  1. How would I set this aside. Do you think I should speak to the claimant and ask them to withdraw if I agree to a payment plan?
  2. Sorry. Notice of issue of warrant I have ordered to make a payment to the court on Monday. There's no option to dispute this. The original default judgement included a instalment option. I have my my mother in laws death certificate of this helps
  3. Hi My mother in law passed away recently during this time I got a claim form for a credit card. I had too much going on and still do and couldnt respond to claim form. Default judgement Claimant then asking for £50 to pay instalments each month on £600 debt by 19th of last month, couldn't pay, didn't even think about this. Court have now ordered I pay full balance by Monday 06/11/2017 or will pass to bailiffs I can't afford this and can't bare the thought of escalating debt collector charges too. I am not sure what to do Can't even bring myself to speak to the claimant, never have done. The debt was with vanquish credit card on high rates with quite a few £12 late payment charges. They have the last 2 letters of surname the wrong way round same on the actual account itself. Not sure if this is in any way relevant.

    Interest rate swap

    Hi We are in the process of accepting the banks offer on a part settlement basis. And will be writing to them asking for compound interest to be paid. I have been reading the Sempra case and I think we may have a case for restitution. We were paying roughly £1100 a month towards this policy since 2009. The contractual rate is 5.2%. At the same time i had a bank overdraft and a credit card from this bank, would I be able to use rates charged to me on those accounts as the bank were unjustly enriched by those rates or would I need to use the contractual rate. Also does this seem right amount reclaimed + compound interest + s69? Any ideas on this anyone?
  6. Hi I want to report a recent success in regards to the mis selling off a interest rate swap. We (me and my sister) took the a mortgage out in 2007 which had a swap attached to it. As of last week the bank have decided to provide redress as the swap should not have been sold to us. We have not accepted the offer as yet as I have a couple of quries. They have agreed to terminate the swap without any fees and will repay all payments which have gone towards the swap and have added 8% simple interest. Would we be able to claim compound interest? Also we have suffered consequential losses, Ive taken out loans incurred various bank charges and my sister has gone bankrupt. Are there any cases studies or threads I can follow in regards to reclaiming consequential losses? Thanks Mrs_p
  7. Hi We were old a interest rate swap in 2007 and still paying this today. Everything was arranged by our business manager who had previously arranged other borrowing (no previous swaps). We are a small restaurant and bought our property which we were previously renting. We have complained to the bank only are now going to review accounts as per FSA announcement but cannot provide timescales. We are looking to start court proceedings we are sure of our case(mainly due to our history with our banking manager) and want to go it alone. I know we have to send in a LBA and then issue court papers but wouldn't know where to start with the particulars of claim. Any help would be appreciated Thanks Mrs_p

  9. Hi I can't seem to find any threads on this. Is anyone in the process of litigation with their bank in regards the above. I am fed up of waiting for the bank to come to a conclusion on our complaint and feel the only way forward now is to start proceedings. Thanks Mrs_p
  10. I've asked to settle. I asked my solicitors how long before I expect payment. I was told we should allow 6 weeks before I get paid. Is this a reasonable time to wait for payment.
  11. Hi Just to update the other side have finally made 2 offers £1350 and then £2000 for personal injury, they have not put an offer in for wages. I asked my solicitors to reject both offers as I feel it is on the low side. They said I was given a 10 month prognosis and according to JSB guidelines the offer they put forward is about right. I know not all cases are the same same but £2000 for 10months prognosis is this about right?
  12. I think this is what has happened but they don't seem to admit it. Ok now that they have re submitted the report along with a part 36 offer what options do I have if the other side do not respond within 21 days? Thanks
  13. Liability is not an issue as 3rd party have paid out for vehicle damage. I understand now that medical report could have been sent via different means so that's fine. I get the feeling my solicitor is not being 100% truthful. Will a Subject access request work if I send this to 3rd party insurers?
