  1. I've received some unexpected help as a result of my thread on Pepipoo. Armtrac may be getting more than they bargained for. Watch this space...
  2. What about the first line under the heading. 'Issued in accordance with Armtrac Security Services (off-street Parking Places) Order 1997' Do you have any idea what this is about?
  3. I thought that the reference to the act was a weak point in their invoice. It makes no real sense but I guess is there to make the ticket look official. What is the best way to include this within the defence?

I'm particulalry thinking of the mention of the road traffic regulation act 1984 at the top.

Surely if penalty charges are unlawful, even if the signage is clear it shouldn't make a difference?
  6. Thanks for the advise everyone. I happened to be passing through Truro today so I handed the acknowledgement of service into the court by hand. They confirmed that I have until 16th July to submit my defence and that it will then be passed to my local court. I also took some photos of the signage in the carpark which I will post up shortly.
  7. I have completed the Acknowledgement of service form which gives me 28 days to submit my defence. Does this have to be a full defence or at this stage can I simply put that - 'I can neither confirm nor deny that the alledged incident occured' and ask for proof from the claimant that it did?
  8. I certainly plan to defend it. But I definately want to make sure I don't make any mistakes in my defence. Unfortunately in my initial letter to Armtrac I stated that it was me who parked the car there. I guess this is what makes them confident enough to take the issue to court. The basis of my defence will therefore not be identity of the driver but a. the fact they have no proof that the ticket was overstayed b. the signage being insufficient to form a contract c. the fact that they are charging a 'penatly' for a supposed breach of contract.   9. To give the background, I was issued the invoice back in January. Its a company car so I contacted the hire company who told me that they always pay any charges on their cars and then pass on the costs to the company. Because of this I initiated contact by following the template on these pages. A number of letters have since been exchanged and despite their not being able to provide proof that the ticket had been overstayed (which is the basis of their charge) they have started court proceedings.
  10. I've mentioned this on one of the stickies but now I've been able to photograph the papers I thought I'd start a new thread.   11. Signage is not noticeable in the car park, which I have used often . I simply put money in the machine, stick the ticket in my windscreen and leave. I will take photos next week and post them up. They have written to me 4 or 5 times and I have replied asking for evidence etc. Their last correspondence in April stated they would issue a court summons if I didn't pay up. I replied with the relevent template including the cease and desist bit and the next thing is the court papers this week.
  12. In theory a ticket may have been purchased. The cost would have been 80p for an hour. Armtrac's claim is that after an hour and 14 minutes an invoice for £80 (60 if paid in 14 days) was applied to the car. They claim to have proof that the ticket was expired and have send me several photos none of which proves anything. I now have a photo of the back of the car showing the number plate but no ticket or PCN. One of a parking ticket and PCN attached to an unidentifiable peice of glass.   13. The claim was filed by Christine White. The particulars of the claim are: Vehicle Registration Number XX00XXX was Parked on xxx xxx xxx Car Park without a Valid ticket on display (ticket expired) thats all she's written including her strange use of capital letters. I can get a photo of the claim form uploaded. How much of it should I scrub out?
  14. Thanks for the reply. I contacted the hire co first and they said they always pay any bills that come through and then invoice my company. I then followed the instructions for this scenario on the templates page. I've not posted this before on CAG as it seemed pointless to put up the details as I knew what advise I'd get from reading other posts. I registered yesterday as I'm now unsure of the best course of action because as you say very few cases get this far.   15. Hi I have been following your instructions following a parking invoice back at the start of the year. I initiated correspondence as the car is a company vehicle and I was concerned that the lease co would dimply pay and pass on the cost. Basically the parking co have made good on their threat to take me to court and I recieved the stamped court papers today. This doesn't make me any more willing to pay up but I would appreciate some advise on my next move as was hoping it wouldn't get this far. If anyone can point me in the right direction I'd be very grateful. Thanks
