  1. I was paying UK search up until a couple of years ago. ive just gone through the old SAR and there is no letter with a notice of default. Just basically the loan agreements, balance history and copies of my id etc when I applied for the loan
  2. Hi dx it has popped up on my credit file from nowhere, as coast. Reporting a statement as “late payment” in July 19, but states acc start date was 2006. Only on credit karma though, equifax and Experian have no record of it

I’m very sorry if I offended you, I only came on to ask a question about credit reporting, rather than get a character assassination. i can assure you I’m not running debts from all debts, I have made efforts to pay debts I feel are just and fare. I am trying to fight to cowboys and have debts written off/dismissed. Absolutely! Unfortunately I am still paying from mistakes when I was nothing more than a kid when these cowboy firms took advantage. I take full responsibility for my actions, but they also had a big part to play in the mess I got myself into. as a single dad of 2 disabled kids I don’t have much disposable income but do what I can to repay past mistakes, whilst also trying to repair years of damage on my credit file. After 17 years of being in a mess, these last 18 months or so have finally seen myself repair a lot of damage, and Stuff like this out of the blue is a crushing blow to that, as I’m back to square one. I am responsible for the situation I am in, but have certainly not ran away from all of my debts
  4. Hi DX - I know its far from the ideal, but I didn't want to give them my new adresss if I'm honest, to prevent being hounded. Last payment was a couple of years back, I was paying via standing order
  5. Hi guys, hoping somebody can help me out. i had an unsecured loan of £2500 with welcome finance back in 2006. I was obviously in difficulty at the time hence using welcome, and eventually defaulted. I then entered into an Iva which did not go the distance, and I entered into a payment plan with all my creditors. I’ll be totally honest I don’t know how much I paid back given the time that has passed, but I’m confident it surpassed the £2.5k. I’ve ran a credit report today, only to find an entry from coast finance solutions for £3.6k showing as late payment. I couldn’t find much about them on companies house, so was dubious about writing in blind and giving them my details (I’ve moved house in the last 13 years). I spoke to them on the phone, and they advised it is the welcome debt that was £2.5k in 2006. I’ve requested a notice of assignment, DSAR and CCA by e mail, but the the question is, can they suddenly start reporting my account as “late payment” after 13 years of nothing?? ive worked hard to repair my credit file, which I finally did last year, so this is a body blow. The guy on the phone also confirmed I’d paid £10k back already, and they still want another £3.6k. TIA

  7. Hi guys If a default date is 23rd October 2011 for example, would you expect to see gone from your credit file on 23rd October 17 or 24th October 17 ?? Been counting down the days to a clean credit file for a long time haha Cheers
  8. thanks for all the responses guys. We submitted a formal complaint to FC, and received acknowledgement, along with a timeframe of 6 months for it to be investiagted. 8 months on, we've heard nothing more, and despite daily attempts at contact for weeks on on end, there has been no reply to e mails, letters or phone calls. We have made numerous attempts via facebook chat which are all documentated, however they simply advise we need to speak to legal team, who we have been trying to contact in the first place. We advised the rep (verbally) of all our illnesses, but only the 2 kids were "officially recorded", and only 1 was medically examined and has a doctors report. We were weighing up either one of these sick holiday type claim firms, or doing a claim form ourselves.

  10. Yeah it was inclusive - last time i ever do a holiday like that. Not really thought of compensation to be honest, was just looking to get the cost of the holiday back, as it was complete write off. Would it be likely to be granted?
  11. Hi I'm considering raising a claim against First Choice, as they have not responded to my compensation claim. All 4 of us (2 disabled kids) were ill during a stay in one of their resorts, which essentially wiped out the holiday. Their legal team are uncontactable, and almost 8 months has passed without them responding to us. We raised a complaint with Abta, and they originally did not reply to them either. Abta referred it to their legal team, but FC responded advising they are not prepared to use the Abta mediation service, so Abta they have closed the close. We have never received any response to our claim. I've never raised a court claim personally before, so was was just after some general advice about potential pitfalls etc. I can see the issue fee would be about £70, but would there be further costs if the case were defended? My Mrs is concerned about us having a shedload of costs, should our claim fail, and mentioned a counterclaim, but unsure what this is?? This is the only option open to us however if we want to pursue it, as they are completely ignoring our claim.

  13. Cheers guys - everything gone in now from our side Still not had any witness statement from Lowell, and the hearing is 15 days away Am I right in thinking I can get the claim threw out, if nothing received by tomorrow??

  15. Hi guys Further to the above matters have now progressed, and I could do with a bit of advice. A hearing date has been set, and we have been asked to exchange witness statements As things stand, Lowell have still not provided a credit agreement or a response to the cpr request. I was just wondering if it was madatory for my mum to attend the hearing as the defendant. She does have a tendancy to get confused, with matters such as this, which is why I've dealt with this on her behalf, and will be attending myself. The worry would be that if she is in attendance the judge may address her direct, despite my presence as her "litigation friend"

  17. Hi guys - this claim just got a bit more interesting. Defence was submitted as above and MCOL confirms this received on 16/05. This is the last update on the system. My mum has today received a completed directions questionnaire in the post from lowell, along with a covering letter, stating they have "lodged this at the court". With us not receiving anything from the court, or MCOL not being updated, I have just called the court, who confimed that DQ's have not even been issued yet. Under seperate cover, my mum got another letter from Lowell dated 08/06, thanking us for our letter dated 22/04 and advising they are requesting a copy of the credit agreement from JD Williams. I would be grateful for anyybody's advice / thoughts on the situation with the DQ?? Cheers

Have drafted the below defence, and would be grateful if you could give it the once over before I submit it: Particulars of Claim 1.The claimant claims payment of the overdue balance due from the Defendant(s) under a contract between the defendant(s) and JD Williams. 2. And assigned to the claimant on 31/03/2014 in the sum of £1300 Defence The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 1. Paragraph 1 is denied with regards to the Defendant owing any monies to the Claimant. The claimant has failed to provide any evidence of agreement/contract/breach as requested by CPR 31.14 and a Section 78 request. Therefore the Claimant is put to strict proof to: (a) show how the Defendant has entered into an agreement/contract with the Claimant; and (b) show how the Defendant has reached the amount claimed for; and © show how the Claimant has the legal right, either under statute or equity to issue a claim. 3. As per Civil Procedureicon Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 4. On the alternative, if the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer crediticon Act 1974. 5. On the 19th April 2016 I made a legal request by way of a section 78 request to the Claimant. The Claimant has failed to comply and therefore is in default of this request and as such unable to request any relief until compliance. 6. By reason of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief. Cheers

  21. There's no jd williams entry on my mums credit file, only a Lowell one which states an opening date of October 2010
  22. No unfortunately, jdw said they only hold 3 months of records so to contact Lowell. Called them and they said it has been passed to their legal dept so they could not access the information either. Not been able to get hold of the legal dept after numerous attempts, so left it to the cpr request. Do you think we should continue to attempt contact with Lowell solicitors for the info or leave it to the cpr?? Cheers
  23. Cheers DX The CCA request expires tomorrow, and the defence needs to be lodged by 13th, so I'll see if she gets anything in post over next couple of days before I file defence fo her
