  1. Apologies if I've confused the matter. OH had a Marbles card, for some years. One day MBNA card drops on the mat. MBNA had taken over the Marbles account, but OH was not informed in writing, this happened at the begining of our debt troubles. Just thought it might help us in some way, or maybe this is totally irrelevant?? Can one bank sell an account to the other without the account holder knowing or agreeing to??
  2. Hi Never-in-doubt, Thank you, yes I have. Was hoping that someone could give answer to my Post #5 on this thread, didn't want to butt in on someone elses thread. Can you or someone help me with that. Something that I haven't mentioned is that it appear that the original OC was marbles. OH received CC from MBNA which he never asked for and never used. but then received a statement which had outstanding balance and some spending which was from Marbles card. This was never challenged and just accepted this is what happened. OH never received a letter from OC stating that it had been transfered to MBNA and never received letter from MBNA saying they had taken over the account. Can they do this without informing account holder:eek: Thanks Joemay:)

  8. Hi Stardust John, My husband is in a similar situation. Is it Bank Account overdrafts or credit cards? The CAB had written to all our creditors explaining husbands situation, with copy letter for the docs. All agreed £1 token payments for now, but no correspondence from Bank Accounts. This was back in early October. Numerous letters were written, no-one could deal with the situation, tried calling every dept and their wives, but no joy, finally rec'd statement showing default, this was due to their charges and interest. Went to local branch, they couldn't help.... Finally rec'd letter from Triton - have agreed and paid a settlement figure. I am so angry how we were treated by the so called "HELPFUL Bank" (helpful my a**e), that I will be making a complaint and investigating if I can do anything about bank charges refund and having default removed. Sorry about the rant it just makes me so angry that the banks choose to ignore people when you try to be honest, you've explain your situation and asked for help. They can't get away with how they are treating you. There are lots of people on here who will be able to guide you. All the best, don't let any of them get to you. You need to take a deep breath and look after YOURSELF, you are NO.1, your health comes first and the bank is right down at the bottom of the list. If they do try and take you to court, I'm sure the court will not look kindly on a bank that ignores a letter from someone who has mental health issues, who has tried repeately to get help from the bank ito resolve things. We are always being told "don't bury your head in the sand", I think it's about time the bank was told the same thing. Its a disgrace. I'm still on my husbands case for other creditors so if I find out anything useful will let you know. Remember you come first!

  11. Do you think that maybe I should put thread for unregulated agreement on the legal threads as people are suggesting going to Law Centre. Law centre overloaded can't get appointment for quite some time?
  12. Thanks Elsa, don't to bad. Yes 2 children make me an early bird!! How r u? Have opened another thread as it appears that MBNA have passed over to Link to early. Default letter doesn't give clear 14 working days. Link letter states it was passed to them at least 5 days to early. Have opened a new link to find out what this all means for us, are they in breach and what are the indications for us. If you have any knowledge of these issues maybe you could you could have a look at the thread Have MBNA/Link Mucked Up??? Thanks Jane

Have copied this quote from a thread that is similar to my situation "The reason DN are so important is that its a requirement to end the credit agreement than a proper default notice is served prior to termination. If the default notice is invalid i.e. not enough time to rectify the fault then the termination becomes invalid, this reduces the right of the OC to just the money due at the time of the default notice, i.e. only the arrears become payable, they lose the right to the balance as they have terminated the agreement invalidly." "The letter implies that Link have purchased the debt from MBNA. As to the selling a debt prior to the default notice expiring that seems to me to be a serious breach." Please can someone advise, am new to this and starting to think i'm a little thick Thanks
  14. Sent it 31/3/08 to Link - after receipt of their letter and finding CAG! Why does that change anything?

  16. Massamum, Have you had a tele call from them today? We have, they weren't sure why they were calling, she stated she was calling from the switchboard???? Told her we will correspond by letter - already sent CCA request.
  17. Not sure what it is I'm trying to find out, I'm a newbie, but no doubt will be learning an awful lot along the way. OH Rec'd default notice dated 6th March, from MBNA, they have stated have until 23rd March, if not settled will pass on for further action. Am I right in thinking that they have to give 14 working days and 2 days for postage??? Rec'd letter from Link dated 26th March stating they are new owner (assuming this is Notice of Assignment?), but then state it was assigned of 20th March??? These dates don't match up with MBNA dates, it's been sold/assigned to early. Is this a breach of something and if so how does it assist my OH? Have already sent CCA request. Look forward to your responses.
