Thank you 42man, I dont want to sound thick but what do you mean when you say apply at the same time, as the same time as what (sorry for sounding thick). Another question is do I have to attend court for the redetermination hearing. Is it possible I could stop this going any further by sending a letter to Restons and HFC explaining that I still havnt received the cca request.

Hello, I am new to this so please bear with me. Okay where to begin. I have had problems paying my creditors over the last few years. I was paying them by reduced payments until things got worse. I have been in a dmp for the last 4 months with payplan and thought everything was going really well until I received a claim form from HFC/Restons. I sent the forms off to payplan who dealt with this for me and ended up with a ccj, but the payments to remain the same. I have today received another letter from Northampton court telling me the claim has now been passed to a Local court for redetermination. (not Happy). I have spoken to payplan and thay are going to speak to their legal team and get back to me. Right,still with me. My question is, back in June last year sent a letter to HFC requesting a copy of the credit agreement, which I still havnt received, after the twelve days were up I sent them another letter saying they had failed to produce agreement and account now in dispute. Am I right in thinking that thay should not of passed the account to Restons while it is in Dispute and is there anything I can do about this now. I received the ccj nearly twelve months after requesting the cca. Can anyone give me any advice on what to do next, because I am getting very anxious over having to go to court. thank you in advance for any help given
