  1. Please please someone respond with advice. I recently offered MBNA a payment of around £35 a month, as this is genuinely all I can afford. The first person I spoke to said that that was fine and they would set up an agreement based on that for a short period, but then someone called a day later and said they wouldn't set up an agreement, unless I make a payment immediately. I said I couldn't pay the first amount until the end of the month, and they said they would need to see commitment of at least 2 payments over the next 2 months. Anyway, I got paid from work early as it's Xmas. So I called MBNA, but the guy was really unhelpful. He took the payment, then said according to my credit file I had a loan that was up to date, and that they couldn't set up an agreement for the lower fee, as I was up date with this other loan, and that showed I was giving preferential treatment. Now it's true, I have managed to keep up with a few debts that are tied in with my bank/account, as I figured it's better to have 1 or 2 defaults rather than 3 or 4? Anyway the guy says they won't set up a reduced payment option for me, and that I would have to have one in place on my bank loan as well. He said that they will sell the debt to a DCA in the new year, who will take me to court. Now please, I'm begging here, can someone please please advise me?! P.S. I took a big (around 9k) pay cut last year, that's how all this happened. I'm desperately trying to find a better job, how can I hold them off?
  2. Hello. I'm in a similar boat to everyone else here... I lost my job and started defaulting on my payments on my credit cards. Where as Halifax have actually been very understanding, MBNA were nasty from the very start, including phone calls where people would laugh down the phone then hang up (these came from Global Vantedge), calling me at nearly 10pm on a Sunday evening! So I am now 3 months in default, and have sent the CCA request, which (of course) didn't get replied to until nearly 2 months later. What I received is a copy of the agreement they sent me, but there is no signature on there. Do they have to have a signature to make it stand? After I sent the CCA about 2 weeks with no calls passed, then they really stepped it up! About 4 calls a day, and letters every few days. The last letter stating I had 7 days to call them or they would take me to court and have my salary deducted, amongst other things... What should my next step be...anyone?
  3. Hello all, be careful with these guys! They are calling me day & night (just had a call at 9pm on a Saturday). I am have now managed to get up to date with my debts, but as a consequence of MBNA's actions on missing...ONE payment!, I am going to see if I can get released from my debt on legalities. The irony being I am now back on track, and 'could' go on paying my monthly installments. GLOBAL VANTAGE, have been calling me, and then putting the phone down on me. With periods of people laughing in the background. I then called MBNA direct, where they also put the phone down on me.
  4. I have found this thread as a consequence of being in the same boat as choppers. I was made redundant about 2 months ago, and have finally run out of money. I have defaulted on an MBNA payment by about 3 weeks, and have just started receiving calls (many of them) from GV. I think I took my MBNA CC out about 2007. Now I would not normally consider this if they had been more reasonable, but do agreements taken out only a few years ago have a chance of being unenforcable?
