My husband has been making payments on this account since him and his wife split up, although he is not paying the full amount as he is unable too. I understand that He is liable as he has signed the agreement but I wanted to know if the agreement is enforcable. The balance is now apporx £2k more than the original loan which was supposed to be over 5 years and was paid fully (we believe) for at least the first 1 maybe 2. I have asked for a full statement of account which has been ignored so a further request has been made.

Can anyone see if there is any reason why this agreement is no longer enforcable. It is my husband and his ex wife who has since declared herself bankrupt and therfore leaving the debt to my husband. It has been passed from debt recovery agency to debt recovery agency and I have asked for a copy of the statement of payments but it doesn't seem to be forthcoming.
