  1. Hi, Do you happen to know whether a claimant would have to provide a copy of their 2nd charge either with their claim or at the hearing? If they don't could the judge dismiss the case?
  2. I hope all those greedy banks get shafted big time, question is when will they pay out and will there be some sort of sealing limit on payouts? Hope not
  3. Can you still send a CCA's off to credit card Companies (all cards taken out between 1990-2000 ) if you have been under a Debt Management Programme for about 6 months?
  4. PN Sorry its a bit late but only just read the thread...very well done !! By the way does the Amex entry on your credit file still exist or did they remove it? Assuming the entry still exists, apart from the removal of the default did they also reset the late payment history to 00000's Just interested to know?

I am disputing a default on my credit file which I partially settled with a DCA last year, I asked Equifax to contact them as I disputed the default as I don't remember ever receiving it and also I asked them to confirm the DCA actually have a deed of assignment from the original lender, its an old goldfish card which has since been taken over by Barclays but I'm sure it was taken over by the DCA before that take over took place. Appreciate any comments/guidance as to how I should reply, do I have a case to get this default removed? Response (Administrator)14/10/2009 04.21 PM This debt has been admitted via settlement being paid on 4 November 2008. As the debt is admitted it must remain recorded as a satisfied defaulted account with a balance of £2,245.56 which has not been paid. This reflects an accurate history of the financial behaviour of the account holder and we are obliged to record factual data in this way as it has occurred. As such we are unable to amend our entry accordingly.

  10. Question please for the experts on here? Can you CCA a credit company where the person is living in the EU and the statements have that address on them and that is the address the statements are sent to by MBNA etc The accounts are old going back into the 1980's/early 1990's and opened whilst living in the UK then, so I guess its highly unlikely they would have the original agreements, therefore likely to be unenforceable? but how would one start the process off? Appreciate any info/guidance on this senario?

Yes also can a status payment history be changed at Swift, I have a few late payments still showing on a closed account from a year ago and I want them changed to show 0000's as I wasn't late with any payments but only recently noticed it on my file. I undestand they could always get out of it by saying they have to keep and record accurate data to the CFA's and in their view the data is accurate. So any ex emplyess know if its possible for Swift to reset this data on my file? Who is the Data controller and have they done this before, they are the legal owners of the data so they can change it if they want. Maybe an offer of an "admin fee" might make a difference?

Thanks, that sound good because Barclays have taken over a big pile of brown stuff from Goldfish and its quite likely that Barclays won't be able to reply with any data or original CCA/ deed of assignments etc. It sounds like Barclays are in a right mess over old goldfish stuff hint hint;) I say that as I recently had success having one old goldfish credit card data removed from my credit file and this was done by asking Equifax to invistigate and they contacted Barclays who later confirmed that the data would be removed from my file as they couldn't provide any evidence to Equifax! So its possible the same thing could happen but would Barclays be able to remove the 1st Crud entry & default or only 1st Crud? Surely if Barclays do not provide any evidence to Equifax etc than there couldn't have been a original agreement to assign to 1st Crud and therefore 1st Crud must remove the unlawful data? Any further guidance would be appreciated.

Status payment history recorded on your credit files, can you challenge a creditor to change late payment history to be reset to "0" s particularly if you are looking to make a full&final settlement offer. I understand the legal owners of this data is the creditor recording the data, therefore I assume they can do as they so wish with the data? Also I settled an old mortgage account some years ago and I want to have some late payment status history reset to "0" 's Can I demand they prove I was late with those payments during the last 4 months of the mortgage? I don't recall being late ever and only recently noticed them still on my credit file. Assuming the 6 year rule this means they won't drop off for another 3yrs or so! Can the mortgage company say that they can't remove them or alter them as they reflect the true situation at the time and they must be seen to report in responsible and accurate manner? What are my options here, can I CCA them or SAR them to find out if they have proof of any late payment during that time? Appreciate any imput/advice
