  1. Hi thanks for replying. I will wait to hear what WF's reply is to our last communication before I go back to their Solicitors. That would be the best thing to do atm I think, but thanks because it never occurred to me to get back in touch with their Solicitors considering the Court stuff was all over and done with. The Tomlin Order was agreed via the Courts and I have received a Court stamped copy of the Tomlin Order from WF's Solicitors. I have a correction notice placed on my experian report, although it didn't do me a lot of good. Experian themselves have contacted WF twice
  2. Hi, I'd already gotten the FOS involved with my complaint. However, I too was sent a questionnaire by WF to complete. I wasn't aware it was sent to trip people up. WF wrote that if they didn't receive a reply from me that they would not accept my complaint. The FOS telephoned them and told them to naff off because they were involved, but in any case the FOS told me that I still had to complete the form because if I didn't it would give WF the excuse that they needed to throw my complaint out.
  3. Hi, thanks for replying. I did request this information from their Solicitors and what WF did even before my very first payment was due was they "attempted" to take money out of my bank account before the DD Date. My bank statements from 2005 however, show no payment ever having been attempted by WF. WF had just added it to my account and began adding charges. They charged me for the RAC and they charged me for a mobile phone holder which was already in the car when we took it from them. They've charged for numerous "Court" appearances which they were supposed to have made, but as the Case
  4. More problems with Welcome... I took a loan out with WF in 2005, but I'll cut a long, very stressful story short. I v.t'd my car in 2007. WF told me my accounts were all in order, I'd never missed a payment, so all was OK. I never heard anything further until Dec '08 whereby they said they were going to take me to Court for non payment. I communicated with W.F.'s Solicitors and counter-claimed WF. It wasn't until I received a statement that I realised in 2007, despite WF staff telling me it was OK to VT, I actually owed 3 further payments before I could have done this. I don't know why W

  9. Wouldn't quite agree that I'm enthusiastic about this!!.. , but 'tis OK. I only ever fight for what I believe in and if you don't try then you'll never know.   10. Knowing what I know about them now, without a doubt they would not have upheld any claim made against the PPI. You see my confusion/annoyance about the "live" balance though - live balance currently £555, so redirect to "balance owed" = imaginary PPI minus £555???.... "if a portion of my money went towards a PPI which shouldn't have been on there in the first place - doesn't that mean that they basically "stole" that money off me? - Not as such, although of course, it is potentially dishonest, but since you didn't actually pay that money..." they can't deny that a portion of my money did go towards something other than the loan else why call it an insurance in the first place.   12. it does all get very confusing doesn't it? hmmm.... why then are there claim companies who deal with PPI's, refund of Bank charges etc., etc? I understand where you're coming from though. your 4th paragraph - The debt didn't include interest, nor PPI. This amount was simply the basic amount I would have paid them had they not misinformed me - minus the PPI and interest. Anyways................ what does one do when they have it in writing that someone else agrees to refund them monies (whether imaginary or not)? and if the balance owed according to them is not the true balance F&F
  13. please excuse my ignorance, but how do you mean by a higher debt??? how was it an imaginary amount if the monthly amount I was paying included a separate payment for the insurances and why did they accept the figure of £613 when they could have taken me to Court and gotten £3,000?

Hi The PPI relates to the monies which I already paid them with the loan, which they told me I had to take out otherwise I wouldn't have been given the loan, but you are correct in that if they adjust their figures to remove the PPI, there would still be a negative balance. However, the tomlin order, supercedes all other balances/figures on the account. I don't think I've wasted time and energy tbh - their Solicitors did all the work for me and as the saying goes "it's not over till the fat lady sings"!!....:-|
  15. Thanks I did Email their Solicitors yesterday and request that they contact their clients to ask if they would refund the PPI to clear the Tomlin Order. They have said I can expect a reply in 7 days!.. Hmm.... the thing is it will be interesting to see what WF's reply will be and the reasons why. Hopefully they will see common sense and agree, but if they don't then I will seek legal advice. After all, they are in effect, keeping my money. It's all a bit concerning really, especially after I genuinely thought I had gotten rid of WF once and for all.
