  1. Hello I wonder if someone can give me advice please on how to proceed, I have likely done the wrong thing already. My bank of Scotland credit card was sold on to Cabot who I was paying £5 a month to (all I can afford) I stopped paying a while ago when even that payment got to much due to post op recovery and sick pay. Now it has been passed to nolans law and they are threatening court action. I have emailed them to offer the original agreement of £5 just to get them off my back as I'm scared about a ccj but I'm worried they will decline this offer and take me to court. I know the debt is valid. I know it was sold on and it is on my credit file as satisfied. I am not sure of the best course of action?
  2. Hello any advice on this would be great please! I have an outstanding balance with next catalogue. I have recently fallen behind with payments and have kept in regular contact with them regarding payment plans etc as my hours dropped in work. I have been paying around £50 per month however this has not stopped them now issuing a default and passing me to a dca who have began to text and call me even though I have received no written correspondence from them as yet. I have not called them back or answered the phone. I contacted next and asked if they could help and they are not interested and told me a default will be registered against me. I want to do anything I can to avoid this! It is not my intention to avoid paying the debt or ignore it...I simply want to try and avoid a default. I know for a fact that they do not have a cca as I have never signed one and wonder if there is anyway I can use this to my advantage to get them to take the account back and allow me to clear the balance without a default?
  3. I told the woman on the phone today that any contact would now be in writing...I defo don't owe any money to argos. I'm dreading the drama of being passed back and forth between the different companies but don't want this showing on my credit file for another six months! Question is do I write back to them directly as I read on the ICO website that they have to prove you owe debt not the other way about so would I request this to be sent to me first?
  4. oh forgot to add that all three credit reports are saying the balance was either settled in 2006 or satisfied this year (which it hasn't been by me anyway!).....but Fredrickson are telling me that the balance is still outstanding and will be pursuing me for it.
  5. Can anyone please help with some advice on how to proceed with this? I checked my experian credit file a few days ago and was surprised to find a default from global arrow for £172! Started: Feb 2006 Defaulted: Aug 2006 Satisfied: Feb 2012 I then went on to check credit expert and equifax and both have listed this account also. Call credit lists similar details to experian in that I defaulted and it has this month been satisfied....Equifax lists that the account was settled by payment in Aug 2006 and no default is shown! I contacted arrow global who put me through to Fredrickson and after several calls managed to speak to a girl who couldn't understand what was going on. She said that according to their files the balance was still outstanding and was for argos additions. She said she would look into this and she called me back today. No she is telling me that the account was supressed for 5 1/2 years and they have no idea why and it was due to go live this week so I would expect to be recieving letters to make an arrangement to pay!! Firstly I can't understand why it would take so long to appear on my credit file..5 1/2 years The differences between experian and call credit stating default and equifax stating satisfied why the account would lie "suppressed" for so long I have never satisfied the account as I never even knew it existed ......most importantly I have never had a argos additions account in my life and I am 100% certain of that. She advised me that once I receive my letter from them asking for payment I could call her up and she would put the account into dispute while it was looked into. I know by others experiences and my own past experiences that it is unlikely to be as simple as that. I advised her that I must be a victim of identity fraud and would be contacting the police with copies of my files etc to gain a crime reference number,....she said that if i did this then the file would be closed down etc. My main concern is the hanging around waiting for the debt letter to hit my doorstep....do I wait or do I take the matter into my own hands first by writing out to these companies to get the ball rolling? or do I wait until it falls of my account in a few months to save me the grief of trying to fight with a hundred different agencies!? Any advice on the best course of action would be greatly appreciated please.
  6. Hello can anyone please offer me advice on the best way to proceed with this. I have just logged into my credit expert file and a default has been registered from a company called Global Arrow on behalf of a mail order catalogue. The problem is that the details state that I took out the credit in Feb 2006, defaulted in Aug 2006 and satisfied it this Month! - Feb 2012 I have no idea what this is for as I was unable to get credit at that particular time due to a messy credit history from a very messy divorce and I certainly haven't received any letters from this company or satisfied the account! I have emailed credit expert this evening but wonder if there is a standard letter I should also send to the Arrow agency before I proceed? If this is correct which seems unlikely due to it being satisfied when it clearly has not and the itme factor in between alleged default and registering it - then I guess I will have to wait until Aug until it falls of my account but it stinks from lots of levels! I have only just in the last few months got my file back up to scratch after a long wait and a lot of hard work and this has brought my score to an all time low. Any advice would be greatly appreciated.
  7. hi sorry if i am posting in wrong place! can anyone please give me advice or point me in the right direction? I am finally getting my credit rating back to normal after several long years and I have no more defaults etc on my file...however cabot financial are continuing to search my credit file for an outstanding debt?!? I am unsure what specifically to write to them about and how to go about making sure they no longer search my file..(surely they cant if the debt is to old to even be on my file) its currently stopping me from obtaining even a decent bank account as i am currently still sitting with a squirrel card (thanks BOS!)
