  2. Shrewsbury County Court informed me yesterday that all claims are being stayed pending the OFT test case.
  3. I'd give the court another ring to see if your hearing tomorrow has been cancelled as this happened to me and the court didn't inform me. My preliminary hearing was schedulled for today at 10:30am at Shrewsbury County Court and after a letter from Barclays like yourselves I contacted the court yesterday only to be told the hearing was now cancelled and my case stayed.
  4. Phoned the court yesterday afternoon and they informed me that my case has been stayed. I asked if it was possible to lodge an objection but the lady I spoke to wasn't that helpful and just said that all bank charge cases were being stayed pending the OFT test case. It would've been nice of the court to let me know this as I've had nothing from them, just a letter from Tom Hickey at BLT saying they were going to apply for a stay. I have drafted a letter to the court attaching the Application for removal of a stay document requesting that the Judge consider this and if the stay is to be upheld then could s/he consider the injunctions against the bank mentioned in it until my case is resolved. I am also going to attach my Allocation Hearing Witness Statement and Draft order of Directions in case by any miracle the Judge decides to overturn the order of a stay. All very frustrating
  5. Thanks for that Saintly. I needed a bit of a chuckle. I've got so many things like Witness Statements and Draft Orders going round so fast in my brain that I'm getting dizzy.
  6. My Case Management Conference is taking place on Thursday morning at Shrewsbury County Court. I had a letter from Barclays saying that they are applying for stays and that it is highly likely that this will be granted. Does the bank have to attend to request a stay? I've seen a thread elsewhere listing the courts that are automatically granting stays but Shrewsbury appears to be undecided so far. I will give the court a ring tomorrow to enquire but so far am still planning to attend. Here's what I'm going to take with me:- Allocation Hearing Witness Statement Draft order of Directions Reason's why they should be ordered Statement of evidence Application for removal of a stay - UPDATED TO ACCOUNT FOR OFT TEST CASE Should I take all of this in triplicate, ie. one for me, one for the Judge and one for Barclays? Has anyone successfully resisted the ordering of a stay yet? I'm unsure how the hearing will be run. Will I be expected to read out all of the above statements to the court or will the judge just look through it and ask questions? How do I address the Judge? Is it Your Honour?? Any help would be most gratefully received.
  7. Thanks Saintly. I've had a look at that thread. It doesn't mention a Case Management Conference. Do you think it's the same as a preliminary hearing? What do you think I need to take with me?
  8. OK. I emailed the litigation team on the 24th June and had a reply back from Kate Ashton on the 2nd July stating that she was handling my claim and that she would be sending a letter by the end of the month to settle my claim. All well and good I thought. At the end of July I sent an email back to Kate as I had heard nothing more from her. I received a reply stating that she would no longer be able to make an offer of settlement for my claim due to the emergence of the test case in the high court. She went on to say that Barclays would be requesting a stay so that they can await the outcome of the test case. Where does this leave me now? I havn't submitted a court bundle to the court as my hearing on the 16th August at Shrewsbury Court is a Case Management Conference and there were no directions that I had to adhere to (i.e. submit any evidence). Should I have submitted my court bundle by now or not? I was under the impression that this was a preliminary hearing only. What should I take with me to court? Needless to say I am getting a bit jittery now as it looks like I will be required to attend this hearing. I'm worried I may have screwed things up by not submitting anything to the court before now. On other threads people have had specific directions stating that there bundles should be submitted at least 2 weeks prior to their hearings but I have had nothing like this at all. Sorry for rambling on a bit but I'm just a bit anxious to say the least. Any suggestions anyone.
  9. Thanks Dar£n. You got in there just before me . I actually tried to phone Krysta before the weekend, but got her voicemail. I think I'll try dropping Dino an email as he seems to be pretty quick in responding, judging from others experience.
  10. Thanks Saintly. I was thinking of contacting the Barclays litigation team as per Dar£n's thread. If this is only a directions hearing and not the full monty, will this make any difference in them agreeing to settle do you think?
  11. I have received a letter of notice that my claim is being transferred to my local court. The notice reads as follows: TAKE NOTICE that the Case Management Conference will take place on 16 August 2007 at 10:30 AM at Shrewsbury County Court When you should attend. Is this an actual court date where my case will be decided or just a preliminary hearing? There is no mention of when documentation needs to be submitted. Any ideas anyone?
  12. OK, as predicted, Barclays have ackowledged the claim yesterday at the last minute. Time to send them a copy of the schedule of charges including the 8% interest. I wonder if its worth giving them a call to see if they will settle as others have had some success this way. Save the hassle of preparing a court bundle etc. Does anyone know who I should try to contact? Cheers Belly

  14. Just checked on MCOL and my claim is still listed as issued. It was issued on 12th April so over 14 days ago. Nothing further from Barclays. What's the next step? I havn't sent Barclays another schedule with the interest yet as they havn't acknowledged the claim. Should I sit tight a while longer or should I start the judgement process. Any advise appreciated.   16. I have just received the standard offer of approximately 3/4 of the sum being claimed, namely £695 of the £925 I want back. I didn't think they were going to bother with this step in my case as I thought it usually came before now, but I guess they are a bit swamped with claims at the moment. Do I still reply to this letter saying that I accept it as a partial settlement, but will be continuing to claim the remainder, or should I ignore it as I have already filed a claim with the County Court. I suspect I'll do the former as it might not look good should it come to court if I have ignore them, but advise appreciated. Belly
  17. Great. Will get the initial 2 copies sent off to the court. How long does it normally take for the Banks to acknowledge the claim? I think I've read that it is 4 days until the claim should be deemed served and then they have 14 days to acknowledge. Is this correct? Belly
  18. Of course I meant Northamptom - slip of the finger The schedule of charges that I send to the court now, and later to Barclays when they acknowledge the claim, should include the S.69 8% interest, right?? Thanks for your help. Belly
  19. Hi everyone, I started the whole process a couple of months ago sending my SAR on 9th February. Things have gone very much true to form and I am now at the stage of applying with MCOL to claim the £925 of charges from Barclays. Have just paid my £120 and filed the claim. Should I now send off the 2 copies of my schedule of charges to Nottingham or should I wait for the claim to be acknowledged? Also, when do I send another copy of the schedule to Barclays. Do I wait until they have acknowledged the claim? I know that I still have quite a way to go before they pay up but I'm started to get excited now. Belly
