  1. Good Evening. I've had lots of help on here and I'm very grateful. I was an habitual 'ostrich' but I now check my mail daily and this evening found 2 undated letters from Marston's with regards to unpaid congestion charges (x2) I turns out they are for 2 dates very close to one another and I must have forgotten to pay them. I'm usually very good with the congestion charge so this did come as a shock. I wasn't aware of them and I have emailed Marston's thanking them for bringing this to my attention and informing them that I will be filling out an out of time statutory declaration with regards to these. As you would expect the amount of money that they say I owe is outrageous. (£334.94 each) I have asked them for a breakdown of their charges however I would like some clarification on this please. How much is a Bailiff allowed to charge for collecting unpaid congestion charges? I'm perfectly happy to pay a reasonable fee to them seeing as someone has had to make the effort of hand delivering these letters. It's not their fault I've had my own problems and not opened or seen mail for many years. (That's not the case now but the past is the past. I can't change it.) I also understand that by completing an 'Out of Time Statutory Declaration' the clock gets reset and I will then pay the congestion charges accordingly but what happens to the 'proper' fees? Personally and morally I believe I should pay them, when they have confirmed to me that they are correct and lawful. I know there's lots of bad press about them and they do seem to have very few morals but that doesn't mean that I should lower myself to their standards should I? So. What I'm asking is what do you think is the correct amount this firm can charge and also is it right that they charge twice for whatever it is when they are doing both tickets in one visit? Below is a copy of a post from fork-it about fees: " The law prescribing bailiffs fees for collecting unpaid parking tickets is Schedule 1 et-al of the Enforcement of Road Traffic Debts (certificated Bailiffs)(Amended 2003) Regulations 1993. It provides for bailiffs to charge: Letter Fee £11.20 - If letter arrives after first visit is made then its £0.00, if a bailiff says he sent a letter, you have a right to see the Certificate of Posting which has been date-stamped by a postmaster. This is not the same as a proof of posting. Levying Distress up to £100 (excluding bailiffs fees but including court fees) - £28 More than £100 - 28% for the first £200 then 5.5% on everything over £200 If no levy is made then bailiffs can charge fees for a maximum of three visits. Multiple fees cannot be charged for simultaneous unpaid ticket collections. " Am I right in thinking that this should be 2 x £11.20? I don't believe any Levy has been made. (How would I know that also?) Lots of food for thought!
  2. I'm sure someone with more credibility will be along but here's a Notice/Claim of Ownership. I've copied this from the consumerwiki, just adjust, get your mum to sign it and send it in. BAILIFFS NAME AND ADDRESS DATE Dear Sir/Madam Re: : Notice of Ownership I write on the understanding you or your firm of bailiffs has seized, or is intending to seize chattels, vehicles, goods, or property belonging to me at the above-mentioned address in respect of an alleged debt belonging to somebody else. I confirm that I am the lawful owner of the aforesaid and there is no entitlement enabling you to change ownership, possession, location, use and enjoyment of my property by way of a levy or a walking possession agreement. This document is delivered by Royal Mail and I deem it to be served on you by the ordinary course of post in the meaning of Section 7 of the Interpretation Act 1978 and therefore your responsibility this letter is handed to the relevant person within your organisation. Any attempt to subvert or rebuke this notice will result in an invalid levy and I will automatically file at court a Form 4 complaint with an application for costs against the certificated bailiff without contacting you further in this matter.   3. Hi Badger. First of all well done for getting your head out of the sand. I'm guilty of that and I know how hard it can be to get out of it. I'm sure people with lots of experience will be here shortly to help you but I think it's important that you let them know that you do not live at your Mothers address and that she is vulnerable. I'd also get your mum to fill out a 'Claim of Ownership' stating that she owns all of the items in your house. It's your fine, they're merely trying to get the fine and no doubt trying to intimidate your mother. There's some great advice on bailiffadviceonline and also bailiffadversary but I'm sure you'll get what you need here. It's really scarey I know but keep your head out of the sand and continue to ask for help. If you haven't got anywhere to live and no money to pay the fine they can't do anything about it. I would get you'll need to make a declaration to the court etc. but once again someone with lots more experience will be along to help. One thing I know I can advise is NEVER call the Bailiffs. Do everything via mail. (Although I'm not sure how you will do that with no fixed abode.)
  4. Apologies, this is copy of my original post that I put in the parking ticket section. Somebody advised me to ask in this forum. Hi Everyone. I'm very new to this so let me apologise if I get any of this wrong! I checked my mail this morning after walking the dogs, (I live in an apartment block.) and found a hand delivered envelope from 'Whyte & Co' Certificated Bailiffs. In it are 3 sheets of paper. 1 is a Warrant of Execution for an unpaid penalty charge that I knew nothing about until this letter. (£155.00) There's an 'Enforcement of Road Traffic Debts' paper which takes the £155.00 and turns it into £296.00. Then there's a 'Notice of Removal of Expenses' letter whereupon they've charged me a further £681.00 to remove my car! That's £971.00 for a £155.00 parking ticket! I'm sorry to say that due to various circumstances (bad news health wise, loss of job and some other stuff I don't need to go on about in a public forum.) I hadn't checked my mail (the letterbox was full to the brim) for a long time. I got the lock replaced about a month ago. The car has been parked in the garage as it needs 2 new tyres and I couldn't afford them. I've not used it since November. The Bailiff says he was at my place from 0700hrs until 1130hrs on Friday morning but I didn't leave for work until 0930hrs and I walked my dogs without seeing anybody near or around. Nobody rang the buzzer or knocked on the door. Am I stuck with this or is there anything at all I can do? I know I have a part to play in not having a letterbox for quite some time but to be honest it was the last thing on my mind. I'm out of that hole now and ready to face everything I need to. 'Just for today' you could say. Thanks very much for any help in this matter.
  5. It's a big communal garage with an electric shutter, it's always going up and down. I'm not saying I won't pay a parking ticket but I've never had sight of it. (You think I'd learn my lesson with this but 'ostrich syndrome' is a big one for me. Stop opening the mail and unplug the phone and it'll all go away. I've decided that's not working for me any more! lol.

  9. No, I've lived at my present address since 2002 but around the time of these judgements I had "a lot going on" in my life! lol! Basically, I ended up in rehab and had to deal with some of the physical consequences of that (I've kind of given myself a shorter shelf life that I would have had but with the correct medication I should live for another 15 to 20 years (I'm mid 30's.)) and was in total meltdown at that time, I actually lived at my friends house for nearly the whole of 2005 whilst I learnt how to live life on lifes terms again. Needless to say, I'm not after sympathy and just for today my life's much much better, but I'd really like to get this job and this has really floored me. Thanks again for your help, how would I go about getting them "set aside"?

  11. OK, I've just gone on that site, it cost me £30 to check them all and I've got the same information that's above, 2 judgements against me 1 in Romford and 1 in Northampton. How do I find out who they are from please? I'm quite worried as one of them is for a lot of money and I seriously know nothing about this!

Hey Everyone, I've been a lurker on here for a while now but I've just gone for a new job in the finance industry (I've worked in it for some time now sorry!) and HR have told me I have 2 CCJ's on my record. How do I find out what they are and who I allegedly owe money too please? This is the first I've heard about them and of course I can't have my new job if I have CCJ's. I'm sick with worry.
