  1. HMRC can dispose of the goods, if they are perishable, before you can even dispute it. Tobacco is classed as perishable so they had a right to destroy it. The best you can hope for is a restoration back to the price you paid with perhaps an allowance for the cost to travel. I don't know why other posters have such an issue with it as you've already proven your case to a judge so shouldn't have to answer to judgement here. Some people many only be able to travel once every few years and to take advantage of something that's cheaper, for personal use, and is only going to rise in price in the future makes sense. It's your money and the allowance is only a guide, not a law. Just beware that they will monitor you if you travel frequently.

  3. What limit is that? There is no limit within the EU and the OP has stated it's personal use so that's not for us to question intention as they have already proven that to a judge. There is nothing stopping you baloney from suing them but you will only get back the cost of the goods. It can't hurt to ask for the reasonable cost to put you back in the position you started from to purchase more.
  4. Just creates more of a black market. They can't stop the illegal drugs going into prisons so what hope do they have for 20 B&H? When all smoking is banned the compensation ambulance chasers will pick on another target. Where would we be if health workers refused to be near to anyone or anything that posed a potential risk to them?
  5. I forgot to add that I'm now waiting for the hospital to call me to arrange something between now and Monday to be seen. Not looking forward to it being looked at again and messed with.
  6. Not a happy bunny! After I first had the accident I was told that it would be referred to 'plastics'. I did see someone that was presumed to be from 'plastics' shortly after in the same hospital. They advised just dressing changes to be done at my GP. After plodding along since I last posted here, with regular dressing changes, the nurse at my GP wasn't happy with the way it's healing..or not. They got the GP to look at it and other nurses and they think the same. It's still swollen, not healing correctly and they query that there could be other damage as it's bent oddly much lower down and not from just lack of use. The GP looked at my notes and said they don't have anyone from plastics at the hospital I was treated at and I should been referred at the time to the hospital that specializes in it. The person who I saw in the hospital must have just been a general nurse and no appointment was made with the people I should have seen. My GP has had to try to rush through an appointment to see them as soon as possible and I can't fault him having to call several times just to get through on the phone to the right dept. I thought I was doing pretty well and had turned a corner with looking at it and the pain settling down a little. The nurse accidently caught it on Monday when cleaning it and since then it's become a lot more painful but without any signs of infection although the bone is questionably still exposed and since then I can't stand anyone to touch it. I did ask about it just being removed and closed. Unlike before, none of the people I've seen today have dismissed it, or said anything other than it's not looking good. It's been almost 6 weeks and, apart from the pain, it's annoying that I still have to rely on other people as I still can't drive. On the brighter side I've discovered that I can draw and write with my left hand pretty well.