  8. The last payments would have been around 2002 well over thesix years. Certainly no payments have been made on the dates stated. Thecomputer print out they have given me lists payments I have apparently made however do not show any specific details relating to me. I will send the first letter and see what they say. What happens if they cannot provide these details? I know for a fact no payments have been made the sneaky snakes
  9. Hi apologies firstly as I am sure this has been covered several times before which I am unable to find! (feel free to direct me to a link if poss plz also) I have received three letters recently for debt over six years and have sent off the statute barred letter.... Today I recieved a letter from 1st Credit claiming that I have made payments to Connaught by way of a standing order between 16th June 06 and 31st May 07. They attached a print out of these payments which looks suspect in itself ......(Payment type states "payment from connaught" - not to connaught and doesnt really link me to the payments directly. I have not made these payments to them and have also checked back my bank statements to confirm this.....they total £150. My question is what do I send them next please? Do I request proof of the agreement etc? Do I ask them to prove the payments came from me? I am unsure how to go from here. The payment printout they have sent me does not look like acceptable evidence that I have made any payments to this account which i know i have not! Any help would be most appreciated please and thanks in advance. Ps I am in Scotland also..
  10. no i seem to just have a standard meter..just one reading on it and this is what they bill me for. i have contacted my landlords electrician and they have checked my wiring etc and everything seems fine so no help from them!
  11. I am currently with scottish gas after switching from scottish power in sept 08. The current bill I have just received is for over £400 for the quarter and when I call them they reckoned that was okay for a one bedroom all electric house with a single person living in it who is not home a lot! As you can imagine i am now watching my meter like a hawk and took a reading last fri and again this fri with a clockage of 79 units used averaging 11 a day...I know its now the height of summer and the other bill reflects winter so i am also considerin this. The difference however to what they say would triple my bill to over 30 units however and i cant see how this could be possible!? the landlord tells me the all electric heating would be a factor but i try to keep that to a miniumum and it is never on when i am not here...timer etc...and i do not keep it on a lot I asked for someone from british gas to come out and check my meter and they said it would be a £70 call out charge....being a full time student the bill is hard enough to pay never mind that on top. My question is...does this amount of usage seem normal for my living situation and can anyone comment who is roughly in the same boat? i have taken a reading from my parents house and will again nexxt week and this reflects my dad's constants usage of 2 tv's throughout the day...washing machines etc...just to see how much they use in comparison. Also is it possible someone else can be using my electricity?....i turned off my power at the internal fuse box for a few hours and it never moved:(...disappointing when if that was the case i would feel relief that i am actually not using that on my own! I am now monitoring usage and recording and will be paying it on a weekly basis based on the reading i take....as the arrival of mail man is starting to scare me I also noticed today after scrutinising my bills that the bills from scottish power and scottish gas have the same meter number on it...but the top part of the electricity supply number is different??...would this change if i switch suppliers as the bill from scottish gas states below it that it is still a scottish power pricing area...i thought this number would be unique to me then and would not change? any help would be great.....thanks in advance.
  12. Hi Rob I to am in the same situation and even though I am now switched to scottish gas i am facing almost a five hundred bill for the quarter. the previous bill was around 650 and it paid this off fully initially thinkin it was because i had been goin by their estimates and when i gave them the correct reading over the phone thought my consumption was much more.... but now this bill is also estimated by them and is actually lower than the meter says! scottish gas want to charge me £70 to come out and do a check on the meter as i believe something is defo wrong!! (one bedroom..single person...out a lot!) .....i am now taking weekly checks of electric and my landlords electrician will be visititing tomorrow....i wont be keepin this lease on past xmas now as despite living here two years being a full time student i cannot afford this crazy bill.... i am away now to check all the suggestions from posters ...eat the contents of my freezer turn the electricity off for a few days and go down south.....lets see if anyone has no power in the close:mad:
  13. thank you.... so would i just refer to that act in relation to the letter then. please forgive the ignorance. Lx
  14. Hi can anyone tell me if this letter applies to Scottish law also please? Account Ref xxxx Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date. Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384 . per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance. Yours faithfully,
  15. thanks so much for your reply Fox I will get that sent off straight away.... Would u be able to tell me if once it is sorted with them (ie they stop chasing me for the debt over six years etc) do i then have the power to ask them to remove the debt search from my credit file? When i called equifax they told me that the search would have a negative impact on my file. thanks in advance L
  16. Hi I am new to the forum and it has been a great tool so far with all of your advice:) Can anyone please advise me on this...sorry if its long winded I contacted cabot today as they performed an outstanding debt search on my account a few days ago and it is in relation to an account with halifax that defaulted in 2003....I questioned them as to why they are chasing me for this when it has fallen off my account and no ccj was in place and they say i made a payment in 2005..which i did not. They asked for payment on the phone...i refused...but what should i do if they write to me now pursue this? and it re shows on my credit file! At the time of the default I was left by my partner with all the bills and mortgage to pay as our marriage broke down...I made the choice to default on 3 credit cards and my halifax current account as money advice suggested this was the only was to stop the balance continuing to cripple me with late charges and interest...and concentrated on the debt i was falling into with my mortgage. I have gradually managed to sort my debt and my credit file is slowly looking more promising (not that i want anymore debt but gettin rid of my squirrel card!!...stupid visa electron card would be nice) so....i just dont know what my legal stance on this is.....whether they can still chase me for money if i have made no payment...do they need to provide proof of this supposed payment in 2005? ....and can i request they remove the credit search from my file as equifax are sayin it will have a detrimental impact on my rating:mad:
  17. Hi A linked address is showing from a flat i am renting from british gas when i started an account with them...this is annoying as i do not intend to register every address i rent in while i am a student:evil: all my details (bank accounts etc) are registered to one address (ie my folks) will creditors now look at my rented address also as i have heard that streets can hold bad credit and houses from previous tenants. i dont want to be affected by anyone elses bad credit:sad:
