  1. Yeah....It is good news and it would be one less creditor and set of DCA's to have to deal with!
  2. Ok thanks...do you not think its worth asking again for the full amount I requested which is over £100 more than the current balance?
  3. They have said they will right off the outstanding balance as full and final settlement.
  4. Update: I recently aksed BC for all my charges back for the last 6 years, which was actually £100 above the current balance on the account. They have responded by saying their charges are fair and in line with their T+Cs. However as a gesture of goodwill they have offer to pay off the amount I allegedly owe them as F+F settlement. Good news....or is it? Should I insist on the full amount to be refunded? and how would I go about getting them to remove details from CRA's??? Not sure on how to play this one....any advice would be appreciated....baring in mind they have not provided me with a enforceable CCA!

  6. Still no sign of the SAR document, I have asked for them to be made available at my local branch so I can show them ID and collect in person. There was no response to my letter. Also the account has now been passed to Lowell.

  8. I received letters from NCO, gpb solicitors, instrum justitia, s.c. leatham-locke and iqor. Not one of them has attempted to carry out any of their empty threats! If you recieve any threats what so ever then you need to tell them that you are reporting them to the police. I have done this and it helps calm things down. I paid money back to several ebayers after several tickets had been stolen/lost in the post!
  9. carlose, A very similar scenario happened to me and I have been getting letters from various companies for about a year. I do not have any intention of paying paypal or any of their collectors a single penny. They will get bored after a while! I haven't received anything for a good few months now.
  10. I had a few demands for payment from Triton. Today I recieved a posh looking letter from Green & Co Solicitors who say Triton and in turn Tesco have demanded payment and I have failed to comply. They will now commence court proceeding unless I pay up within 7 days. They have not answered my SAR so far, should I advise them that the account is in dispute as it contains unlawfull charges that I wish to claim back?
  11. Todays letter is from DG Solicitors, who are acting on behalf of HSBC. As I have not met HSBC's demand of full payment they have been instructed to take legal action against me. They go on to say I have 14 days to avoid legal action.

  13. I know...I couldn't believe my eye's at first! Thanks for the info and letter guys! I forgot to mention, this actually came under a Metropolitan covering letter!
  14. OMG what utter incompetance! SAR arrived today! What a can of worms it is! 1)They have only sent me statements for my flexiloan and not my current account. 2)They only have sent me correspondance over the last 6 months. 3) The CCA they have provided is NOT even mine!!!!! Diffrent name, account number, dates, signatures, amount and type of loan! 4) They have broken the Data Protection Act, they have provided me alsort of account information for someone else! This in the wrong hands could be used for fraudulent activities!!!!
  15. Just received a letter regarding my SAR which confirms my £10 fee has been received and that my request is being processed. However, they state that they need me to contact a member of their team to ensure that they match my exact requirements. They go on to say that HBOS is not obliged to supply records held in paper format (Original CCA?) if they do not form part of a relevant filing system (Who defines what is and isn't their relevant filing system?). They then state that in order for the to select data regarding telephone call's; I must provide them with specific dates, times, telephone number I dialled and dialled from, and the name of the colleague I spoke to! (Obviously I would not have these details recorded!). Has anybody had this experience or know the best way of dealing with their obstacles to prevent my SAR?
  16. Just dug out a copy of my most recent T&C's which came with my CCA request. There is a paragraph 8f which states: Subject to sending you any notice required, you, or your legal representatives, must immediately pay your whole balance (icluding all interest and charges and fees due). Does this make any diiference? as I have not signed for these T&C's! Can you explain why do you think the CCA is duff? I have the envelope filed, thanks! It has UK Mail express parcels & mail (S postage paid GB, C9 10022.

  20. Another Wescot demand for paymnent! Think I should send the the following.... Dear Sir or Madam, I must admit that I am rather bemused as to why this account has been passed to you, as it is in dispute with ***DCA*** and has been since ***Date*** Not only is this a breach of OFT collection guidelines, but also in breach of the Consumer Credit Act 1974 and Data Protection Act 1998 As ***DCA*** is now in default of my Consumer Credit Act request, Office of Fair Trading Collection Guidelines and s10 Data Protection Act request, I consider this account to be in SERIOUS DISPUTE. As you are aware while my Consumer Credit Act request remains in default, enforcement action is NOT permitted; under s127 this constitutes a complete defence at law. Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS. Now I would respectfully suggest that this account is returned to ***DCA*** for resolution of these defaults and breaches, as ***DCA*** cannot lawfully pursue any enforcement activities. If ***DCA***chooses to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, Financial Ombudsman Service and possible court action. I hope that this will not be necessary and an acceptable solution can be accomplished. I would appreciate your due diligence in this matter. Yours faithfully