So much fluff and fuss about Syria, not that it's not worthy, but what about the chemical warfare that's dished out daily by the denial of drugs and treatment to patients in the Western World to save lives or any part of the world? I don't see summits about what's inhumane in that and why Governments can pick and choose who lives and who dies according to wealth and status. The lucky ones die quickly without being a burden. Just saying...Rant over..
  8. I injured my middle finger, right hand, 3 weeks ago. I'm right handed. Turn away if you are squeamish please. The pad is completely missing, along with the tip and bone at the end. The rest of the bone is cut in 2 along the length. After 3 weeks of no improvement, an allergic reaction to the antibiotics and constant pain I'd prefer it to be amputated. It's not going to be of any use as the nerves are damaged and I'd much sooner have the wound closed and a hand that functions. I have asked but they seem to avoid the question and say to wait .. I don't want to wait and have a finger that is just bone covered with a bit of skin as they are sure to say it's a non-essential operation even if it's causing pain or distress. I'm having dressings changes twice per week and can't look at it. It's not nice when the nurse cringes and my OH goes a bit white and his hand shakes more than my good one that's holding on to him. I'm not difficult, I don't cry or scream but each change takes 30 mins..with the nurse sweating buckets. I smushed up a toe years ago and I have no feeling in that, other than horrible ones, so I really don't want that in a finger. My toe was squashed by a wall falling on it and my finger was in a battle with a door. The door won. I just feel that the right thing to do is lose it and close it. Can I insist or make a formal request that it's done?
  9. I tore the ligaments and bone off in my ankle about 4 years ago. It was only X-rayed once and they couldn't tell the extent because of the swelling. It was put in a cast for 2 days and then an air-cast because I was going on holiday. When my OH joked in front of a Dr. that he was glad it was just a sprain, they said it can take far longer to heal than a fracture. I can vouch that it does and it took at least 2 years to even feel steady without limping and even now it's still not 'right. I force myself to use it and put my weight on it now without anything happening. Part of it I put down as fear...When something hurts, or you think it will hurt, you avoid it - when really you should be doing the opposite. I was told that it was going to be prone to arthritis, pretty much like every other bit of my body I've managed to break.
  10. Losing part of a finger..Give me a broken arm, leg or just a complete bit off! Why do I have to be so awkward and not keep it simple?
  11. After all the threads on here I just don't understand why people reply to these threats unless they have a serious debt. If several years have already passed and then you get an SD then it's nothing but clutching at straws in the hope that you will respond. They don't want to take the court route as it costs money, time and effort. For what? £4000 which you probably don't have and they've had to pay the court costs and the server? They could be last in line of creditors and get £0.01p in the £. Don't encourage them and leave it to them to PROVE the debt and to take it further than just a threat-o-gram.
  12. That doesn't sound like an air freshener! Do you have any warranty with the car or anything on your insurance to get a hire vehicle? I'm afraid you have to dig your heels in and insist they put the situation right to your satisfaction. Put it in writing to them and tell them if you have to take it elsewhere or incur any costs you will bill them for it. They soon change their minds as my OH bought a car from one of their branches and after a few weeks of them denying any problems they were quick to fix things when challenged with court action. Ask to speak to the person in charge and take it to the top...don't just speak to the garage monkeys.
  13. I'd agree with those comments. We asked for everything in writing but they insisted on calling. It took several strongly worded letters and threats to get them to play ball.
  14. Lloyds win on a credit card, 406 squid! They protested that I didn't have PPI until I sent them copies of old statements to show that I had. I don't have a specific thread for that but it is mixed in with my other claims.
  15. It seems more people are falling foul of hire companies advertising cheaper rates but if you look carefully they can sting you with added extras you just didn't bargain for. In my local rag today there was a column stating that companies were charging for fuel even though cars had been fully topped up before being returned with photographs, receipts and mileage records. 19 emails later the person was still no nearer a refund despite the car being full to the brim as they let it settle before adding a few drops more. They advise to always pay on a credit card, top up at the nearest fuel station before returning the vehicle, ignore any pressure and make sure every part of the car is checked and photographed and signed off before and after. Get your fuel receipt signed off and make sure they sign to say there is no damage to the vehicle. It's seems to getting a common problem so just stand your ground...
  16. Sorry ..I didn't make it clear....I did mean the company you purchased the car from for SOGA. But they can pursue you as the one that sold the car. You seem to have owned the car for only 3 months? Sold in May and bought in February? The OP does not say it is a private sale and I'd be wondering why it was sold after 3 months. This sounds like a trader but that's just my opinion and that's why I think the aggrieved person has quoted SOGA. My concern would be that if the OP purchased the car from a company then they would have paid well over the price for it, if it has indeed done 170k and not 90k. If I was the OP I'd be bothered by that and making a case myself against the company who sold it to me. There is no mention of that and it was sold after 12 weeks?
  17. SOGA does apply....even on second-hand goods...and they must be as described. They do have a claim against you even if you didn't know of any alteration on the mileage. You'd have to claim against the company that sold you the car. It's easy to check with VOSA on mileage, and with tax and insurance these days.

  19. They are just trying it on... As it's local ask to the see the car again and take you own photo's. It's probably a pin-prick of a dent that was there before or they have caused. Minor dents should be covered as fair wear and tear otherwise you'd be crawling along to stop any stone chips! Just stop them taking money from your account first.

  21. I've been with them before on a 2 year rocky road. But during that time it did keep the wolf at bay when it came to my mortgage company trying to impose every charge they could think of. I won in the end and the rats have been like kittens since... I'm pursuing a PPI complaint and the FOS seems far quicker now. I thought I'd have to start again as the it's a long chain I have to pursue but no.. the FOS have done it all for me. They have tracked everything for me and sent it on. A company has denied receiving anything but they can't really say that honestly when it was also sent by the FOS..snail mail and email as well as by me! The FOS have improved. It's still slow - but I think that gives you the greater power to prepare what you put forward over the court system. And it's free ... with the right to go to court if you still aren't happy. It's worth a go if you're in a situation that you need help with and certainly better than nothing. I don't regret using them and I can't fault them at this time.
  22. They have a right of appeal, or to stay silent, but at least your money is going to earn more interest until the Ombudsman rules. It's not going to go away and it seems very much in your favor by them not replying promptly.

  24. No court proceedings, no nothing... I'm a little disappointed they didn't go that far. It 'seems' like they pluck ones at random, regardless of value, and try to exploit the recipient for charges that they just don't owe and there is no legal basis for. As postggj has said, their letters and responses are threats and bogus. They must be raking it in if people are actually paying these amounts and being lead into thinking it is a legal tax or duty they owe. My advice is just to ignore them.
