  1. I followed the correct procedure to cancel and today around 6 weeks after I placed my order for the free trial they charged my card £37.50 and £75.00! So I am in the process of phoning them but will report to my bank as fraud. Received two emails from them today confirming cancellation. I returned items on 1st august and have a receipt to prove it! Seems it doesn't matter if you follow the correct cancellation procedure!
  2. 'An installment decree was granted on 22nd March 2004 for the amount £1449.47 and expenses of £189.47, with time to pay of £20 per month was granted.' I have been paying this amount and have now paid £1464 in total so far. However, there is stil £813 outstanding on my account. The extra money being interest added to date and also costs involved in tracing my address and employment (i moved a couple of times since the decree was granted) Do I legally have to pay this extra amount or only the amount stated by the court? It was originally a black horse loan, taken over by Hillesden Securities Ltd and Nolan Solicitors are dealing with it on their behalf!

The information I got from dundee sherrif court was: The information that i have is the case was pursued by Black Horse Ltd., Formerly Chartered Trust PLC their solicitor is NOLANS An installment decree was granted on 22nd March 2004 for the amount £1449.47 and expenses of £189.47, with time to pay of £20 per month was granted.

  5. I recently received an income/expenditure form from Nolan's as they are reviewing my payments and asking for proof of income. I emailed to say that my circumstances had not changed and I would continue paying the same amount. I also asked for a statement of my account. I got an email back saying I had to fill out the income/expenditure and provide proof of income. I then received a statement through the post. When I started making payments I was told the loan amount was £1499. When I checked the statement there has been lots of investigators fees added and also interest to date (26th apri 2011). At one point the amount had increased to £2000. I was told nothing about these fees and any interest being added I was told i was paying £1499. Can they do this?

  7. unfortunately I have made payments since 2004. Made a few payments back in 2008/2009 when they wrote to me about the debt. To be honest can't remember if they informed me at that time of the decree. I sent them a formal request back then asking for a copy of my credit agreement. They refused and I stopped paying them. This is them getting back in touch after a year. I didn't apply for time to pay, knew nothing about the decree being granted as any paperwork must have been sent to an old address.

I am now told that this decree will be enforced on monday 28th if I do not arrange a payment plan. I have asked the reason they can't provide me with a copy agreement,awaiting a reply. I now feel i have no option but to agree to the £20 per month repayments. Am I doing the right thing?
  9. finally managed to get some info from Nolan's about the decree. They have told me where and when it was granted. However, they have said the following 'as Decree has been granted in this matter our clients will not now be providing a copy agreement'. Where do I go from here?
  10. have done all of the above. No info at any court and they are refusing to give me any cca or decree info.
  11. I have today received a letter from Nolan's solicitor's regarding an unpaid debt owed to Black Horse. In the letter it says; 'as you know,we have obtained a court decree regarding payment of the above debt'. I am completely clueless about this, I have moved address quite a lot over the years, this debt dates back at least 7 years. I have received no notification of a court decree and there is no record of it on any of my credit files. They have given me a form to fill out regarding what repayments I can make. Can someone advise on the steps i have to take to get more info about this.
  12. great thanks.asked them a couple of times now about the decree and agreement and they aren't getting back to me!! I'll leave it a couple of weeks before I make my next move.
  13. thanks did a search on this site and there's nothing regitered for me. Asked them to explain clearly about why they are unable to provide me with a copy and heard nothing back. Have also contacted FSA for advice.
  14. They have my address now. Received a letter in November last year at my most recent address so they finally managed to track me down.
  15. There is nothing on my credit file about it. I just don't understand what the decree means and why I can't have a copy of the original credit agreement. I do not want to dispute the debt, I wanted to see what the original amount was and if PPI was added to it etc as the debt was so long ago.
  16. I am not sure, I moved around a lot and they did not have an up to date address for me so I am unsure what was sent where.
  17. I received a letter from Nolans Solicitors a while back regarding an old blackhorse debt. I set up a payment plan which was going fine but then I had to change the amount so requested a standing order form and also requested a CCA. I received the standing order by email ut couldn't open it so sent a request for it by post. I heard nothing until i got a letter saying I was in arrears. I contacted them and explained they had not posted my standing order form and also asked about my CCA request. I then received a response saying: We write to advise that as stated in our letter to you of 3 April 2009 as a Decree was granted in this matter on 22 March 2004 our clients will not be providing a copy agreement. Should you wish to dispute you liability in this matter at this stage we would advise you to seek legal advice. I have received no letter on 3rd april and don't know what any of this means regarding a decree, can someone help?
