  1. Hi everyone, sorry I haven't been in touch but we have been waiting for developments. Below is a link to the cca Optima sent me. Please check it out as I think we have had it! I just can't see what I can argue. http://i778.photobucket.com/albums/yy68/paulbaxter009/img028.jpg Furthermore, Optima sent me a letter today saying that they are requesting on their allocation questionnaire that my defence be struck out as we have no realistic chance of winning based on the defence I entered and that I have breached cpr 16.5 by acting as my wife's litigation friend. I really don't know what
  2. Thanks for the advice ss. Just to let you know I received the subject access request paperwork back from mbna today, sent by recorded delivery. It has a copy of my wife's application form for the credit card which I assume they are using as the true copy of the original agreement. Can someone advise on what to look for as there is so much paperwork it's difficult to know where to start. I do remeber reading somewhwere on this site that an application form is not an agreement as required by the cca. Is this right? Regards, PB
  3. Hi everyone, not much news to report other than I still haven't had any paperwork back from either optima or mbna. I'm wondering what I can do now as the cca request and the subject access request are now in default due to them not replying within the time limits. Optima did send my wife this though. I wonder what the judge will make of it? have a look if you want a laugh. regards, PB http://i778.photobucket.com/albums/yy68/paulbaxter009/img025.jpg
  4. Many Thanks to Main Man for his help, my wife and I are extremely grateful for everyone's help and good wishes. I will post the defence via the internet and keep you all informed of my progress. Once again, Thank You. Best Regards, PB

  7. Thanks PF, I read your thread last night but must say I am still confused as to what to plead as a defence as I don't know whether mbna have a copy of the original agreement. Could someone please help as I don't have much time left. I do remember reading somewhere of a defence in law against turning an unsecured debt into a secured one at the expense of other creditors. Could this be useful? Regards, PB
  8. Hi everyone, sorry I haven't logged in recently but I have been rather poorly. Anyway, I have to file a defence by Monday but am still waiting for replies from MBNA and Optima regarding the requests I sent out. The CPR request gives them 40 days to reply, so I need to ask the court for more time. Any ideas how I go about this?
  9. Thanks for all the advice guys. I have scanned the letter and added it to my album on photobucket. It is image 16. Will go online again tonight to advise of any progress in the case. Regards, PB
  10. Hi everyone, received a letter today from mbna sending back my original letter and postal order requesting my wife provide proof of identification before they will send out any info as asked for in the subject access letter I sent. They want proof of signature! e.g. copy of driving licence, passport etc.
  11. Hi everyone, I filed the acknowledgement of service today online but realised I left out some information. Should I send the form as well or call the court to try to rectify the mistake?
  12. Thanks for all the advice guys. When would it be appropriate to submit a cpr 31.14 request? Regards PB
