  1. Hi M-D. Sent my stuff off a couple of weeks ago, stating that they had better put up or shut up, and quoting the Regulation 9 to them in full. I also followed that up with a SAR for all my accounts. Am waiting for a response on both counts, but will give them some extra time to come up with the information. I had a response from MBNA regarding the CCA request asking for an extra 4-6 weeks, but NatWest just threw BS at me. Typical. After having me as a loyal customer for 30-odd years, they behave like shysters.

  2. I have a situation where my 9 year old was at a friends house. He went on his friends sisters bike in a residential area. He crashed into a car, which I thought was parked. But it transpires that the car was actually moving. The guy driving the car parked up on the pavement called the police then proceeded to walk his dog home. I am absolutely furious as apparently the wife was extremely abusive to my son, who I might add was in a state of shock, the police arrived before I did, (fortunately my sons friends mother was there) but they interviewed my son without one of his parents being there. By the time I arrived, which was only approximately 5-7 minutes after police arrived I was informed that my son had hit the car and caused damage, they only took witness statements from the driver & his wife, didn't take any statements from the other 4 children who had all witnessed the accident.

     

    Police had spoken to me as if my son was completely in the wrong and I took there word for it (what an idiot!!), after speaking with the boys I don't believe my son is totally to blame.

     

    I have received a letter from this couples insurance company claiming £1,000:shock:. I have informed the insurance company that IMHO my son's isn't totally liable - they are suggesting I make an offer - can you or anyone else advise me please - cos as things stand I don't really have a bean to offer them. And should I be offering them anything in the first place??

     

    Oh sorry one other point, the police officer informed me that the couple were probably looking for their excess amount of £400, so why are the insurance company trying to get £1k out of me.:evil:

     

    What I need to know is would they be able to take me to court for this, as I don't want it to go that far, and if it did would I be in a position to defend and win this, considering that there were no other 'adults' other than the driver and his wife. And the police took it that my son was at fault, my son was so shocked by the whole incident and the wifes agressive behaviour to him, he would have pleaed guilty to anything.

     

    If there is anyone with any legal or insurance knowledge of this I'd be grateful for adivse or what I should do, as the insurance company are awaiting a response from me.

  3. From what I hear, a single default won't have much effect anyway - there can be all kind of reasons for a default. I wouldn't know from experience though, I ended up with a few. It's a good job I don't ever want any credit ever again, I suppose.

     

    I have 1 default on my cra and I couldn't open a bank account had to get a cashminder account, so 1 default does have an effect.

  4. a certain financial institution used info gleaned from here a couple of years back in a couple of court cases,mine included,and defeated the cases brought against them on the charges issue

     

    they were able to directly identify individuals from threads and comments that had been posted were referred to

     

    I'm saying no more-although I could!!

  5. TBH the more I think about this - I don't actually see how a DCA or anyone else could use the posts to our disadvantage. This forum is not about debt avoidance it's about letting people know their legal rights, something that the DCA's/OC's and solicitor's try to misinform us about.

     

    Surely if a case went to court I would have thought that any self respecting DJ would laugh at any eveidence that was given from these forums, in fact surely it would be hightlighting their (DCA/OC/Sols) unscrupulous tactics therefore giving them enough rope to hang themselves.

  6. I don't think it would work as has already been mentioned there is nothing stopping a dca/oc/solicitor registering.

     

    This forum is open for a good reason, I for one did not register straight away, but found the information invaluable in the threads. If it had of been a site that required registration before viewing, i'm afraid I probably would still be hiding behind the sofa quivering.:eek:

     

    Even if you allow restrictions to threads I think the site team would be overloaded with these requests, and how would they manage to stop any unwanted guest from registering.

    I am no expert with HP agreements (or any other agreement come to that) but what I do know is if you try and hand the car back they will most certainly auction your car of for peanuts and then expect you to pay the short fall.

     

    My OH handed back his car and he is now lumbered with a bill for over £20k, the car was originally priced at around £26k. So what every you do no not just hand back without advise first.

     

    Looking at the figures you have posted there does seem to be amounts added, and what is the final figure 'optional rental'?

     

    It may be worth scanning your agreement and removing identifing info, so that others can see the agreement and maybe able to assist you further.

    I agree just leave it be, see what they start throwing at OH and hopefully they'll hang themselves, doubt that they would need any assistance from us:p

Thanks for responding r&b I was thinking along the same lines, but I'm a little concerned as the police officer had informed me that they were looking for the excess to be recouped and I may receive a small claims - obviously I don't feel that my son is completely responsible and we all insure our cars which should cover accidents like this. Can't recall the number of times my husbands car has been damaged, but insurance has paid out and we've had to pay the excess.

  10. Thanks guys for your response. TBH when I saw the letter I did think they were talking out of their rear end.

     

    One thing that does concern me is when or if this goes to court will a judge not say why didn't you respond to the letter in order to try and resolve the issues, is OH not obliged to respond??

  12. Update - Complaint letter was sent to Helifax and a response has been received. I have a few questions and would be grateful for advise.

     

    They mention they have noted the comment revolking license under english common law not to visit OH, but state this complaint is declined as this law doesn't apply to recovery of debt?? Can someone please confirm if this is the case or not.

     

    They also state that as it's a "Joint Account" they are entitled to contact either party. This isn't a joint account, there is a mere application form with OH details and signature, I was added later as additional card holder, don't remember signing any agreement, awaiting SAR to see if it throws up anything, but my understanding is that OH is totaly responsible for the debt, and therefore they are not entitled to contact me, am I right in thinking this or can they chase me for the debt??

     

    They are of the impression that OH has a payment agreement in place with Bloody Orrible & Snotty, but he has never agreed anything with them, he was paying Helifax £1 pm token payment, but this has now been stopped due to the fact that OH rec'd letter from Helifax stating that agreement had ended therefore rescindering the agreement.

     

    And finally, in the complaint letter from OH it was mentioned that the agreement has been rescindered and they responded by stating they have checked the file and they can't find any record/confirmation that the debt has been rescinded, they want OH to send a copy of the letter which states this?

     

    They say they're keen to resolve OHs concerns and if they don't hear from OH within 8 weeks, they assume he is satisfied. Obviously he's not satisfied and neither am I as they are trying to make this a joint account - they been sending text messages to both of us, which they say is reasonable, but considering OH health issues its not.

     

    Can all you knowledgable caggers please comment on this, as I hope this letter is really just trying to get OH to panic and pay, or is there any truth in what they are stating.

    I sent the letter which clemma kindly provided for SAR. I've rec'd 2 packages one from Triton one from Natwest, but they have only provided statements for the past 6 yrs, a couple of reqs by phone and a few cons details with triton (not all I might add).

     

    Am I entitled to receive everything from them, my account goes back as far as 1981 but they've only sent 6 years. What letter should I be sending them to get all info from them - as far as I can tell they haven't complied with my request.

    Sorry haven't responded sooner have been on hols:)

     

    They have issued a defective DN and confirmed termination, so therefore are only entitled to the arears:p.

     

    Have sent a letter to Halifax and OH has had a response. I'll update my thread prop 2morrow, but it's amazing to see what c**p they write.
