  2. It was originally for £90k. I got some money for selling & that went to them direct. the £40 is what was not covered from the proceeds of the sale. The business was not put into liquidation as there weren't enough funds - it has since been dissolved though
  3. i've just got out my loan agreement. The security schedule states security: debenture property/assets: fixed equitable charge over property; fixed charge over all book and other debts, goodwill and uncalled capital; floating charge over all other assets. ???????

Thanks, so the debenture then would have been secured against the company's property (which there isn't - only our residential mortgage) It's my understanding that there are no charges on land registry details apart from the Welcome loan & obviously residential mortgage. The debenture was secured against the companies debts but there was not enough money to repay the full amount. So I take it that there is not a charge. How does this change things?

  8. I've posted on another forum, but was hoping for some advice from here. I have a business loan with HSBC (£40k) my mortgage iswith HSBC. The business no longer is running - the HSBC want their £40k back(NOW) and as I have debenture - they will start repo proceedings if I don't. I can't remortgage as my credit file is showing late payments on mortgage. Any advice on how I can approach the HSBC? (Pedross suggested I should ask for the amount to be added to mortgage as a further advance????)
  9. Thanks Pedross. When you say to ask them to add the amount as a further advance - does this mean the business loan & would this mean that I wouldn't need to search for a mortgage? Would they agree to that? Is it heard of? That's what I wanted them to do anyway - as it is they have 1st and 2nd charge over the properyt with the 2 separate loans - so what's the difference to put it ino 1?   10. Hi. I need some advice. I have a business loan (has 2nd charge on my property) As the business is no longer running, they are recalling the debt - to be paid in full by month end. My mortgageis with them & I have equity in the house. I've tried to remortgage with the, but due to my credit file showing 6 months missed payments (which isn't true - jst the date was never changed & so i was paying mortgage on 5th whenit was due on 1st) I've had a financial advisor look at all possibilities, but I've no way of sorting cash. HSBC will be calling in the debt at end of month.

  12. thanks Pete. The bailiffs were linked to the business which has now gone, so I hav verified with my credit report that there is no CCJ. The account manager was an employee of HSBC - we were remier account holders! What's the difference between repo & a charging order? I spoke to the national debt line, & they didn't appear to think I had any issues as I have the equity in the house that would cover the debt. The thing is, it's ourfamily home & I don't wan to sell it.
  13. hi, thanks 4 th eresponse HSBC business loan 41k welcome 15k. I haven't any other HSBC products - no PPI. I claimed the bank charges back that were owed & got them eventually. The acount manager was one who looked after personal accounts at HSBC. The bailiffs were due to lease compications - i had had notice prior. Doesn't sound too great does it?
  14. Hi - 4 years ago I started a business & HSBC willingly threw money to finance it. I also took out bank accounts, life insurance and a massive mortgage with them. Unfortunately, last year the business was performing badly, but I managed to achieve a sale. This was in the process of going through when I got a visit by the baliffs; I asked HSBC to lend me more as I did't want to lose my sale; they said no & told me to get it from where evr I could.
