  1. Hi, thanks for your reply, I had a feeling that that would be the answer. The overall amount of charges on the account is more than the current balance so I guess I will pursue reclaiming the charges now. I have managed to not default yet but have missed and been late for a lot of payments so it has adversly affected my credit history. Thanks again.
  2. Hi recieved a CCA from Mint a few days ago and I am not sure if it is correct or not. Any help would be appreciated! I think this is the application form I filled in as you can see it continually says 'please return all four pages of this application booklet'. However on page 3 it is titled 'Credit Card Agreement Regulated by the Consumer Credit Act 1974'? Also if you check the dates in the opening letter I think it is fair to say that the statutory time limit has passed (12+2 days)? Where do I stand on this what should be my next step? One other thing I would like to point out as an aside. I stated my income as £8,800 yet it says on the first page they require a £10,000 minimum income, shows their irresponsibility I suppose. Apologies for the quality, their fault, not mine. Again all help is much appreciated!
  3. Well the reason I would rather go this way is because of my credit file. I have several missed and late payments for this credit card and I have read that it is possible to get it cleared off your credit file rather than have to wait the months/years to pay me my charges back and still have my credit history is tatters.

I recently sent a request for a Credit Agrement to Mint, I sent a letter found on this site: Dear Sir/Madam Re:- Account No: XXXXXXXX/Your Reference Number: XXXXXXX This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply. I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee. Yours, Print name do not sign The time limit which I believe to be 12+2 days has now lapsed. I have had no contact whatsoever from Mint. What should b my next step? Please note I am not trying to get out of debt. The overall amount of illegal charges on the card are greater than the current balance and I think this is my best method of retrieving them. I just never remember signing the agreement and this card has caused me a lot of hassle especially for my credit history. I think this might be my best chance to rectify my situation.
