  1. Hi looking for a bit more advice on this one. I never sent a CCA request to the OC in regards to this loan and I still have never received any CCA. However on checking my credit report I have noticed that they have placed a default in 2006, 2 years after stopping paying them. In the mean time they have no correspondence asking for repayment. What should we do as I would like to get the default cleared as I think it was unfair that they defaulted 2 years later without notifying me of the default.
  2. Hi SW I am in the same position as you with my partner and I having several debts with different creditors. Don't despair, follow the advice of the fellow Caggers above. The advice and support is invaluable and I have finally taking control. Good Luck

  4. Thanks DP Have cancelled the direct debit and hopefully won't be paying any money to Apex again. We did however ask them to prove it when we first started dealing with them, but we never did it in writing til now. Hopefully that is one DCA off our backs until the next one. But now I know what to do, I will writing a CCA letter to all the DCA's that try to collect this debt. purple:)
  5. Need some help. Apex have closed the account and refer it back to original creditor. Have still not seen a reply from OC. Should I send a CCA letter or in dispute letter to original creditor. Or do I do nothing and see what happens. Regards purple
  6. Thanks Madasmuppet for clarifying that the 30 day limit no longer applies. I have read through so many posts and when you go to look for the info you need some how you can never find it. Will send account in dispute letter tomorrow.

  8. I requested the CCA as we were previously paying the OC for a loan and CC through a DMP with CCCS. My partner and I decided to go it alone and phoned OC who put us in contact with Apex and was told that the amount owing was for both the loan and CC. However Lowell started chasing payment for monies owed to the OC as well. (another thread started) Have sent CCA request to them as well as was confused to who we should be paying. To date I have received no reply.
  9. Have sent a CCA request to APEX and have had the following reply with the PO returned. Further to our letter dated xx/xx/xxxx, the contents have been noted. Apex Credit Management are not the data holding branch and are therefore not obliged to supply the data you have requested, this information should be requested from our clients. As a gesture of goodwill I have contacted our clients to obtain documentation, however our clients are unable to supply the data in the time-frame remaining. I have today closed your account with ourselves and returned your file back to OC. Please contact our client directly for a copy of your credit agreement. I am a bit confused as the letter says they have contacted the OC for the documentation and then it says that I need to contact the OC directly for a copy. What should I do now? I have not received any response from the OC and the letter to APEX was sent over 14 days ago. Do I send a dispute letter or should I start again and send the CCA request letter to the OC.   10. Am still waiting a reply, not even a letter asking why we have not paid them. Am requesting CF to see if default has been removed. Not holding my breath!

  12. Thanks Blueda for your reply. It is quite nerve racking sending CCA requests as you don't know what the outcome will be, however have been reassured with the outcome of many others on the site. Decided to use the Rosyth address, we will wait and see if we get a reply.

On holiday today and am trying to get the ball rolling in regards to getting a CCA, etc. Looking at the letter from RWay I notice that they only quote one account number, I know in the previous threads I have said that I know that this is for 2 loans and an overdraft, but I don't I have this in writing from RWay. My question is should I send one letter & £1 PO in regard to the one account number they are refering to, or should I be proactive and send £2 as I know that it covers two accounts. Any suggestions?
  14. I am writing a letter requesting a copy of my CCA in regards to a debt with BOS. Has anyone ever had an unenforceable CCA from them or received a copy from them. Have been making payments for several years now and it will probably be another several years before it is paid off. Also on their letters they have two addresses one at Rosyth, Fife and the other is Manchester. Which one should I use to send my request to? Any help greatly appreciated. purple

  16. Thanks Sam for your reply. Have looked at the track and trace website and it tells me that it was delivered from their Holbeck Delivery Office on 03/03/09. Can you point me in the right direction for a template of the in dispute letter, as I could not see one in the templates section but then again I am getting square eyes with reading through all the threads.
  17. According to my calculations the 12 + 2 days are up and we have had no acknowledgement. Have just noticed that my partner has sent the letter by special delivery rather than recorded. Does this matter? I have a question and it may sound stupid but how do I find out if they have cashed in the postal order.
  18. I have received some letters and now a postcard for a doorstep collector from Penine not to mention phone calls at my work in regard to Honours Student Loans. The agreements are dated 97 & 98 which were originally taken with the Student Loans Co. I made payments for all three agreements to the SLC until 2002. (the other was a loan from 99 which has now been paid in full) I know I have made deferments since this time however I think this only deferred the agreement that SLC kept. I think you need to send two seperate deferment forms. Anyway my problem is what do I do now. Do I CCA, SAR or do I send a letter informing them that the debt is statute barred (hoping that it is?) Any response will be greatly appreciated.

  20. Thanks for your reply Silverfox. I am also paying them for two loan accounts, therefore I presume I ask Robinson for CCA's for these. Sorry this may sound stupid, but just to confirm I send the SAR to the bank even though it is Robinson I am paying. Just a little background, this overdraft was on a student account which according to my CR defaulted in 2004.
  21. The original OC is Cahoot and the debt is over six years. We were originally paying through a Debt Management Plan which we cancelled and contacted Cahoot directly who puts us in touch with APEX. We asked if the debt was for both the loan and credit card and they agreed. We asked for this in writing however never received anything and then guess what. Last year out of the blue Lowells contacted us saying they were looking for payment of the credit card debt, we asked them to prove this as we thought we were paying and received nothing, they got threatening so we ended up paying an instalment by direct debit. And of course a default was recorded on my partners credit report.

I am currently paying money to Robinson Way and have ask them to send me proof of the debt, however this was on one of their many phone calls and all they did was recite some account numbers which I am supposedly due money to. I am going to write and ask for copies of the CCA's but was wondering if I would have signed a CCA for a bank overdraft? Any feedback would be greatly appreciated.
  23. Thanks Sam for your reply. Couple of questions before I send letter. We have recently changed address, should I make reference to this in the letter I have copied letter template N. Hopefully they shoud not have our telephone number as that has changed as well.
  24. Hi I am new to CAG and have spent ages looking at all the info, my partner and I have had experience with a number of DCA's and quite a few of them have already been mentioned! Tomorrow I will be printing off a letter using the templates I have found to Lowells requesting a copy of the CCA for my partner. He already asked for it verbally when they started chasing him but we have now learned from your site that it needs to be in writing. Unfortunately he has already started paying them back by DD which was stupid as they have suddenly increased the payment without warning. Will keep you informed of our progress and will be sending more CCA letters to our other DCA's. Keep up the good work as their seems to be lots of information, I only wish we came across this site earlier it might have saved us a lot of grief
