  2. Hi andy Sorry if i seem to be whinging on (just re-read the above post and it looks like i was being ungrateful!) ..big thanks for your advice and hope I haven't scared you off. Will be tipping your scales big time!! Your advice has been invaluable well received & I meant to say I'll be filling the form in as you recommended but not sure about the negotiating as cohens/CL finance don't seem to be very cooperative.   3. Thanks for your prompt reply. With regards to negotiating The problem I have with the claim is that at no time have I taken out an agreement with Santander Cards so I am unaware of what I would be negotiating never mind defending . The only thing I think it could be is an old bank account I had with the Abbey (now owned by Santander) which was in arrears but the bank very kindly brought the account back to a zero balance (I stiil have the letter confirming this). I had started using a different bank account and promptly forgot all about the Abbey account. I also as explained moved house shortly afterwards. The other option is a dorothy Perkins storecard but the sum s owed was far lower than the claimants are claiming without costs. If i had any inkling as to what the claim was for it would be far easier to cope with either negotiating or defending the claim. It's so frustrating With regards to Section G, the claimants haven't even partially complied with my request. I have only a refusal from cohens their solicitors to comply and no reply to date to my second request. As a bit of background,unfortunately, I have absolutely no income (apart from tax credits) which I can negotiate with. My OH works but in a poorly paid job, we have a failed business (owe tens of thousands) and live in a rented house. I have no bank account and no assets (apart from a 10yr old car). Kind regards MA

  5. Hi Andy Thanks so much Andy ..most of the time I can cope with things but today just seems to be an off day! The AQ is N149 I am presuming that I have to repeat what I said on my previous defence form. Can I also mention that I never took a credit card out with Santander cards..if it was a credit card? Do I also send copies of the correspondence so far with the Cohens? kind regards MA
  6. Help please I would be more than grateful..have just received the allocation questionnaire. Am okay with most of the form apart from section G. Do I reiterate what I said in my first defence to Northampton. Cohens still haven't complied with the CPR request, over a month later! Am on the edge of a breakdown as this is the thin end of our debt problems(failed business etc) and know that i'll have to go through this again. Bankruptcy is looking good though can't even afford to pursue this option! Help! MA
  7. Ooh & thanks Andy I'm sending the defence & letter to Cohens re their non compliance with the CPR 31 tomorrow via recorded delivery...a 8 mile trek to the nearest post office. I had 30 days from the 22nd June plus an extra 7 for the AOS so have plenty of time. Fun..my head hurts MAx
  8. Ooh yes please...the bull mastiff sounds like a star. We've got a border collie who's started barking at the walkers going past our gate. Might start training him to respond to words like 'debt collection' in readiness for the gophers from Sharkleys (nice name!!) if they ever decide to get their boots on & trek up here:D
  9. Hi Copier; Know what you mean re going over your head. The 'lawyer speak' makes my head hurt. I'm sure at the end of it all we'll be experts! I agree it is nice to know you're not on your own, without this site I don't know how I would have coped. The stress alone would have made me ill!! But hey shouldn't let the b******ds grind us down:D MAx
  10. Many thanks for all your advice. Have just phoned the police who have taken it seriously. They did tell us that it sounds quite suspicious as credit card companies don't normally act like this. DCA's do though but my son is convinced he said barclaycard not Barclays. The house is quite large and it looks (apart from the crappy cars outside) that we could have money...ha ha!! Anyway the local police will keep an eye on the place..bit scary really!
  11. If we find out who it was we will certainly report them to the OFT. Luckily my son is nearly 18 and fairly taciturn (be surprised if the man could understand him!) Did wonder if they were sussing out the place (see what the bailiff's could seize)..its a big house but rented...ha ha...with 2 old bangers in the drive...ha ha!

  14. Many thanks dx. will pass on your advise to my OH. We won't be communicating with wescot via phone as there is now way on earth we can afford to pay back Barclays (the original business loan was for £12k!). We recently closed down the business (read my thread on barclays taking my benefits for some background info on this one) Just puzzled how anyone could have found the place, as usually sat nav stops at the bottom of the hill. We are marked on an os map though, so they may be skilled at map reading LOL;)
