  3. have you actually done this as i feel this would be wrong as all i want is the £1380.00 they have taken from me. if i do this it will make me just as bad as they are!!
  4. Thanks for the advice I think I will wait the 14 days and file money claim and claim the lot at once as might confuse me getting £180 now and the rest through the court claim. Has anyone accepted the first offer and claimed the rest through money claim?

Today I received a letter from the halifax stating as below Thank you for your recent letter, I am sorry to learn that you are unhappy with the charges you have incurred on your account. I am sure you will appreciate that like other organisations we incur costs for every transaction made. When we pay an item against an unauthorised overdraft or return an item unpaid, we incur extra costs regardless of the shortfall involved. We beleive it is fair to pass these costs on to the accounts affected, rather than absorb them into other areas of our operations, penalising all our customers as a result. We clearly outline our charging policy in the terms and conditions that apply to your account. In addition, we are committed to complying with the banking code, which sets standards of good banking practise for banks and building societies to follow when dealing with personal customers. the terms and conditions of your account state that you must have funds in your account to cover your transactions. We cannot be responsible if you have authorsied payments against funds that were not available. We are keen to help you avoid any unnecessary charges by providing various ways to keep track of your account. You can do this via the telephone banking or online banking or mini statements. You can also contact one of our advisors at any branch. It is your responsibility to manage your account. However as a gesture of good will we are prepared to offer a refund of £180.00 of charges in full and final settlement of your complaint. I must stress that future valid charges will stand and we reserve the right to close your acount if you do not manage it correctly. If you are prepared to accept my offer please sign and return the enclosed acceptance form in the prepaid envelope. Question 1 do i still give them the rest of the 14 days I gave them in the LBA I sent last wednesday or do I now file a money claim over the net? Question 2 Do I have to tell them I do not accept their offer and will be proceeding with court claim? Question 3 Is it worth me ringing them and telling them NO!! please help as this has thrown me a bit

  7. Sent LBA this morning recorded delivery and given them another 14 days to pay up. I guess their next move will be a phone call offering me a percentage of my claim, I guess I will tell them no thanks and take it to court. Is there any set proceedure for when they call me on the phone? Or do I just tell them no thanks see you in court. Roberto
  8. Well not heard anything from Halifax since the letter so LBA going tomorrow and giving them another 14 days then will file moneyclaim. You would think they had learnt their lesson by now and just pay out as they are going to in the end. Roberto
  9. I get what you mean now Nona! I have sent the first request for settlement letter and need to send the letter before action on wednesday which is when their 14 days from the first letter runs out. I assume then I go to court after the second 14 days? thanks for the help as this is getting confusing! Roberto
  10. Hi Nona I have already sent the LBA letter before action and given them 14 days. Do I need to send the second LBA as technically they have replied within 14 days haven't they. Any advice would be gratefully received. thanks Roberto
  11. Well that wa quick. I have just received a letter from the halifax as follows thanks you for your letter which was received at this office on 31st July 2006. I am sorry to learn that you are unhappy with the charges applied to your account. We're keen to deal with your concerns as quickly as possible. A customer Relations Manager will investigate the points you have raised and you will receive a reply shortly, but certainly no later than 4 weeks. You will find a copy of our leaflet, which tells you how we will handle your complaint. Your concerns will be dealt with as quickly as possible, but to help us deal more efficiently with your enquiry, please quote XXXXXXXXX when writing or telephoning the number at the top of this letter. The letter is signed by someone called Joanne Carmichael and there is a leaflet with the letter. Do I now have to wait for 4 weeks before I move to the next step which is court I beleive. Their original 14 days runs out next Wednesday so if they haven't paid up by then I assume I move to court order then? Could use some advice!!!!!!!
  12. been 7 days sice sent letter requesting refund of charges, do you all think i should follow up with a phone call as not heard anything at all from them?
  13. I sent mine to the trinity road address. As for interest used the spredsheet template and make sure you send a list of charges you are claiming back I did mine like the spreadsheet template. hope this helps.

  15. yes they cashed the cheque 3 days after I'd rang. they were lying about not geting my letter as the cheque was in with it. they really are sneeky!!!!
  16. yes I paid them £15.00 all together as they told me at first they didn't receive my letter but they could send them out for a fee of £5.00. Should have just rang them and asked for the statements and paid their £5.00. Whats £15.00 when we are getting all our money back!!!!
  17. I have sent of the letter requesting repayment of charges and my fingers are firmly crossed. I will update as soon as I hear from them. thanks for everyones help so far. roberto
  18. I have received my statements from the halifax after they charged me a further £5.00 for the privledge. I am now in the process of claiming my money back. I've worked out that they owe me £1260.00 plus interest. I will let you all know if they pay up!!!!!
  19. well done!!!! I'm still awaiting a response from my data protection letter requesting statements. been 10 days now so will give it a bit longer. Hope your going to support the rest of us against halifax!!!! Roberto:-D
  20. Been 10 days now since sent Data request not heard anything yet I know you give them 40 days in the letter but on average how long does it normally take them to write back with the info. Should I wait until i write again? Roberto:???:
  21. Yes did send a letter as on the templates and enclosed a £10.00 cheque, just waiting the reply now. I will have a read through the FAQ's as I'm sure they very interesting.
  22. Good Luck! I've just sent my request letter today as well let me know how you get on and I'll do the same. They must be getting fed up of receiving these letters from robbed customers. Roberto:-)
  23. Hi Everyone. I have today requested a statement of bank charges on my account from the Halifax and have given them 40 days to provide the infomation as advised by the site. I am now waiting for the reply I estimate they owe me around the £2000 mark over the past 6 years. Does anyone have any advice as this is the first time I've done anything like this.
