Khalid, that is exactly what happened to me at the same stage, I have had a reply to an e-mail to rachel hinchcliffe senior lawer telling me that they had not recieved my claim. Well letsee what happens next as mine was acknowledged at the 11th hour beffore judgment could be passed on 15th. Just got acknowledgement through and they intend to defend mine - All this time wasting is immoral and really getting on my nerves especially after all the quick settlements lately Regards Amanda

Just, filed for my credit card charges on moneclaim and noted that judgement has been rejected- for current account claim - obviously reading the user guide it would appear Halicrap must have left it to the last possible minute to file an acknowledgent! DOH! Oh well will really have to practise those relaxation excercises now good luck to you all, I hope mine hasn't run out!!!

Well heres the update, requested judgement in the early hours, and then just logged on to mcol and it is showing as acknowledged now!!! Slimey stalling halicrap have waited till the very last minute to acknowlege. What is going on with them, they now have another 28 days to file a defence now.???? Oh well mudst now work on relaxation and patience excercises. Amanda:-o any thoughts or support would be apprecaited:oops: thanks

kHALID, have just spoke to mcol and they say that judgement letter will be automatically printed and sent off to Halifax, and to just leave all correspondance to the court - incidently she said it is not unusaul to have no acknowledgement and that the claim may just still be lostn in thier system due to amount of claims going through. Incidently even though we pressed pay immediately they have up to 30 days to pay before A warrant is issued. She said they may just pay up this week to get the judgement removed. I would sit tight with the int charges and concentrate on getting the rest of the amount at the moment - It seems we may have set a precedent on the forum for lack of acknowledgement to claim. regards Amanda

KHALID, I would try not worry, as stated in earlier threads I am at exactly same stage and requested judgement in the early hours too. Incidently I included the8 % interest in the total, and they still did not bother to acknowledge. They also offered me 2 amounts the greater being £904.00. Just before moneclaim. Hi Guys, another update, just tried to start judgement as 14 days up today, but it won't let me!! Apparently because it is a weekend that the deadline falls on, Halicrap are given the next working day too to respond!!! Will now have to be really patient and wait another day. Amanda

Hello everyone, just thought I would update you all. Today is the deadline for the Halifax to acknowledge my claim - still no word - on the claim, although they phoned this morning at 8.30 to ask if I could pay my over the overdraft amount!! MCOL is still saying issued, but it will not let me start judgement- guess I will have to wait until midnight and hit the key!!!! Anyone else at this stage out there? Good luck to everyone Amanda

Hi Mark, once you file your claim, youn are given an issue date and a service date. The defendant is given 14 daYS either to acknowledge claim, put in defence, or ignore your claim. iT appears they have ignored mine as of tomorroe, therefore, I can ask for a judgement to be made and all the money be paid back via a judges order imediately. If you can familarise yourself with the site and log onto MCOL HMIC and havev a look at moneyclaim on line - it will give you an idea of all the bits to follow as laid out in the faq. Hi again Mark, I have filed for moneyclaim and Halicrap have failed to acknowledge as of 13th. Therefore, come tomorrow I can ask for a judgement for £ 3.011 + xtra int now. . I am going to file for the joint account £ 1,599 on the 14th and my cc on the 16th. After reading all the threads on this site. Halifax are so overwhelmed they are truggling a bit, but just follow all the timescales laid out and let hem meet your timescales. It is such a good site and there is so much help around, just make sure you read ll the faq and use the templates, if you are stuck just post- someone will help. Hello Mark, wecome on board, I wouldn't think that the change of address should make any difference. I think that depending on the amount you are claiming it is your choice as to whether to lump them together or if it will take you over the 5k threshold, then split them up. I have a cc account , a joint acount and a current account and, I am at different stages with all 3. GOOD LUCK, you won't need it though Amanda

Hi everyone, just thought I would update you, just checked my account this afternoon- no money put in. Clock is ticking and Halifax have until 13th to acknowledge claim and then it is judgement day. Have read about posting the judgement on MCOL? Has anyone been at this stage ? and has any advice please? Sneaky Hliafax have sent al etter today, stating that my payment plan has been cancelled!!! I have never had a payment plan. It appears they may have taken away my overdraft too!! Help !!! If this is the case I really am well overdrawn!!! Cheers Amanda
