I was thinking of what you said in post 8, as regards 'limits'of FOS FOS have come back with "BPF say they do not have any copies of the cheque, nor do their records show into which wrong account funds were placed. They are probably right, so we cannot decide against them. Any Legal ramifications are not for the FOS to consider" I have sent a reply winging back to FOS, and pointed out that BPF sent a full set of Statements, (in with original claim) taken straight off of their system.   2. Hi Slick. The intention of starting this new thread, was the first question, Re-activation. It is our contention, that BPF acted Illegally from the outset, and that there was no Legal basis for any actions taken after this !! The same opinion was held by the CAB, who we went to during the troubles. My gripe with FOS, is that the above is what we went to them about in the first place. There was no mention of limitations. Them having sat on this case for over a year, has allowed BPF to pull all kinds of stunts with impunity.
  3. On the question of FOS. Had a letter recently from the poor chap, who has had to sit staring at the file for the last 13 months. He states, amongst all the waffle, "we can only study the financial technical aspects. We cannot (and will not) make any decisions on Legal matters. Therefore, we cannot comment on any agreements made, or possible Illegal activities by the company. This is for a court to decide" In other words, this is a cop-out. They have effectively disqualified themselves from the proceedings.
  4. Slick. I already have a large box file crammed full with letters, statements, notices etc. Everything is to hand. The first cheque (as per retailer contract), was supplied by retailer. I sent this off Sept. During kerfuffle with BPF, retailer rang and confirmed their records showed this had been cashed within two weeks. I honestly think that BPF accounts made a big mistake. They had not realised, or checked that the accounts had been consolidated, and was now just the one.   5. Hello slick132. I will try to be as brief as possible. I will also leave the Chocolate Teapot (sorry, I meant to say FOS) until last. August 2007. We were abroad at a retailer. We wished to upgrade an item with them. There was already an existing loan through this retailer. Agent suggested that it would be cheaper to combine existing loan with a new one, and have them under one account number.   6. I have a question (or 2) for all you bods in the know on the site. I have followed this site for some time now. The first one is.........I had a consolidated loan with BPF. This loan was paid off, settled and Closed, with a zero balance. Two months later, BPF, without my knowledge, Re-activated the account. Can they do this...............?? I first realised when BPF wrote to me. They stated "We do not think this account was paid correctly. We have withdrawn Funds from this account, to pay into the incorrect part of that account. I do hear the caggers on Clydesdale / Barclays PF Post just love to hear more things about them About 15 months ago, I got into a serious dispute with Barclays Pinching & Fiddles, Glasgow. It concerns an Account that was Settled & Closed in 2007. I went to the FOS at Xmas 2008. Just been informed by them, they are starting enquiry in 2 weeks time. Mercers (BPF) have at the same time, slapped a Default Notice on me. Although

Company say we can upgrade, we agree. Company says we can consolidate into one Agreement to make life easier. Get settlement figure for XXX from Clydse. XXX is put into new Account YYY, and new Agreement ZZZ drawn up. Month later, part XXX paid for. Settlement figure for remainder of ZZZ requested, this is YYY. My Bank, loan is cheaper than (now) Barclays PF. Month later, YYY paid off. BPF send settled letter for Agre
