  1. this has been discussed before... An untaxed vehicle is technically uninsured, therefore as it's in a public place (including privately owned publically accessible car parks) it is therefore a dodgy one. This is where the cash cow comes in, because you are insured as you did have tax, but to make the job easier it is required to display the tax too!
  2. in your case, the difference between the keeper and owner is irrelivant. They have got your Dads details from the DVLA and are writing to him hoping he'll just believe the rubbish and think that he is responsible for all the drivers (like the police/council tickets) and pay up. It will never get to court... but if it did, you can tell the courts that your father is unable to attend due to his disability... the judge would probably throw it out before it even got to that stage!!!
  3. I said that! Though if it went to court you would have to reply to the defence stating why it was incorrect and then show evidence to prove why they were not the driver...
  4. So they are charging you £130 per day for hire of a clamp or storage costs???!! A little unfair terms of contract springs to mind!!!

I can post you a draft claim form for the Trumpton County Court for £1000 for parking too if you like.... until they part with even more cash and you receive the court summons DIRECTLY from the court, with a pretty stamp of a crown and a legitimate case reference number then you can continue to ignore! If you do receive papers that you think are genuine, ring the court and ask them, they'll ask you for the case reference number and will soon tell you!
  6. argue what? You are not in anyway legally obliged to tell me or any other random 3rd party (including Excel) who is driving. IT is their responsibility to prove who is driving ... and they have no legal powers to carry out investigations or force people to tell them under oath!!!! Let them chase your father all the way. If they take it to court (which they wont) the case would be dismissed as soon as you can prove your Dad was not the driver. Remember, debt collectors have absolutely no powers. They are just agressive individuals who are paid comission and so bend the truth to make you think you must pay!!!!

  10. All clampers charge a clamp and tow fee.... what law says they can't. A clamp is the quick fix and then gives them the chance to get the truck out asap!
  11. Just read it .. fines, penalties galore!! The new law should be the same as scotland, not letting it carry on! So when the changes are announced later this year (as per the consultation) are the Daily Mail going to take credit for it... I think so!!

  13. they seem to patrol a lot during the night... Have they acknowledged your claim? Are they defending it? Has it been transferred to a local court? If so you could ring them up and ask them how to go about adding a second defendant. Where abouts were you done? PM me if you prefer..
  14. They're probably shocked someone bothered to write to them these days! If you call then that is enough! Now just ignore it.. they will "refer" it back to their client anyway and the PPC will put it in the bin like you should have done in the first place!

  16. What crem is saying that this is a civil matter. This means that you can not be taken to court and made to pay a fine or a penalty, as that would be a punishment and no joe blogs can impose a penalty on another. If the car park charged £1 per hour, and you paid £1, but stayed for two, then the landowner could take you to court for breach of contract, and only sue you for its loss because of it... which would be £1 (for the second hour). He could not charge you £70 for a PCN etc. because the only loss incurred would be the £1 if someone else had actually used the space and paid! If it's a free car park, then they lost £0 by you overstaying because if someone else had come along, they would have been doing it for free too!!!
  17. Or you could disclose who you think the driver was? Are you sure you didn't lend your car to Alan Johnson c/o 10 Downing Street ? Perhaps if the home secretary started to see the tat that comes from this unregulated circus then he might actually get on with it!!!
  18. does it say WILL or does it say MAY ?!! Can't see how they WILL when you didn't break any contract with them! One day this will all be illegal and we'll just laugh about it!
  19. Well ... I'm not saying UKPC will, but a case was taken to court in the past and the PPC won because the defendant admitted to being the driver on a forum! It is the driver who breached the contract, so therefore by saying YES I'M THE DRIVER it is helping the PPC!!

If you admit you are the driver, then you are admitting that you breached the terms of the supposed contract... this is usually a flaw in the whole [problem] because they send the ticket to the registered keeper who is not necessarly the driver! By admitting in a letter you are the driver it seems to give the PPCs a bit of encouragement to take things further!
  21. yeah you can ignore it... as said here you're going to get all sorts of letters.. Its not a debt so they can't do anything to your credit file or give you a CCJ as it has to go to court first. They are well aware that you may not be the driver so they are just trying it on. It is the first thing a court would ask and it would be thrown out on those grounds!
  22. You have no legal requirement to tell them who was driving, just like you have no legal requirement to tell me your favourite colour!
  23. Firstly, if one was to pay for the "contravention" it would be lining the pockets of a 3rd party and not the landowner itself. Secondly Mr PPC. these people do support those who are taken to court Thirdly, your final word, most forum users do park between the white lines, its just some PPCs decide that the bay was actually not for parking in. If perhaps there was an appeals system which was independant and actaully worked then I'm sure people on here wouldn't tell innocent drivers to simply ignore you!!!
