  1. make no mistake the claims firms will have big hitting QCs to argue the debtors case. some of them have already invested millions in creating a whole new industry on the advice of the very best QCs in the country and they will not go down without a fight.
  2. There is a letter from the Chester County Court which appeared somewhere else on this forum which I have as a pdf but don't know how to bring it up here. It refers to the test cases and putting a stay on other cases but there are some confusing things. 1.It is not addressed to anyone 2.There is no date on it. 3.It says that all parties involved in CCA cases already in progress through that court will be informed and invited to make representations about the proposal-I have been taken to court by MBNA in the Chester County Court and submitted a defence and the pre trial process is conti

  5. Guys this does not apply just to claims being dealt with by Ultimate Law my solicitor friend tells me it applies to every case of unenforceability being dealt with by Chester County Court

I have been in touch with a solicitor I know who deals with such cases and he tells me his company is seeking clarification from the Chester High Court on the grounds that there has already been good case law such as Hurstanger and Wilson regarding the vast majority of cases which deal with the prescribed terms which has been tested in the House of Lords.His company will therefore be arguing that there is no reason or justification for these cases to be stayed in that it will not be in the public interest for that to be the case.   12. Please forgive my ignorance but if they can do it in Cheshire how long before the cases are stayed everywhere else? I understand that if the APR and or interest rates within a CCA are not calculated and displayed correctly then even if everything else about the CCA is correct this alone can be argued to be a breach of the prescribed terms and means that the agreement is not properly executed and therefore can not be enforced. Is there some information about this somewhere in the forums as if it is true it may be possible to deal with agreements using this method which would otherwise be enforceable.

Can you direct me to he right thread to discuss this unenforceabilty issue please.I have been approached by someone who has shown me a report confirming that the apr and interest in his CCA has not been calculated correctly which renders his agreement improperly executed and I would like to know where to find information on how to do this
