  1. hi all im looking for some advice for friend of mine her ex partner ( been split up for 4 years) has made an application for child maintenance payments against her despite him not having the child. she herself does not have the child the child was placed with her father (granddad) about 4 years ago but this s not the first time he has done something like this when the child was first placed the granddad he claimed child tax credit despite the child living with him the granddad has a residence order for the child but the ex keeps making these applications for child maintenance . after speaking to the CSA yesterday they said as the letter was addressed to the mother she is the one that has to send in all the relevant documents to show the child does not live with her and is with the grandfather which they can do that's not the problem. but the ex still chooses to keep on doing this the csa said they will investigate it again once all the documentation has been sent i but she will have to start paying him CSA as from next month even though the child doe snot live with him is there anything they can do legally to either stop him doing this or get him prosecuted ? any help would be gratefully appreciated thanks guys
  2. do you get contribution based ESA? or income-related ESA ? in-come Related ESA will be reduced by £1 per week for every £250 (or part £250) you have over £6000 you might be best informing the DWP of this and about the debt your going to be paying back to your dad in case it causes any problems for you in the future
  3. you can always ask for another job advisor if you feel she is being to pushy or there is a breakdown is communication or if you feel you cannot work fully due to your illnesses then you can always put in a change of circumstances if you feel your illnesses have gotten worse and you think you now meet the descriptors for the support group
  4. did your claim stop due to being sanctioned or did you stop the claim for ESA yourself?

  6. glad you got it sorted then do call them blips in the system but one do wonder but then again it is the DWP
  7. a few questions foir you do you currently have a CPN (clinical psychiatric nurse) or a support worker? have you got a copy of your diagnosis from your psychiatrist or psychologist ? ( you can call them up and usually get copies of the letters for free from them ) have you been in touch with mind or rethink the mental health charities? they have a good advocacy department and might be bale to help you and come with you on the day they do get very busy but its worth a try to see if they can help you if you have a family member or friend who has seen how your illnesses effect you then they can send in supporting letters explaining what you go though on a daily basis and how theses illness effect you
  8. have you appealed against the decision you got from them regarding this? most councils have an appeals process. This is a request for a review of any decision/s taken by your locality office about: your eligibility for funded social care your assessment your funding allocation your support plan

You need special help either because you are old, mentally disabled, physically disabled or other special reason.

  11. im not too sure if SEE do an energy trust grants most of the other big 6 do it might be best to phone them up and see if they do this as the grant may be able clear the debt for you they can stop you switching to other provider due to the amount owed however if its under £500 some of the big 6 do let you switch but it has to be under £500 that you owe My questions are: 1) How to negotiate with SSE and arrange repayment plan? At this point they're asking for £250/month. Too much! they usually stick there heels in at this point these big energy company's what they will do is give you an amount of what they feel you should pay and they are not very negotiable on that 2) Is there any 'safe period' by law that they cannot perform disconnection of electricity services? If you are not happy with the result, you can contact the Ombudsman Services: Energy. if all else fails a date when they have been to court to gain access to your property to fit a pre payment meter an engineer will come with a lock smith if needed so its better to be in on the day when they say they are coming its easier to be in so they dont have to force entry to your property. once they have installed the pre patent meter they will set an amount each week or day to recover the money owed if the amount is too big and you cant afford it they usually adjust it to what you can afford but unless you can pay a large amount off up front for the debt currently owed the will continue to install the pre payment meeter 3) Only he (the other tenant) has a contract with SSE. They will block him if he tries to change providers. How does the situation look for me? Can I change providers or get a contract with new provider? im not too sure about this one to be honest they might ask you for prof of when you moved into the property etc ect but i would not advise changing the name on the supply to yours just to avoid the debt
  12. the assessments are taking longer than usual due to the backlogs . you could always contact your local MP and ask him/her to write to them on your behalf have you applied for discretionary housing payment? it might be best to call you local council and see if you entitled to any help . the leaking roof and the access to water you have mentioned is this in a council property?
  13. when is your esa up for renewal? i know the support group can be awarded for Support group descriptors 8. Absence or loss of control whilst conscious leading to extensive evacuation of the bowel and/or bladder, other than enuresis (bed-wetting), despite the wearing or use of any aids or adaptations which are normally, or could reasonably be, worn or used. At least once a week experiences (i) loss of control leading to extensive evacuation of the bowel and/or voiding of the bladder; or (ii) substantial leakage of the contents of a collecting device; sufficient to require cleaning and a change in clothing.

  15. congrats on winning your tribunal glad it all went ok the recommendation the tribunal gives you is not set in stone im afraid the DWP usually ignore the recommendations they get from the tribunals service i know People whoa have been sent another ESA50 with 3 months after winning there tribunal it all depends on when the DWP decide to really
  16. you will be sent an ESA50 questionnaire to fill usually about 4 weeks before his renewal date once you send this off it will go to ATOS he maybe be called to attend a medical it has been known that you can be placed in either the WRAG or the SG without a medical but there is always a chance he will be called for one make sure you put as much information on the form and also send in any medical evidence you have to support his reassessment. if he goes for a medical and they score him 0 points again then you will have to and ask for a mandatory reconsideration of the decision i think there is now no time limit of how long this can take though at the moment im sure someone will come along and confirm this for you. if the decision is still a no then you can appeal to the tribunals service as you have done before
  17. you usually have to wait a minimum of 6 weeks to get back pay for money owed to you from the job-centre i know people who have waited 3 months for there's though id call them up in the morning to make sure you will be getting your esa now instead of jsa
  18. it might be taking longer than usual due to the Christmas holidays as such id call them today and see where they are up too and if you can apply for some extra financial help until they start paying you

  23. we can understand that your worried about this and as you have said councils dont work weekends. it can be for a number of different reasons as advised in your thread the only thing you can do is wait until Monday to phone them up and ask them to explain why they need this info it might just be a compliance check but until you phone them you will not know and we cannot tell you as we dont know ourselves we can only give you advice on the information you have provided us with as someone else has said it might only be a random compliance check it seems to be a standard letter they have sent you i know its going to be worrying but the best thing will be to phone them Monday morning and see why they have sent it to you then we can advice you further or give you more help if you need it
