  3. started to get from my creditors( DCAs) You are late with your payments.Stopped paying all creditors, sent CCA to all, not one has produced a copy of the original agreement. I guess IGNORE , or do I just send them stop pestering me until you produce a Signed agreement. ,or just put up with nuisance mail FS
  4. I am no longer paying PRA (Exporto,Varde, MBNA) They have sent a copy of the T&Cs, the card was pre 2007,but surely just sending T&Cs is not sufficient, or is it?? Thank you FS

  6. Dx something I should have carried out a number of years ago, and carried through, my own fault. I have now CCAd again the 5 companies involved and stopped all payments, to date 2 have written and confirmed the account is unenforceable. 2 have referred back to Arrow and awaiting reply which is way over the 12 working days, Same with Natwest Thanks for your help regards FS
  7. Has anybody managed to have payments refunded where for example a credit card company cannot produce a signed agreement but you have been paying the debt back by a small amount each month for a considerable time??? Logic probably. wrong, any thoughts FS
  8. So sent out 5 CCA requests, Cabot have already stated unenforceable. PRA have also stated unenforceable even though they managed to come up with signed application form Link not bothered to reply Moorcroft 2 CCAs replied have sent a request to the OC,I am sure Moorcroft own the debts. So I am not paying any of these well exceeded 12 working days Only problem is Natwest Bank Account obviously no CCA, should I just stop paying them and see the reaction, can always use current cost of living increases FS

Yes it is MBNA ..Exporto... sent CCA as you suggested because I have been paying through Stepchange who I will scrap when I have had the various replies .PRA return your £1 send letter they will look into my request and will not pursue until they have the required document, However they enclose an information leaflet stating if they cannot produce the original signed document they will supply a reconstituted copy. The fact this has been MBNA and then Exporto and now PRA doubt they can produce the original Question how do I deal with a reconstituted copy agreement??? Thank you DX FS
  11. Had a letter from PRA and they state if they cannot supply the original CCA agreement they will send a reconstituted agreement is this still legal Thanks FS
  12. posted in wrong title..........sent CCAs as suggested DX first reply is from CABOT who clearly state they cannot at present produce the signed contract hence in their words "Unenforceable" but they suggest I continue to pay, the answer is surely NO. is this correct FS
  13. sent CCA request to those debts on my Stepchange List as you suggested DX, the first to reply is Cabot, state they have been unable to obtain the information, but will contact me if it becomes available, until then it is unenforceable, the balance remains outstanding and you pay through payment plan, continue to pay I think the answer is NO stop paying is this correct?? From memory I believe you cannot send a CCA for a Bank Account, what is currently the best way to deal with this I pay them £5 a month and am in the throws of sending CCA to other companies (already posted) will wait 12 working days from Monday, it is just the bank account I'm not sure how to approach it Regards
  16. dx....10+ years with Stepchange I wanted to clear my debts but over the last few years I have only paid them £5 for each creditor ,they are unhappy that I can no longer pay anything and are taking for ever to approach creditors so I will do it myself.Will raise a new CCA request, so if I do not pay them what action can they take FS
  17. Been paying creditors through Stepchange at approx £5 per month, can no longer afford to do this due to cost of living increase. Have approached one creditor to see their reaction, Link Financial, they have replied NO, they will not write the debt off, even though I have stated there will be no further payments, what action can they take the debt is old, and Barclaycard the original creditor were able to produce a copy of a signed agreement. many thanks

Thanks for the response, this is Hypothetical in as much that in my opinion Benefits should never be used to pay any debts as that is not what they are designed for.Hence my comment about the State Pension this is a Benefit,and I should imagine many of us use this to pay of debts through say DMPs. Just seeking opinions Many thanks FS
  19. Have tried to Google the answer, come up with vague answers. Surely they cannot take money where Priority Debts are involved (ie rent, HMRC tax, council tax etc etc) Can they take Benefit Money to pay towards Non Priority Debts ( ie Bank, credit cards etc etc) The reason for asking is I feel DCAs should not be able to touch Benefits to pay any Debt,should this be the case, it raises the question State Pensions are considered to be a Benefit, Opinions Please FS
