  3. So all these cmcs, who are taking on cases by the thousands soley on the back of section 78s. What are they going to do now?
  4. If a section 78 is now deem to be useless in ascertaining enforcability, how do you now discover whether an agreement is enforceable?
  5. Couldn't find an existing thread with regards to debt transfers so appologies to site management if there is one already. Does anybody know anything about companies buying perople debts of them. Apparently there is a company out there who will purchase your debt of you (unsecured pre April 07). A mate of mine who is a mortgage broker has done it with a loan he had. He has a contact from the company who have "legally purchased the debt from him for £1". He was given template letters to send the all the credit reference agencies, and has receive a response from one within 3 weeks stating that the said loan does not show up on their credit report anymore. The company charge £250/£350 up front plus 10% of the outstanding balance to transfer the debt over to themselves. The whole process took 3 weeks. Does anybody else know anything about this?
  6. Do you know whether the procuration fee that the appointed rep received was paid direct, or to the principal. It should say on the KFI (Key Facts Illustration) the broker gave to you or the offer document. Wgat was the name of the lender and the bridging company?

  9. Hi I have recently requested my CCA from MBNA (Virgin credit card). I wrote to them asking for a copy of it saying I was getting my affairs in order, and received it back within 10 days! I think if you ask nicely and don't send them a threatening letter you have more chance of a quick reply. That's just my opinion, but I am new to this, and judging from what I have read on her, there are many that know much more than me. There is a link below to view what they have sent me. I would be grateful for you thoughts on it. It looks a load of rubbish to me. It looks like something that they are just drawn up and printed off. Have a look and see what you think!   10. Hi All I have had my CCA from MBNA (Virgin CC) within the allotted time. Not sure whether it is unenforcable. To my, it looks like something that they have just drafted up. If I post it on here can someone take a look at it and tell me what they reckon, or failing that can someone post me to a thread relating to a copy of an MBNA CCA.   11. Has anybody heard of the Debt Advice Network (DAN)? I think it is a charitable organisation that advises people with debt problems. Has anybody heard of them and if so whether that a worth speaking to.

  14. Hi I am using a company called Loan Resolutions. The seem to be very ethical compared with most of the other sharks out there that are in to this. They charge a fee up front, but nothing back end apart from PPI claims which all these companies do. If you want further detail get back to me or google Loan Resolutions.
  15. Hi I have a question with regards to a secured loan I have on an (Commercial) investment property with HSBC. I used to bank with them and moved to NatWest when they tried to call in my relatively small overdraft. I wasn't worth re finacing the loan else where as I couldn't find a deal as good elsewhere. HSBC are now insisting that I have another valuation done which I have agreed to. However they have contacted a surveyor who want to charge me £400. I have said I would rather use someone else with a perfect reputation in my area who will only charge £200. They are told me this is not possible, but failed to give a reason. I currently owe £62,000 with 13 years left. Rental income is £500/ month. Worst case senario the property is worth £80k in present market. I can't see why the need another valuation doing. Also my repayment figure has recently increase from £650 to £940. I received a letter from them a few months ago saying this would be happening. This is very strange seeing that the loan is 3.5% above bank rate. If anything the repayment figure should be decreasing dramatically given recent rate reductions. The payment is made on standard order. Really is should be on a direct debit I think. I am however concered that they may call the loan in, although really they have no right to as I have not missed a payment ever, but if they ask for recent accounts there may be an issue. Any advice would be gratefully received. Thanks

  17. In which case if they don't reply in time you advise that I should stop paying my monthly payment and this in no way will affect my credit rating? Thanks in advance!!
  18. Many Thanks Scott fro the quick reply. What happens if they don't reply in that time and they are not likey to try and call the debt in as I couldn't repay it obviousl. Haven't defaulted yet but am likey to in the near future!
  19. Hi New to this, so any help would be much appreciated. Is this the correct letter I need to send to my credit card companies to request CCA? Dear Sir/Madam Re:- Account No: XXXXXXXX/Your Reference Number: XXXXXXX This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with a copy of the default notice, statement of account and any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply. If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR). I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee. You should also note that I will only discuss this matter in writing and should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you or any of your associates. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.   20. Hi Everybody Was wondering if anyone has had any luck with unenforcable credit agreements. By this I mean has anyone had a credit card balance wiped? If so, did it go to court or did the lender settle before it went that far. Who was the lender. I'm thinking about giving it a shot with Virgin, but don't want to waste time with it if it doesnt go any where as I have not seen any test cases in the press that have reached a court room. Any advice would be much apreciated.
