  1. Yes agreed. But all of my 3 previous phone numbers were ex-directory - each OC passed on my telephone details until I got savvy and after the last change I have only communicated in writing. The point is that if you do use yac the DCA's can no longer continually harass you using a phone number that you dont want to change just because of them (thread title states this) - if your phone is not already a witheld number just dial 141 (to hide your number) when you get through to the DCA you give the yac number and tell them its your new contact number. It goes straight onto the computer. And as you have notified them that you have changed your phone number to a legitimate number the call will be logged and therefore you have 'assisted' them with your account. Personally, I would have liked to have used the service just for the pure satisfaction that some brainless twit from a DCA would keep calling this number, always getting a voicemail message and paying 42.533ppm excludingVAT for the privelege, especially when a request has been made to put all communication in writing that has been ignored by the DCA.
  2. steve1111 I think you'll find that hillards complaint is about unwanted phone calls from companies that have hillards phone number when hillards clearly wasnt aware that the ex-directory number was known to the company. I consider that a form of tele-marketing (personal choice). Point is, if hillards wants to use such a service then Im sure they would approach such companies on their own reconnaissance.

Ive mentioned this service on a couple of posts, but I thought Id post it here in the hope it will help people who are experiencing distressing phone calls (from anyone) at all times of the day and night. www.yac.com offer a free telephone service whereby when you sign up you will be given 070 number which is an all-encompassing number, therefore allowing you to screen the calls you receive - but if you only give the number to the DCA's they will constantly be phoning a number where they will receive no reply. All you have to do is not check the answering service - so no distressing phone calls from DCA's. Yac's site states: 'Instead of having to give your contacts your home number, mobile number, work number, and fax number, you can give them just one number, your Yac Number! Please note that 070 personal numbering services are not guaranteed to be accessible when called from outside the UK – therefore are only suitable if your callers are based in the UK' It is available to private individuals and businesses - I was advised of the service a bit late after changing my phone number 3 times. However, I'd never notified any of the DCA's or OC that I changed my phone number, so I cant enjoy the effects of Yac on DCA's. However, I find it a useful service for a variety of things. You dont even need a phone to use the service! It has provisions for email also. The absolute beauty of it is that the caller has to pay 42.533ppm excluding VAT; what a sting in the tail - I suspect thats what funds the free service. If you're interested check out the website and look at the bottom right hand corner of the home page where it has the link for the personal service www.yac.com They've got a call queing service but that incurs a charge. I would have really liked that service giving the yac number to all the DCA's so if more than one called the number at the same time, they'd be told they were in a que, hear piped in que music and when they reach the top of the que they'd get an answerphone - thats on a 30 day free trial atm - such a shame I didnt have knowledge of this sooner On their testimonial page, I have noticed that one testimonial is a technical officer at BT. I highly recommend the service . Oh I forgot to mention so Im adding this in edit - as well as screening calls, you can bar phone numbers so that they go straight to voicemail. You can also analyise the calls you've received so you can see how many times a DCA called and which number the call was from. Please note, there may be a charge for email to fax, name call screening and the call history report, but I havent needed these services so I dont know about that one.   8. Oooh! I dont know - but I got it from a very reliable source telling me to use it for my purposes and there's no mention of the cca 2006. only cca 1974 and cca (agreements) 1983. He does make reference to a case that was upheld at appeal and by the House of Lords, Wilson v First Counties Trust, 2001. He does say its not a parallel case but he gives reasons why. I've just noticed after going back to read the judgement following the above comments that it is a draft - it says on it: 'the draft itself nor its substance may be disclosed to any other person or used in the public domain' - but Ive been told I can use it and surely as this has now been approved in its final form which can be obtained from the court offices I can post the draft? Advice please? Dont want to break the law or anything
  9. The link you provided for the SAR document is really interesting. I dont have to include the fee initially, they can charge up to £10 and if they choose to charge then they have to request it in writing. Once they recieve the fee they then start gathering information. But, this is what I found interesting - the initial request for the SAR with or without the fee is the date that the timescale to comply begins! There are so many choices on how to proceed! CanI do all of them??? request CA first, then use CPR followed by SAR?? Oh please say I can ...

