  1. hmmm... yes it is excessive in my opinion, but sadly I'm not a district judge!! What were the signs like in the area... were they clear and did they state these charges. Do they clearly state the area they apply to. If you want to take it to court then your best bet is to have more than one ground to fight on.

  9. Sadly I think more PPCs will clamp now because victims are realising the tickets are worthless. First thing you should do is go back to the site and take lots of photos of the signs and the area itself. Your friend will need to prove that they are not obvious and therefore they never entered into a contract. Look at the sticky posts on here, they will be able to tell you all the info about the procedure... it will most likely involve the small claims court
  10. I read your post with interest because at the advice of my CC I'm sueing the clampers and will be expecting a chargeback when I've (hopefully!) got my CCJ. You may find the following interesting, particularly about the fact the ombudsman even compensated the customer £250!! credit cards - issue 31 During my research I think I may have seen somewhere that you must notify the CC within 6 months of a problem. This should be irrelevant for you because you called up near enough the time and they should have marked the transaction as disputed.

  12. Well... as you'll read from the posts on here, debt collectors never come to your door so its all talk. The only person who can come knocking is the bailiff to enforce a CCJ. If you just want to stop it, wait for the next letter and send it back to them as not known at this address..

  14. Well .. if the baliff turns up again you need to prove that there are the two same named people at the same address and that your husband is not the guilty party. Try and call the baliff to discuss, rather than wait for them to come again, or ring the court and speak to the enforcements department. I can understand you might not want to turn your son in, but the CCJ wont go away so ignoring it isn't really an option.
  15. So what if they send a summons .. a) they don't know your name so are they going to sue the company purely because of the logo on the side. b) they know your name, no one in your company should be opening your post?!
  16. From what I've seen from this forum this is usually the last one you'll get. As already stated here, a "debt collector" has absolutely no legal power to little more than walk up to your door and ring your doorbell. Just as you would with a door to door salesman, you don't have to answer any questions and you can ask them to get off yer land or you'll call the police.

  19. Hi, I'm about to start my claim against the landowners and the clampers for recently towing my car. As per the advice on here, the first defendant is the land owners and the second is the clampers. I suspect the land owner will respond and indicate they wish to defend, but know its unlikely the clampers will bother. If this is the case, can I still get a default judgement against the clampers without having to bother the land owner. The reason for this is I paid by credit card so will be able to get them to pay if I get a judgement!
  20. Not sure about that... its a legal requirement for any car on the road to have an insurance policy. For example, if it was parked in a public place and it blew up, it would need 3rd party liability cover!!
  21. In normal situations there will be a limited company who effectively owns the buildings and pays the bills. Your maintenance charge is paid to this company. The directors are usually unpaid people who live in your block of flats and have volunteered themselves for the job. It is them you want to write to. They instruct the management company who to employ and who not to employ.
  22. good work ... once you've moved they wont bother trying to find you. Doubt the DVLA let them apply for the same car more than once and doubt they would wanna risk paying any more DVLA costs
