been able to significantly reduce my payments of the secured debts. I would not be homeless and would still have my family life. The resources to help you are here and you should also check out the CCCS. I have learned so much in the last 6 months and really feel sad that I did not learn these lessons sooner, but glad that the resources are now available to other people that they can get the help they need. I am just in the process of getting a basic cash card bank account as A&L closed my account when I asked for the £2000 of bank charges back. Once that is completed in a few days I will then file for bankruptcy. Will have to seek out for advice on that when the time comes. I have been through a lot of depression during the last 18 months and have resisted going to the doctors as I do not want to be on drugs. The depression at times has been unbearable but I know I cannot go any lower, so the only way is up. There is nothing more they can do to me. When I lost my house I got all my mail redirected to my brother's house and have not looked at it for the last 6 months. (My brother is getting a bit depressed reading the though:D). Since this has all happened I have been able to help a lot of other people I meet with advice, letters they can send, resources they can access and have built up a lot of knowledge. It is really good to be able to now give that help to others and have them write to me and thank me. It would have been nice to hae known this stuff last year, but at least I can help others.
  15. First I would make a CCA request for an agreement and state clearly in the letter that you have no record of ever having have a loan with them. Find out if they have an agreement and whose name/signature is on it. Either they will have no record of the agreement or it will have someone else's signature on it. Then you can threaten to sue them if they do not immediately remove the negative record.

  17. Just write to Moorcroft asking for a sign contract or proof of debt and make it clear to them that they should only be chasing debts that actually exist. State that you do not own BT any money as the service was never requested, and I have had confirmation from them that they have no record of a verbal agreemet with me. Also demand that they cease any further communication until such time as they can substantiate their claim against you. or you could simply write something like this: In response to your letter dated (date of their letter), I am sorry, but I have been advised that as third parties have no legal standing in this matter, I must therefore decline any further communication as I am dealing with BT directly and am awaiting a response from them at this time. I do not own BT any money as the service was never requested, and I have had confirmation from them that they have no record of a verbal agreemet with me.
  18. You can write them a letter - politely - requesting that they delete that number from their record. If they fail to comply then you can report them to the OFT, Info Commissioner

Key points to qualify: Debt Relief Orders are intended to provide debt relief for people in England and Wales if: The debtor is unable to pay his/her debts; The debtor’s total unsecured liabilities must not exceed £15,000; The debtor’s total gross assets must not exceed £300 (this includes houses so homeowners will not be eligible); The debtor will usually be allowed to keep a car if it is worth less than £1000 or it has been adapted for them because they have a physical impairment that has a substantial and long-term adverse effect on their ability to carry out normal day-to-day activities. The debtor’s disposable income, following deduction of normal household expenses, must not exceed £50 per month. The debtor must be domiciled in England or Wales, or in the last 3 years have been resident or carrying on business in England or Wales. The debtor must not have previously been subject to a DRO within the last 6 years. The debtor must not be involved in another formal insolvency procedure at the time of application for a DRO, such as: An undischarged bankrupt; A current Individual Voluntary Arrangement; A current Bankruptcy Restrictions Order or Undertaking; A current Debt Relief Restrictions Order or Undertaking; An interim order A current pending debtor’s bankruptcy petition in relation to the debtor but the debtor has not been referred to the DRO procedure by the court as a more suitable method of debt relief; A current pending creditor’s bankruptcy petition against the debtor but the debtor has not obtained the creditor’s permission for entry into the DRO process.
  20. It never hurts to apply for more time and would give you time to sort this out. Check out the PPI reclaim stuff and begin that process regardless. You don't say what the situation is with the loan. I am guessing that your partner is in arrears.
  21. In addition you can try the CCCS as they have successfully helped a lot of people to get the interest frozen and repayments reduced.
  22. Good question, as far as I am aware it is automatically lifted, but I have never asked that question myself so I can't be completely sure.
  23. You are entitled to withhold payments if that default on providing the executed agreement, but they will register a default on your credit record even though they should not. Also provided you are meeting payments as negotiated with the lender (even if they are not in line with the original agreement) they are again breaking the rules if they file a default with the credit reference agencies, however, banks rarely follow the rules.
