hi, my sister-in-law rented a flat in glasgow on a 6 month AST from a private landlord (with no agent involvement) that expires in July 09. she wishes to stay in the flat, has no rent arrears, no other problems and the owner is happy for them to stay - however, this is where it gets difficult: instead of offering another AST, the owner wants them to move to a 'rolling, one month' contract. she doesn't fancy this for the very simple reason that it seems to offer no security for her and her young baby, and what makes the situation more difficult is that the owner of the flat lives on another continent and has serious debt problems in the UK (as witnessed by a couple of Sherriffs Officers turning up on the doorstep early in the tenancy), and is using a locally based friend as their representitive. my sister-in-law needs to know whether this 'one month, rolling' tenancy has any legal basis, and whether the landlord could have any other reason for offering this kind of tenancy other than the ability to get them out quickly should they wish to re-occupy, sell, or re-let the property? any advice gratefully recieved...
