Does anybody know about letters of Novation? I believe this is where a new agreement is substituted for a previous one. Sometimes it transfers the obligation to a third party, sometimes it offers a lower full and final settlement on the basis that the debtor has no realistic prospect of ever repaying the entire debt in a reasonable timeframe. I heard that one sends them the letter and a payment in F & F settlement and by accepting the payment they also accept the 'new' contract and have to put on the record that the account is settled.

I have had defaults registered when accounts were in dispute under CCA - with requests for data outstanding. I challenged this with Experian Credit Expert (am a member) - they said they would enter a notice of dispute but nothing seems to have appeared on my file - just lots of missed payments (which are screwing up my credit score) - if the credit card companies don't have the right to register this whilst the debt is disputed, what can I do to remove the information from file?
