  2. Hi Forum, I have an unusual and complicated situation that I would greatly appreciate some helpful advice on. On 31st March 2008 I entered into a HP agreement with BH, total price £11,179.83 and paid a deposit of £500. The total credit charge was £2,858.65 and agreed to be repaid by 48 instalments of £282.26 I was able to meet the payments up until and including November 2009, but after this date I was unable to due to my company going into liquidation. I held onto the car without making any payments until October 2010 in the hope things would improve and I could get back on my

  5. Hi Everyone, I currently am in the process of fighting a dispute with HSBC which has been going on for nearly 3 years now! It is still unresolved and can be seen here if you want to know more. Anyway, a colleague of mine is now in a similar situation regarding a personal loan with HSBC and I recommended posting it on here to see whether the agreement was unenforceable or not.   6. Steven, I may at most have been 1-2 payments behind, but nothing like £2,000 - £5,000 pounds. Do you still think I should submit an SAR?
  7. Can I first say a big thank you to everyone who has contributed to this thread, especially Steven and Citizen B. Firstly, Steven, the PDF attached of the dualcalc says it is damaged and will not open properly. Could you please reattach a new one? More importantly there is alot of information on here and I would appreciate some assistance in the best way to proceed with this now. I note that Castlebest suggests submiting an SAR in order to get all of the information in order to get a precise and accurate statement of affairs to then be able to put undisputable facts under HSBC's nose.

  9. Ok the first time I asked for a break down of the amount of the ML I received the following: "We can confirm that your Managed Loan was for £23,020. This balance was made up of your current account of £398.47, your Personal Loan of £21,599.87 and your credit card £1,012.95, totalling £23,011.29. This is then rounded up giving the figure £23,020." Then upon asking if any amount fo the PPI premium was in the ML I received the following: "We can confirm that your Personal Loan protection was not included in the amount of your personal loan that was consolidated into your Managed Lo

  11. They said that when the PL went into the ML there was a rebate and the PPI was cancelled.

Steven, I have received another reply from HSBC now saying: "We can confirm that your Personal Loan protection was nt included in the amount of your personal loan that ws consolidated into your Managed Loan." So I am at the stage now where I need to respond formally to Metroplitan Collection Services as to my position on this issue. Do you think that the incorrect TCC is still grounds enough to contest the agreement and that it is only enforceable through a court order? And what details will I need to highlight to them in a letter if I do contest the agreement on these gro
  13. In addition, it doesnt appear to alter the fact that the TCC is incorrect still as it doesnt stack up properly. I will ask the question about there being any of the PPI premium being in there.

Hi Steven, I have received a letter from HSBC regarding the PPI, and it reads: "We can confirm that the Personal Loan Protection Insurance was cancelled when your accounts were consolidated in to a Managed Loan. Personal Loan Protection Insurance is applied at the beginning of personal loans and when loans are consolidated in to a Managed Loan, any remaining money that you have paid for your insurance is deducted from the total amount of your Managed Loan."
