  2. Hello everybody Barclaycard have sent me back my CCA request within it's timelimit containing a previous address to the one I was living at the time of application which was in summer 2006. (I did make a declined application from the previous address they've used in late 2004 / early 2005). I've just sent them a letter of dispute - I'm thinking though ought I have got them to confirm in writing that that is correct as far as they're concerned or is it too late now? I'd scan the CCA they sent but scanner is out of action Also if this went to court am I correct in thinking that it's unenforceable or could they simply re-produce it with the correct address? Bit worried. Really appreciate any input please...

  4. PS - I should say that the Postal Order is currently back with me - ought I re-send it back to them again before I can write to them stating the account is now in dispute & has been for a number of weeks?

Hello again Unbelieveably I've spent most of July playing letter tag with HSBC about my signature - the Postal Order is looking tattered at this stage from all the 'oh yes you will/oh no we won't'... They're trying to fob me off and of course have long missed the CCA request deadline - what should be my next move - a Dispute Letter? Really appreciate any advice please?

  8. Hello all Sent a CCA to Scotcall on Thur 9th July for my OH's Barclaycard agreement (Mercer's had been dealing with it previously). Just received a reply from Scotcall dated 10th saying "this account is closed, please contact Barclaycard..." They returned the £1 postal order too. I did include in the CCA request the paragraph intended for DCA's which cites: " If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. " Where do I go from here - do I get back to them & point out that they breached s.175 by not passing the request on to the creditor or do I simply re-issue the letter as a duplicate with the clock still running to Barclaycard or do I simply start over with a new CCA to Barclaycard? Any advice would be much appreciated.

  10. Hi again Thank you very much for your input & apologies for the lengthy silence of late (life kicked off...) I'm not aware of a DN having been issued by BOI unless they sent it to my old address in Ireland before I notified them of the change of address & it's simply sitting there (does that give them any traction?) Largo went quiet and have since a letter from BOI notifiying me that they were handing it over to their legal dept. & had another letter from Red Castle-Gothia today demanding payment & threatening all sorts. I'll send the CCA request (should it go to Largo or Red Castle at this stage?) immediately. Really appreciate the help. Many thanks Skeeks
  11. Thanks Johnnymitch Had to wait until end of month (payday) to put requests in. However they've sent me a letter of default dated 18th June recieved by me on the 22nd June with a deadling of the 2nd July - just 14 days. I presume that I should continue making the pro-rata payments which they've declined until I see evidence of a CCA? A bit confused over the default notice & how to proceed... Any advice appreciated.

    Hello steven4064 Thank you for your reply. Sorry for delay in coming back here. Can I just ask, if he wants to do a CCA request wouldn't it be unwise to sign the letter in addition to challenging the unfair charges levied? (I didn't mention that in the original post). We also received a letter the next day from them which actually pre-dates their first letter by one day. In this second letter they acknowledge him contacting them about making payments and enclose payment slips as he had requested. So is just a case of the right hand not knowing what the left hand is doing? The payment was made online around the same time as he proposed it in any case. They've issued a notice of default dated 28th June received in today's post with a 28 day deadline upon receipt. So how best should we proceed do you think? Appreciate your help. Skeeks
  13. Understand what you're saying... I thought though that in terms of evidence for unfair charges it was enough from my statements to challenge they've been unfairly overchageing me (esp. First Direct current account £25 for going pence over my OD limit - forgot to mention that one) in addition to HSBC current account. Also evidence-wise, the HSBC credit card - my circumstances when I applied for the card indicates that the PPI was mis-sold... I've placed a thread in the other forum, so you needn't address that. But do you see what I'm getting at - is my impression of what constitutes evidence irrelevant until I get the SAR? One other thing if I may? Is there any conflict between requesting a refund of charges and at the same time doing a CCA? Really appreciate your time with all this S
  14. Forgot to say - they have cancelled my credit card PPI saying that this does "not affect any claim that may alread be in place" - I did mention in my previous letter to them that it had been mis-sold to me a couple of weeks back. Can I still make a claim? Please anybody?

  16. Lovely - so your saying that SAR will have the same function as a CCA reuqest or rather will let me see if they have one and therefore whether or not to request one - am I correct?

Hello everyone I am having problems with HSBC at the moment - due to dire changes in our circumstances OH & I have been advised to concentrate on paying our priority debts each month since April. We have sent pro'rata payment proposal letters along with a statement of our incomins/outgoings & unsecured debts to each of our creditors - some of which have been accepted so far & we've gone ahead and made the payments to all of them in the meantime to show willing. I have an HSBC credit card, overdraft and personal loan. HBSC are being really difficult with the credit card account (no reply from loan or overdraft) saying that the proposal is unacceptable. I replied using the follow-on template for such an eventuality. Rec'd reply yesterday stating that they are proceeding with normal collection procedures DCAs etc. If I make a CCA & PPI request on loan and c.c. will this make matters worse - although how I can't see...? Also would a Subject Access Request cover both of these eventualities? What kind of timescale am I looking at in needing to make these requests? I would be hoping in the case of PPI to make a hardship claim and believe we would meet the criteria from what I've read here. The PPI was definitely mis-sold on c.c as I was working as a temp with erratic hours at the time c.c was granted & despite numerous requests over the phone to cancel the PPI on the credit card over the years was advised that it could not be cancelled (as recently as 2007) . Looking back at old HSBC current account statements re: a previous HSBC loan taken out & cleared, I discovered had the loan insurance loaded as a single payment from my current account while in that same job, can I put in a claim for this too even though it's been paid off and I have through necessity now missed 3 payments on both present loan and c.c? Sorry to be so long-winded - I'd really appreciate any help out there please... Thank you

In terms of specifying the SAR documents I'll need - can I simply ask for every shred of info they hold for me accross all 3 accounts (loan, cc & overdraft) or this that too ambiguous and will they take advantage (as if!).     Hello all, OH received reply from CapOne to our recent pro'rata payment proposal this morning saying that they were "unable to action your request because you have not signed the letter you sent to us. Please send in your letter again with your signature on." Where do we go from there - the outstanding amount is in low 200's and we can't tell from the letter if they're willing to consider the proposal (we've made the payment anyhow) or whether they're after a signature... They've levied a £12 payment default charge which has taken it over it's limit so they've whacked on a £12 overlimit charge to boot Any advice most welcome. Thank you

  21. I have a debt outstanding with Bank of Ireland in the Republic of Ireland. The situation is very similar to this one : http://www.consumeractiongroup.co.uk/forum/general-debt-issues/158449-castle-let-battle-commence.html I had been paying the loan off remotely but have recently got into financial difficulties and can no longer make repayments. I had a letter first from Red Castle and then another letter arrived the other day from a law firm called Largo. They threatened court action but told me to reply to Red Castle. What should I do in the first instance? I am completly new to all of this and stressed out! My understanding from reading the other thread is that the debt cannot be enforced in the UK. Is this correct? Really appreciate any help on this.