  11. Thank you for the link. I have several accounts that appear to come under the shop direct group but are being dealt with separately. Although, I have received a letter from AK today saying that they requested documentation regarding one of the accounts and that the OC cannot supply any information so they stop all further collections. I think it may well be beneficial to SAR Shop Direct for all the accounts.
  12. Im sorry, but whats an f&f? Scuse my ignorance. I am with Sky talk and I can block 10 numbers that I dont want bothering me. I dont know if any other telecommunications companies have a similar service - I suspect they do. Or you could get a free telephone account www.yac.com You are then given a 0709 phone number. If you give that one out & they start calling YAC allows you to screen the caller & let all their calls go to an external answering machine.
  13. Should I just SAR everyone so that I have all the information I need when I want to challenge things? Im writing so many ca request letters and getting the runaround that Im fed up. What are the rules surrounding SAR? Sorry if this has been posted before - if so can someone direct me to the thread. Many thanks.
  14. Derek R. Halbert, Designated Civil Judge at Chester County Court, quashed a possession order on 8th April 2009. In paragraph 12 he cites section 65(1) and 127(3). He sums up in paragraph 23 'I have already held that this agreement mis-states the cost of credit by failing to include the interest on the £875. Therefore the breach is established. The question remains should the court make an enforcement order? In my view it should not. This agreement is an attempt to circumvent the provisions of s 9(4) and it should not be encouraged. Appeal allowed'. I do have a copy of the whole appeal but Im not sure what the rules are in posting up such documents. However, if it has already been posted on the forum then I apologise. If not, I hope it is of some help. I have just quoted it in my most recent letter.
  15. I've got this dispute going with Cap1 now that CapQ closed their files. The FOS are investigating Cap1 regarding the MASTERCARD that was activated by someone else, but things have just taken a complicated turn (or at least its complicated for me ). I requested a CA from capquest for a cap1 VISA card. However, what they have sent me is a constructed document that they say is the CA for the VISA card. As far as I can tell after viewing many cap1 documents on this forum, the 'CA' is a very deliberately constructed composition of at least 5 different documents. My signature has obviously been tampered with, as well as several other things and the dates on the 'form' do not correspond to the VISA card account opening date. Additionally, there is an account number in a name and address box that belongs to the MASTERCARD account that I have asked the FOS to investigate. So as the FOS are investigating the complaint about the MASTERCARD being activated by someone else, should I send them the document I have received from capquest, explaining that it was received after requesting a CA for a cap1 VISA account and NOT the MASTERCARD account despite the fact that the MASTERCARD account number appears on there? Should I also ask them to investigate this as a fraudulent document considering it is made up of several documents, a tampered with signature and pruporting to represent a CA for the VISA card, when in fact its the MASTERCARD account number quoted on it? Its really complicated because my solicitor is dealing with the VISA issue and I know the FOS wont continue to investigate any complaints if they are being dealt with another person at the same time. But surely this document can be investigated as part of my original complaint re the MASTERCARD? Should I be reporting both cases to any other authorities? Does any of that make sense? I know some of this info has crossed over from my other thread but the details are relevent to both situations. I want my day in court!!!! Oh my head hurts!! :-|

  18. What are the tiny numbers at the bottom of the page? I found an old 'pre-approval' letter for a second card. There is a part torn off at the bottom but according to the letter this was just a 'short application form'. It has tiny numbers before the tear off mark, but the numbers dont match those of what they claim is the Credit Agreement. Are'nt they supposed to match? There really is something very wrong with the signature and little dots around certain areas of the document suggest to me that these are 'join lines' from other documents or places that have been covered up to give a false impression of what the document looks like. Has anyone got an application form that they might have kept or copied from Capital one or a copy of the actual cca going back to 2002? All Ive got is 'Congratulations you've been approved for a Cap1 MC' but the letter is undated - and ive noticed that apart from the statements, no other letters including the ones with replacement cards on are dated. Surely theres something wrong with that? I have replied to their latest letter using the advice Ive been given here as well as my solicitors advice. So if anyone has a copy going back to 2002, i would be extremely grateful if I could have a quick peek.
  19. If you take the train from the east, you can see the Cap1 offices (yes, thats offices) as the train pulls into the station. Soooooo many times I have been tempted to go in. Nottingham is a rough city now. It wasnt before. Its a shame cos the castle, underground caves and old lace making quarter are really interesting. Really sorry to hear about your OH's poor health.   20. Debt is probably a couple years old - not sure as I dont have anything to say when the account was supposed to have been opened. I may wait a bit longer to see if Im contacted again, that way Ive got some breathing space to sort other stuff out. What really puzzles me though is why moorcroft wont tell me why they are no longer dealing with the account or who its been passed onto? Can I make them tell me? Thought there may be something that covers that - Data protection Act maybe? Btw thanx cas93 for your responses
